RESOLUTION NO. 2494
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, FIXING
THE COMPENSATION OF VARIOUS EMPLOYEES
OF THE CITY.
WHEREAS, on July 3, 1973, the City Council adopted Resolu-
tion No. 2488 entitled:
"A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, FIXING
THE COMPENSATION OF VARIOUS EMPLOYEES
OF THE CITY AND APPROVING A MEMORANDUM
OF UNDERSTANDING."; and
WHEREAS, said resolution increased the compensation of cer-
tain employees except for persons employed under the Public Employment
Program of the Emergency Employment Act of 1971; and
WHEREAS, Subsection (a) of Section 55. 19 of Part 55 of Subtitle A
of Title 29 of the Code of Federal Regulations provides:
"(a) Participants shall be paid wages or a salary at a rate
which is not lower than whichever is the highest of (1) the mini-
mum wage which would be applicable to the employee under the
Fair Labor Standards Act of 1938 if section 6 (a) (1) of such Act
applied to the participant and he were not exempt under section
13 thereof; (2) the State or local minimum wage for the most
nearly comparable covered employment, or (3) the prevailing
rate of pay for persons employed in similar public occupations
by the same employer. In addition, participants shall receive
the protection of the same workmen's compensation, health in-
surance, unemployment insurance, and other benefits as other
employees of the employer similarly employed, and shall enjoy
working conditions and promotional opportunities neither more
nor less favorable than such other employees enjoy. "
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That pursuant to the mandates of the Code of Federal
Regulations, effective July 1, 1973, personnel employed under the Public Em-
ployment Program of the Emergency Employment Act of 1971, on and after
July 1, 1973, shall receive the compensation increase provided in Section 2
of Resolution No. 2488 and the holiday and sick leave fringe benefits provided
in Sections Nos. 3 and 4 of said Resolution No. 2488.
SECTION 2. The City Clerk shall certify to the passage and adop-
tion of this resolution; shall enter the same in the book of original resolutions
of said City; and shall make a minute of the passage and adoption thereof in
the records of the proceedings of the City Council of said City in the minutes
of the meeting at which the same is passed and adopted.
