CC RESOLUTION 2473y_ RESOLUTION NO. 2473 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, URGING THAT THE AMENDMENT TO THE QUIMBY ACT RELATING TO OPEN SPACE REQUIREMENTS FOR CONVERSION OF APARTMENTS TO CONDO- MINIUMS BE REPEALED. WHEREAS, this City Council has been advised that a Bill has been passed and signed by the Governor which has the effect of denying local governments the right to require open space or the payment of park fees for subdivisions resulting from the conversion of apartments to con- dominiums; such law being the effect of AB -1435, AB -376, or AB -1363; and WHEREAS, the result of such law could be to severely limit the financial ability of local governments to establish open space or provide parks for heavily concentrated areas and run contrary to the philosophy and purpose of the original Quimby Act and the Supreme Court's decision in the Walnut Creek case; NOW, THEREFORE, the City Council of the City of El Segundo, California, does hereby resolve as follows: SECTION 1. That it urges all members of the legislature to reconsider their act which permitted the referenced law to become effective. SECTION 2. That it suggests that such law was adopted with- out adequate consideration in that it contains ambiguities impossible of inter- pretation without resort to the courts. SECTION 3. That such law is ill- advised and was apparently adopted in the last minute rush of legislative business without sufficient con- sideration being given to the overall effect such act would have on local governments. SECTION 4. That it has been clearly demonstrated that such conversions result in very substantial financial gains, thus evidencing the ability of apartment owners to contribute to open space or park areas. SECTION 6. That copies of this Resolution be sent to our elected representatives in the State Assembly and Senate and to Assemblyman I -) John P. Quimby. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
