RESOLUTION NO. 2468
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, AMEND-
ING RESOLUTION NO. 2458 (THE SALARY RESO-
LUTION) BY AMENDING SECTIONS 14. 00, 15. 40,
24. 00, 24. 10, 24.20, 24. 47 AND 26. 10 RELATING
TO REQUIRED REVISIONS FOR IMPLEMENTATION
OF A FOUR *TEN WORKING SCHEDULE.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER
AS FOLLOWS:
SECTION 1. Section 14. 00 of Resolution No. 2458 is amended
by adding thereto Item No. 1. 1 and amending Items Nos. 6 and 7 to read as
follows:
"1. 1 Ten hours shall be deemed to constitute a day's work for em-
ployees assigned by the Chief of Police to a four -day ten -hour
working schedule.
6. That all employees of said City (excepting those to whom these
rules do not apply, as hereinabove or hereinafter set forth),
shall render their respective services on a working schedule
of eight hours per day or ten hours per day for employees
assigned to a four -day ten -hour working schedule, or forty
hours per week, and the City Manager shall designate the
particular days and hours such respective employees are to
render service to the said City. "
I. The City Manager may require any employee or employees
to render service for more than eight hours per day or ten
hours per day for employees assigned to a four -day ten -hour
working schedule, or forty hours per week in any and all
cases where the City Manager feels that such additional ser-
vice is essential for the best interests of the City at the time. "
SECTION 2. Section 15.20 of Resolution No. 2458 is amended
to read as follows:
"SECTION 15.20 OVERTIME PAY -- COMPENSATORY TIME.
Compensatory time may be substituted for overtime payment if
approved by the City Manager, provided that the accumulation may
not exceed twenty -four hours, or thirty hours for employees assigned
to a four -day ten -hour working schedule, or three working days at any
one time, and no more than eighty hours may be accumulated or used
in any one year. Compensatory time may be used in conjunction with
normal vacation with prior approval of the City Manager. No more
than three consecutive days of compensatory time may be used. "
SECTION 3. The first paragraph of Section 15. 40 and Items 1 a.
and 1 b. of Section 15.40 of Resolution No. 2458 are amended to read as follows:
"SECTION 15. 40 OVERTIME PAY -- POLICE DEPARTMENT.
Except as otherwise hereinafter provided, the members of the Police
Department of said City shall work regularly scheduled shifts to be
promulgated and established from time to time by the City Manager,
and all of the members of said Department shall be subject to call
for service at any and all times. It is provided, however, that where
a member of the Police Department is required to render more than
eight hours service,or ten hours service when assigned to a four -day
ten -hour working schedule, in any one day or more than forty hours
per week, such member shall be entitled to receive, and there shall
be paid to him, additional compensation for such overtime at one and
one -half times his or her regular rate of pay, unless such member is
the Chief of Police of said City.
"a. Officers promoted in rank and who are required to attend
in- service classes to gain the knowledge necessary to per-
form their new duties and responsibilities of said position,
shall not be compensated in overtime pay for the hours
spent in training over and above a normal eight hour day,
or a ten -hour day for employees assigned to a four -day
ten -hour working schedule; and
b. Overtime pay shall not be paid to police personnel who attend
a basic recruit school learning the duties and responsibilities
of their new career in law enforcement."
SECTION 4. The second paragraph of Section 19. 00 of Resolution
No. 2458 is amended to read as follows:
"Police and Fire Department personnel who are regularly required
to work on holidays, pursuant to this section and notwithstanding any pro-
vision herein to the contrary, shall be paid for eighty hours in lieu of
holidays once a year on or about the 10th day of December. "
SECTION 5. Section 24. 00 of Resolution No. 2458 is amended
to read as follows:
"SECTION 24. 00 SICK LEAVE: LEAVE WITH PAY DUE
TO ILLNESS: ACCUMULATION OF SAME. Sick leave with pay
may be granted for an absence from duty because of personal ill-
ness, injury, or legal quarantine not compensable under the provi-
sions of the Workmen's Compensation Laws of the State of California.
Regular employees shall accumulate sick leave at the rate of one
eight -hour day accumulation for each month's service, not to exceed
a maximum of 1056 hours. Hours worked in addition to a regular
work week shall not entitle an employee to additional sick leave accum-
ulation. Sick leave taken by an employee shall be deducted from his
accumulated credit. IT
SECTION 6. Section 24. 10 of Resolution No. 2.158 is amended
to read as follows:
"SECTION 24. 10 SICK LEAVE CERTIFICATION. Any em-
ployee taking sick leave shall, upon his return to work, sign a state-
ment certifying the reasons for such sick leave. Employees absent
five or more consecutive days, or four consecutive days for em-
ployees assigned to a four -day ten -hour working schedule, must sub-
mit a statement from a doctor that the employee was under his care
and is able to return to work. The City Manager may, before allow-

'ling such leave or before permitting an employee to return to work,
require submission of a doctor's certificate for any absence. Any
employee who makes a false claim to sick or emergency leave or
who refuses to cooperate in an investigation by the City of his claim,
shall be subject to disciplinary action. "
SECTION 7. Section 24.20 of Resolution No. 2458 is amended
to read as follows:
"SECTION 24.20 SICK LEAVE -- PAYMENT OF ONE -HALF
ON ACCRUAL. On the first day of December of each year, em-
ployees who maintain a balance of 1056 hours of sick leave accrual
shall be paid for one -half the sick leave accumulated and not used
during the preceding twelve month period. Payment shall be made
on or before December 10."
SECTION 8. Section 24. 47 of Resolution No. 2458 is amended
to read as follows:
"SECTION 24.47 SICK LEAVE TRANSFER-- POLICEMAN --
LATERAL ENTRY. Policemen who enter the service of the E1 Se-
gundo Police Department under the Lateral Entry Program shall be
allowed to transfer their accumulated sick leave from the preced-
ing employing agency at a rate of one hundred percent up to a maxi-
mum of two hundred forty hours. "
SECTION 9. Items Nos. 1, 2 and 3 of Section 26. 10 of Reso-
lution No. 2458 are amended to read as follows:
"1. Ninety -six hours per year with full salary for the first seven
years of continuous service with the City;
2. One hundred twenty hours per year with full salary after seven
years and until the completion of fourteen years of continuous
service;
3. One hundred sixty hours per year with full salary after fourteen
years of continuous service. "
SECTION 10. The City Clerk shall certify to the passage and
adoption of this resolution; shall enter the same in the book of original reso-
lutions of said City; and shall make a minute of the passage and adoption
thereof in the records of the proceedings of the City Council of said City in
the minutes of the meeting at which the same is passed and adopted.
