CC RESOLUTION 2436RESOLUTION NO. 2436 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DETER- MINING THAT THE PUBLIC NECESSITY, HEALTH, SAFETY, AND WELFARE REQUIRE THE FORMA- TION OF AN UNDERGROUND UTILITY DISTRICT ON GRAND AVENUE BETWEEN EUCALYPTUS DRIVE AND LOMITA STREET IN THE CITY OF EL SEGUNDO. (UNDERGROUND UTILITY DISTRICT NO. 1) WHEREAS, pursuant to Resolution No. 2431 adopted by the City Council on March 13, 1972, a public hearing was called for April 10, 1972, at the hour of 7:00 p. m. in the Council Chamber in the City Hall, El Segundo, California, to ascertain whether the public necessity, health, safety and welfare require the removal of poles, overhead wires and associ- ated overhead structures and the underground installation of wires and facili- ties for supplying electric, communication, or similar or associated service on Grand Avenue, between Eucalyptus Drive and Lomita Street within said City; and WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and all utili- ties concerned, in the manner and time required by law; and WHEREAS, such hearing has been duly and regularly held, and all interested persons have been given an opportunity to be heard; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, FIND AND DETER- MINE AS FOLLOWS: SECTION 1. That the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, com- munication, or similar or associated service on Grand Avenue between Eucalyptus Drive and Lomita Street, and such described area is hereby estab- lished as Underground Utility District No. 1. SECTION 2. That the following exceptions in said Underground Utility District No. 1, be, and they are hereby, authorized: (a) Any municipal facilities or equipment installed under the supervision and to the satisfaction of the City Engineer. (b) Poles or electroliers used exclusively for street lighting. (c) Overhead wires (exclusive of supporting structures) cross- ing any portion of the District within which overhead wires have been prohi- bited, or connecting to buildings on the perimeter of the District, when such wires originate in an area from which poles, overhead wires and associated structures are not prohibited. (d) Overhead wires attached to the exterior surface of a build- ing by means of a bracket or other fixture and extending from one location on the building to another location on the same building or to an adjacent building without crossing any public street. (e) Temporary poles, overhead wires and associated structures used or to be used in conjunction with construction projects. SECTION 3. That all poles, overhead wires and associated over- head structures shall be removed and underground installations made in said underground utility district within the following times: (a) Underground installation by utility companies and property owners and reconnections not later than October 1, 1972. (b) Removal of poles, overhead wires and other associated over- head structures not later than November 1, 1972. SECTION 4. That the City Clerk within ten days after the adoption of this resolution, shall mail a copy of this resolution and a copy of Chapter 14. 08 of the "E1 Segundo Municipal Code" to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Reso- lutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is_pa-ssed and PASSED, APPROVED AND ADQ'PTF,1.;0Ehis loth d ATT T: 1 o ayo r o the Q._c_ c � City C er ( AL) -2- ed f April, 1972.
