CC RESOLUTION 2433RESOLUTION NO. 2433 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMEND- ING SECTIONS 8. 00 AND 8.40 OF, AND ADDING SECTIONS 4.25, 4. 50, 8.25, 24.47 AND 26.15 TO, RESOLUTION NO. 2397 (THE SALARY RESOLUTION), RELATING TO POLICEMEN'S LATERAL ENTRY PROGRAM. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That Sections 8. 00 and 8. 40 of Resolution No. 2397 (The Salary Resolution) are amended to read as follows: "SECTION 8. 00. POLICE OFFICERS' EDUCATIONAL IN- CENTIVE PAY PROGRAM: OFFICERS ELIGIBLE. There is established an Educational Incentive Pay Program which shall apply to all sworn personnel of the Police Department, with the exception of the Chief of Police as follows: 1. All sworn personnel first employed on or after Septem- ber 1, 1970 who have qualified as hereinafter set forth; 2. All sworn personnel of the Police Department employed prior to September 1, 1970 who have elected to partici- pate in the program and have filed a written election to do so with the Personnel Officer. Such written election shall be irrevocable. "SECTION 8.40. STEP ADVANCEMENT -- EDUCATIONAL IN- CENTIVE PAY SALARY SCHEDULES: All sworn personnel in the E1 Segundo Police Department employed prior to September 1, 1970 who have subscribed to and are entitled to the Educational Incentive Pay shall advance to Step B -1 or 2; C -1 or 2; D -1 or 2; or E -1 or 2 (to whichever they are entitled by classification and length of ser- vice), in accordance with the Educational Incentive Pay Program Salary Schedules for Intermediate or Advanced Certificates set forth in Section 2. 10 of this resolution. Educational incentive pay J� "shall not be automatic. Each officer must continue to be pro- ficient and is subject to annual examination and evaluation. Should a police officer receive an unsatisfactory rating, the educational incentive pay shall be terminated until such time as the employee receives a satisfactory rating. SECTION 2. Sections 4.25, 4. 50, 8.25, 24.47 and 26. 15 are added to Resolution No. 2397 (The Salary Resolution) to read as follows: "SECTION 4.25 POLICEMAN -- LATERAL ENTRY PRO- GRAM. The City shall allow lateral entry of qualified peace officers from other agencies who desire employment in the E1 Segundo Police Department in the position of policeman in an advanced status, in accordance with the provisions herein - after set forth. "SECTION 4.50 POLICEMAN -- LATERAL ENTRY - -BASIC SALARY SCHEDULE. Subject to the approval of the City Mana- ger, policemen entering the service of the El Segundo Police Department under the Lateral Entry Program shall receive com- pensation under the Basic Salary Schedule at the salary step to which they are entitled by their total number of years of law en- forcement experience. "SECTION 8.25 QUALIFICATIONS -- LATERAL ENTRY. Policemen who enter the service of the E1 Segundo Police De- partment under the Lateral Entry Program and have qualified for and are entitled to the Educational Incentive Pay shall re- ceive compensation in accordance with the Educational Incen- tive Pay Program Salary Schedules for Intermediate or Ad- vanced Certificates set forth in Section 2. 10 of this resolution. "SECTION 24.47 SICK LEAVE TRANSFER--POLICE- MAN-- LATERAL ENTRY. Policemen who enter the service -2- "of the E1 Segundo Police Department under the Lateral Entry Program shall be allowed to transfer their accumulated sick leave from the preceding employing agency at a rate of one hundred percent up to a maximum of thirty days. "SECTION 26.15 VACATIONS AND OTHER BENEFITS -- POLICEMAN -- LATERAL ENTRY. Policemen who enter the service of the E1 Segundo Police Department under the Lateral Entry Program shall be new employees with no rights of senior- ity in the treatment of vacation or any other benefit accrued by right of seniority. " SECTION 2. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adop- tion thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
