A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, AMEND-
ING RESOLUTION NO. 2397 (THE SALARY RESO-
LUTION) TO PROVIDE FOR EDUCATIONAL INCEN-
TIVE PAY FOR UNIFORMED MEMBERS OF THE
FIRE DEPARTMENT WITH THE EXCEPTION OF
THE FIRE CHIEF.
WHEREAS, on June 22, 1971, a Memorandum of Understand-
ing was entered into between the City's authorized representatives and the
Firemen's Association; and
WHEREAS, said Memorandum of Understanding provided in
Paragraph 3 as follows:
"3. Educational Incentive Pay: Prior to September 15, 1971,
the City Manager shall appoint a committee composed of members
of the association and representatives of the city to explore and
study the possibility of an educational incentive program for the
Fire Department. "; and
WHEREAS, said Memorandum of Understanding provided in
Paragraph 8 as follows:
"8. On or before September 15, 1971, the City Manager
shall appoint a committee composed of representatives of the
city and representatives of the Firemen's Association to study
and recommend a policy regarding longevity that would involve
merit as well as service time to receive the longevity benefit. "; and
WHEREAS, said Memorandum of Understanding was approved
by the City Council at its meeting of June 28, 1971; and
WHEREAS, the City Manager did appoint a committee composed
of members of the Firemen's Association, the Fire Chief, Public Works
Director, and Assistant Personnel Officer, to explore and study the possi-
bility of an educational incentive pay program for the Fire Department, and
to study and recommend a policy regarding longevity that would involve merit
as well as service time to receive longevity benefits; and
WHEREAS, said committee reported to the City Manager its
findings and conclusions; and

WHEREAS, the City Manager has recommended to the City
Council the implementation of the programs set forth in this resolution; and
WHEREAS, the City Council desires to approve the recommenda-
tion of the City Manager;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE
AND ORDER AS FOLLOWS:
SECTION 1. Sections 9. 00, 10.00 and 11.00 of Resolution No. 2397
are amended to read as follows:
"SECTION 9. 00. STEP ADVANCEMENT - -BASIC SALARY
SCHEDULE- -FIREMEN'S EDUCATIONAL INCENTIVE PAY
SALARY SCHEDULES: The advancement of a new employee
from Step A shall be on the new employee's anniversary date
which is established as the day immediately following satisfac-
tory completion of his first six months' service; Steps B, C and
D (or in the case of uniformed members of the Fire Department
entitled to the Educational Incentive Pay, Steps B -6, C -6 and D -6;
B -7, C -7 and D -7; or B -8, C -8 and D -8 of the Firemen's Educa-
tional Incentive Pay Program Salary Schedules) contemplate one
year's service in each of such classifications and the advance-
ments therefrom shall be on the anniversary date of the employee;
Step E (or E -6, E -7 and E -8) contemplates continued service in
such classification until further advancement is indicated by rea-
son of longevity.
"SECTION 10.00. LONGEVITY ACHIEVEMENT: Steps X,
Y and Z of the Basic Salary Schedule (or in the case of sworn per-
sonnel of the Police Department entitled to the Educational Incen-
tive Pay, Steps X -1, Y -1 and Z -1, or Steps X -2, Y -2 and Z -2 of
the Police Officers' Educational Incentive Pay Program Salary
Schedules) (or in the case of uniformed members of the Fire De-
partment entitled to the Educational Incentive Pay, Steps X -6,
Y -6 and Z -6; Steps X -7, Y -7 and Z -7; or Steps X -8, Y -8 and Z -8

of the Firemen's Educational Incentive Pay Program Salary
Schedules) are longevity provisions and are to be used in
applying the following policy: Upon attaining seven years of
continuous service with the City, an employee shall be com-
pensated at Step X (or X -1 or X -2) (or X -6, X -7 or X -8); upon
attaining fourteen years of continuous service with the City, an
employee shall be compensated at Step Y (or Y -1 or Y -2) (or
Y -6, Y -7 or Y -8); and upon attaining twenty -one years of con-
tinuous service with the City, an employee shall be compensa-
ted at Step Z (or Z -1 or Z -2) (or Z -6, Z -7 or Z -8); provided,
however, that employees may be paid at a higher level then the
foregoing schedule when necessary to comply with the require-
ments of Section 21. 00 and provided that the uniformed members
of the Fire Department shall be subject to the further limitations
contained in Section 10. 10.
"SECTION 11. 00. STEP ADVANCEMENT -- ANNIVERSARY
DATE: An employee advanced in step by direction of the City
Council or advanced frdm Step E of the Basic Salary Schedule
(or in the case of sworn personnel of the Police Department en-
titled to the Educational Incentive Pay, Steps E -1 or E -2 of the
Police Officers' Educational Incentive Pay Program Salary Sched-
ules) (or in the case of uniformed members of the Fire Department
entitled to the Educational Incentive Pay, Steps E -6, E -7 or E -8
of the Firemen's Educational Incentive Pay Program Salary Sched-
ules) of any range to a step in another range receives a new anni-
versary date which is the date of the change. Other changes in
salary, unless specifically directed by the Council or as provided
in Section 12. 00 herein, shall not change the anniversary date. The
City Council reserves the right at any time, and in its sole discretion,
to change the range number assigned to any officer or employee and to
determine the particular step in any range number which is to be

"thereafter assigned to any such officer or employee. "
SECTION 2. Sections 2.15, B. 50, 8. 60, 8. 70, 8. 80 and 10. 10
are added to Resolution No. 2397 to read as follows:

"SECTION 2.15. FIREMEN'S EDUCATIONAL INCENTIVE
PAY PROGRAM SALARY SCHEDULES. (A) Uniformed members
of the Fire Department except the Fire Chief who have obtained a
Fire Science Certificate or successfully completed twenty units of
college level courses in Fire Science shall upon completion of the
initial probationary period be compensated for their services at
the grade and step to which they are entitled by classification and
length of service, in accordance with the following salary schedule:
FIRE SCIENCE CERTIFICATE OR 20 COLLEGE UNITS
"(B) Uniformed members of the Fire Department except the
Fire Chief who have obtained an Associate of Arts Degree with at
least twenty units in Fire Science shall upon completion of three
and one -half years' service be compensated for their services at
the grade and step to which they are entitled by classification and
length of service in accordance with the following salary schedule:

"SECTION 8. 50. FIREMEN'S EDUCATIONAL INCENTIVE
PAY PROGRAM. There is herewith established an educational
incentive pay program which shall apply to uniformed members
of the Fire Department except the Fire Chief. The program shall
become effective on January 1, 1972.
"SECTION 8. 60. ADMINISTRATION. The Firemen's edu-
cational incentive program shall be administered in accordance
with the "Fire Department Educational Incentive Pay Program"
dated November 12, 1971, a copy of which is on file in the office
of the City Clerk.
"SECTION 8.70. 'ELIGIBILITY. Each employee who quali-
fies for educational incentive pay shall remain eligible until his
employment with the City of E1 Segundo is terminated or he re-
ceives an unsatisfactory performance evaluation. Should an
eligible employee receive an unsatisfactory rating, the education-
al incentive pay shall be terminated until such time as the employee
receives a satisfactory rating.
"SECTION 8.80. MAXIMUM LONGEVITY AND EDUCA-
TIONAL INCENTIVE PAY. The combined total of the educational
incentive pay and longevity pay for uniformed members of the Fire
Department may not exceed seventeen percent (17 ranges) of Step E
of the salary range set forth in Section 3. 00 of Resolution No. 2397.

"SECTION 10. 10. LONGEVITY ACHIEVEMENT ON MERIT- -
FIRE DEPARTMENT PERSONNEL. Advancement of uniformed
members of the Fire Department to Steps X, Y and Z of the Basic
Salary Schedule shall be based on the satisfactory performance of
duties as indicated by performance evaluation. An employee in the
fire service shall be presumed to merit an increase in pay as pro-
vided in Section 10.00 unless his current performance evaluation
on file rates him below standard or unsatisfactory and the Fire
Chief notifies the Personnel Officer and employee in writing at
least ten days in advance of the scheduled increase that the increase
in pay should be withheld, stating reasons. If the employee's per-
formance subsequently improves to a satisfactory level, the lon-
gevity pay will be granted upon the issuance of a satisfactory per-
formance report."
SECTION 3. This resolution shall become operative at midnight
on December 31, 1971 and until such time shall remain inoperative.
SECTION 4. The City Clerk shall certify to the passage and
adoption of this resolution; shall enter the same in the book of original reso-
lutions of said City; and shall make a minute of the passage and adoption
thereof in the records of the proceedings of the City Council of said City in
the minutes of the meeting at which the same is passed and adopted.
