RESOLUTION NO. 2397
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, FIXING THE
COMPENSATION OF THE VARIOUS OFFICERS AND
HEADS OF DEPARTMENTS OF SAID CITY, AND OF
THE VARIOUS EMPLOYEES THEREOF AND REPEAL-
ING RESOLUTION NO. 2365 OF SAID COUNCIL AND
ALL RESOLUTIONS AMENDING SAID RESOLUTION
NO. 2365.
WHEREAS, the salaries or compensation of the members of
the City Council of the City of E1 Segundo, California, are fixed by law
at the sum of One Hundred Fifty Dollars ($150. 00) per month, each; and
WHEREAS, the salary of the City Clerk, as such, is fixed at
the sum of Two Hundred Fifty Dollars ($2 50. 00) per month and the salary
of the City Treasurer, as such, is fixed at the sum of Two Hundred Fifty
Dollars ($250.00) per month, both of which salaries have been established
by ordinance and may not be changed during their respective incumbencies
except by ordinance adopted by the City Council and as provided by law; and
WHEREAS, the City Council of the City of E1 Segundo, California,
now desires to fix and determine the salaries or compensations of the vari-
ous other officers, heads of departments, and of the various employees of
said City, all as hereinafter set forth;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE
AND ORDER AS FOLLOWS:
SECTION 1. 00 RATES - FIXED SERIES: That subject to the
other provisions of this resolution, each of the incumbents of the following
offices or positions in the service of the City of El Segundo shall be entitled
to receive for his or her services, in his or her office or position, the rate
or rates of compensation hereinafter set forth:
(A) CITY ATTORNEY------------------------- - - -$1, 198. 00 per month
and, in addition thereto, he shall receive such
reasonable additional fees or compensation as
the City Council may allow for suits, appear-
ances or proceedings before any Court, Board,
Officer or Commission in, or before which he
has been directed to act or appear, and also
when allowed by the Council, extra compensa-
tion for bond issues of all kinds and for any ser-
vice which the Council may deem extraordinary.

SECTION 2. 00 BASIC EIGHT -STEP SALARY SCHEDULE: That
except as hereinafter specifically provided and subject to the other provisions
of this resolution, each employee in the service of said City (other than those
hereinabove provided for in Section 1.00 and Police Department personnel parti-
cipating in the Educational Incentive Pay Program) shall be entitled to receive
for his or her services in his or her position the applicable rate of compensa-
tion shown in the following basic eight -step salary schedule prescribed for the
class

SECTION 4. 00. FIRE AND POLICE DEPARTMENTS - UNI-
FORM ALLOWANCES. Following the effective date of this resolution, fire
fighting and police department employees who are required to purchase and
continuously maintain prescribed items of uniform clothing and personal
equipment shall be compensated for a portion of the initial and maintenance
costs thereof according to the following:
1, a. Police officers assigned to motorcycle duty - $16.00
per month of active duty.
b. All other police officers - $10. 00 per month of active
duty.
c. Fire fighting personnel required to regularly wear dress
uniform while on duty - $10. 00 per month of active duty.

d. Dispatcher clerks and police cadets - $6. 00 per month of
active duty.
e. All other fire fighting personnel - $7. 50 per month of
active duty.
2. Newly appointed police officers and fire department person-
nel shall be provided with uniform allowances at the time of
appointment and thereafter as follows:
a. At the time of appointment - 150% of annual allowance.
b. At first anniversary of appointment - 5016 of annual
allowance.
c. After first anniversary - 10016 of monthly allowance.
3. Newly appointed dispatcher clerks at the time of appoint-
ment - $110.00.
SECTION 5.00. POLICE OFFICERS -- MARKSMANSHIP:
The Chief of Police is authorized to conduct in his department, drills, prac-
tices or tests in the use and firing of sidearms and small arms by the mem-
bers of his department in order to increase the efficiency of the members of
his department in the use of such firearms. Such practices, tests or drills
shall be held at such times and at such places as said Chief shall designate
and shall be participated in by such members of the department as the Chief
may from time to time authorize so to do. Such tests, practices and drills
shall be held under such conditions and at such times and subject to such rules
as to enable said Chief to properly make the certifications hereinafter referred
to, to the Personnel Officer. In addition to any compensation otherwise provided for
any officer or member of said Police Department authorized to participate in
any such drill, test or practice, there shall be paid a compensation in accor-
dance with the following schedule to each such member of the department
for his proficiency in the use and firing of such sidearms or small arms,
and in the accuracy of such fire as indicated in the following schedule, to
wit:

In addition to the above, each officer selected to serve on the pistol team, not

to exceed eight members of the department with the highest proficiency in fire-
arms, under rules approved by the Chief of Police, shall receive an additional
$5. 00 per month during the time he serves on the team. Said additional com-
pensation shall be payable only upon certification by the Chief of Police that
the particular officer or member has qualified during the quarter preceding the
certification in one of the classes (indicating same) of the foregoing schedule,
and that such person is entitled to the additional compensation for such class as
set forth in such schedule.
SECTION 6.00 POLICE OFFICERS -- MOTORCYCLE HAZARD
PAY. All Police Department patrolmen assigned to motorcycle duty will be
compensated by an additional payment equal to seven percent of the "E" Step
of the patrolman classification while serving in such capacity.
SECTION 7. 00. POLICE OFFICERS -- RESERVE: Notwithstand-
ing any provisions herein contained to the contrary, and for the sole and ex-
clusive purpose of establishing a duty status of the reserve police officers
pursuant to which they are peace officers within the full meaning of Section
830. 6 of the Penal Code of the State of California, compensation of said offi-
cers is fixed and determined in the amount of $1. 00 per year; this employ-
ment status shall augment and be in addition to their Civil Defense status
and shall include Workmen's Compensation benefits.
SECTION 8.00. POLICE OFFICERS' EDUCATIONAL INCEN-
TIVE PAY PROGRAM; OFFICERS ELIGIBLE. There is established an Educa-
tional Incentive Pay Program which shall apply to all sworn personnel of the
Police Department, with the exception of the Chief of Police as follows:
1. All sworn personnel first employed on or after September 1,
1970 who have qualified as hereinafter set forth and have satis-
factorily completed the first year of service following employ-
ment in the El Segundo Police Department;
2. All sworn personnel of the Police Department employed prior
to September 1, 1970 who have elected to participate in the
program and have filed a written election to do so with the Per-
sonnel Officer. Such written election shall be irrevocable.

SECTION 8. 10. ADMINISTRATION. The program shall be
administered in accordance with the revised "Educational Incentive Pay
Program Rules, Regulations and Procedures" dated September 25, 1970, a
copy of which is on file in the office of the City Clerk.
SECTION 8.20. QUALIFICATIONS. Except for the year com-
mencing September 1, 1970 and for the year of initial qualification, an em-
ployee in the Educational Incentive Pay Program shall not be entitled to educa-
tional incentive pay for any year unless during the preceding year he has:
1. Earned three semester units of college credit with a passing
grade; or
2. Satisfactorily completed informal educational courses equiva-
lent to three semester units of college credit; or
3. Engaged in community service approved by the Chief of Police
outside of duty hours for the period of time equivalent to the
time required to satisfactorily complete three semester units
of college work.
Units of credit and /or civic activity in excess of the yearly re-
quirements shall be encouraged, however, they will not be accumulative and
will not be applied toward eligibility for ensuing years.
SECTION 8. 30. LONGEVITY EXCEPTIONS. The provisions
of Steps X, Y and Z of the Basic Salary Schedule shall not apply to any sworn
member of the Police Department except:
(1) The Chief of Police; and
(2) Other sworn personnel of the Police Department employed
before September 1, 1970 who have not elected to participate
in the Educational Incentive Pay Program.
Police Officers hired prior to September 1, 1970, who sub-
scribe to the Educational Incentive Pay Program and later fail to meet the
necessary requirements for eligibility in the program, will receive longevity
pay in accordance with the longevity provisions set forth in Section 2. 10 of
this resolution, if otherwise qualified.

SECTION 8.40. STEP ADVANCEMENT -- EDUCATIONAL
INCENTIVE PAY SALARY SCHEDULES: All sworn personnel, upon comple-
tion of the first year of service following employment in the E1 Segundo Police
Department, and all sworn police officers of such department employed prior
to September 1, 1970 who have subscribed to and are entitled to the Educa-
tional Incentive Pay shall advance to Step B -1 or 2; C -1 or 2; D -1 or 2; or
E-1 or 2 (to whichever they are entitled by classification and length of ser-
vice), in accordance with the Educational Incentive Pay Program Salary
Schedules for Intermediate or Advanced Certificates set forth in Section 2. 10
of this resolution. Educational incentive pay shall not be automatic. Each
officer must continue to be proficient and is subject to annual examination
and evaluation. Should a police officer receive an unsatisfactory rating, the
educational incentive pay shall be terminated until such time as the employee
receives a satisfactory rating.
SECTION 9.00. STEP ADVANCEMENT - -BASIC SALARY
SCHEDULE: The advancement of a new employee from Step A shall be on
the new employee's anniversary date which is established as the day immedi-
ately following satisfactory completion of his first six months' service; Steps B,
C and D contemplate one year's service in each of such classifications and the
advancements therefrom shall be on the anniversary date of the employee;
Step E contemplates continued service in such classification until further ad-
vancement is indicated by reason of longevity.
SECTION 10.00. LONGEVITY ACHIEVEMENT: Steps X, Y and
Z of the Basic Salary Schedule (or in the case of sworn personnel of the Police
Department entitled to the Educational Incentive Pay,Steps X -1, Y -1 and Z -1,
and Steps X -2, Y -2 and Z -2 of the Educational Incentive Pay Program Salary
Schedules) are longevity provisions and are to be used in applying the follow-
ing policy: Upon attaining seven years of continuous service with the City, an
employee shall be compensated at Step X (or X -1 or X -2); upon attaining fourteen

years of continuous service with the City, an employee shall be compensated
at Step Y (or Y -1 or Y -2); and upon attaining twenty-one years of continuous
service with the City, an employee shall be compensated at Step Z (or Z -1 or
Z -2); provided, however, that employees may be paid at a higher level than
the foregoing schedule when necessary to comply with the requirements of
Section 21. 00.
SECTION 11.00. STEP ADVANCEMENT -- ANNIVERSARY
DATE: An employee advanced in step by direction of the City Council or
advanced from Step E of the Basic Salary Schedule (or in the case of sworn
personnel of the Police Department entitled to the Educational Incentive Pay,
Steps E -1 and E -2 of the Educational Incentive Pay Program Salary Schedules)
of any range to a step in another range receives a new anniversary date which
is the date of the change. Other changes in salary, unless specifically directed
by the Council or as provided in Section 12. 00 herein, shall not change the
anniversary date. The City Council reserves the right at any time, and in its
sole discretion, to change the range number assigned to any officer or em-
ployee and to determine the particular step in any range number which is to
be thereafter assigned to any such officer or employee.
SECTION 12.00. STEP INCREASES ON MERIT - -BASIC
SALARY SCHEDULE. An employee will be eligible for advancement to a
higher step on the basis of service time as described in Section 9.00
and satisfactory performance of duties. An employee will be presumed to
merit an increase unless his Department Head notifies the Personnel Officer
in writing at least ten days in advance of the scheduled increase that the in-
crease should be withheld, stating reasons. The reasons shall be provided
to the employee in writing. If the employee's performance subsequently im-
proves to a satisfactory level, the step increase will be granted and the date
of increase will become the employee's anniversary date.
SECTION 13. 00 COMPENSATION PAYMENT: The monthlv
compensation basis, hereinabove provided for, shall be payable biweekly.
(A) Compensation of employees for services rendered during each pay-
roll period shall be for the two week period ending the week preceding the date
of payment.

(B) Compensation of Councilmen and Commission members shall be
paid not less frequently than monthly.
SECTION 14. 00. WORKING SCHEDULES AND RULES AND
REGULATIONS RELATING TO HOURS AND PERIODS OF SERVICE: That
salaries, fees, or pay, as same are hereinabove stated, and as same may
hereafter be amended, contemplate service to be rendered by the various em-
ployees of said City substantially in accordance with the following rules and
regulations relating to hours and periods of service which are hereby estab-
lished, to wit:
1. Eight hours shall be deemed to constitute a day's work, except in
the Police and Fire Departments in which the members shall be
subject to call at all times.
2. A week shall be deemed to mean any period of seven consecutive days.
3. Unless the context otherwise indicates, Sundays and legal holidays
shall be construed as such.
4. The year shall be taken as having 365 days and the month as having
30 days.
5. The length of service shall be determined as follows:
a. For employees not on the payroll on January 1, 1968:
(1) Permanent Full -Time Employees. Length of service shall
e counted from t ei crate Maast continuous permanent em-
ployment.
(2) Permanent Part -Time Employees. Length of service shall
be counted from date of last continuous permanent employ-
ment, regardless of hours worked, provided the positions
occupied are specified as permanent part -time positions in
the budget or by personnel authorization.
(3) Other Part -Time or Temporary Employees Service shall
not be counted toward longevity or step increases.
b. For employees on the payroll as of January 1, 1968, length
of service shall be computed on the length of time an employee
has been continuously in the service of the City in any capacity.
An absence for a period of ninety or more consecutive days
shall constitute a break in service for the purpose of determin-
ing continuous service.
6. That all employees of said City (excepting those to whom these rules
do not apply, as hereinabove or hereinafter set forth), shall render
their respective services on a working schedule of eight hours per
day or forty hours per week, and the City Manager shall designate
the particular days and hours such respective employees are to render
service to the said City.

7. The City Manager may require any employee or employees to render
service for more than eight hours per day or forty hours per week in
any and all cases where the City Manager feels that such additional
service is essential for the best interests of the City at the time.
SECTION 15. 00. OVERTIME PAY: Except as otherwise herein
specifically provided, any employee subject to the rule of eight hours per day
and forty hours per week, required to put in more time on his classification
for routine or administrative reasons, shall be compensated at the rate of one
and one -half times his regular rate of pay.
SECTION 15. 10. OVERTIME PAY - EXCEPTIONS: Only
regular salary rates shall be paid in emergencies pertaining to war, civil
defense, strike patrol duty, after the first forty -eight hours thereof, flood,
earthquake, fire or other similar conditions of urgency.
SECTION 15.15. OVERTIME PAY -- RECALL MINIMUM HOURS:
Employees who are recalled to work at a time other than their normal scheduled
work day will be compensated for a minimum of two hours work.
SECTION 15.20. OVERTIME PAY -- COMPENSATORY TIME:
Compensatory time may be substituted for overtime payment if approved by the
City Manager, provided that the accumulation may not exceed twenty -four hours
or three working days at any one time and no more than ten days total may be
accumulated or used in any one year. Compensatory time may be used in con-
junction with normal vacation with prior approval of the City Manager. No more
than three consecutive days of compensatory time may be used.
SECTION 15.30. OVERTIME PAY - -FIRE DEPARTMENT:
Except as otherwise herein provided, the members of the Fire Department of
said City shall work on a fifty -six hour per week schedule in shifts to be pro-
mulgated and established from time to time by the City Manager, and all of the
members of said Department shall be subject to call for service at any and all
times. It is provided, however, that where members of the Department (with
the exception of the Chief) are required to work overtime, such members
shall be entitled to additional compensation at straight time rates, based on
forty hours per week for special details and assignments other than fire and
rescue calls, and when required to work overtime on a regular fire fighting
company assignment, shall be paid straight time based on the regular fifty-

six hour week. Members of the Department (with the exception of the Chief),
recalled from off -duty to respond to fires and rescue calls, shall receive a
minimum compensation of $ 5. 00 per call.
SECTION 15.40. OVERTIME PAY -- POLICE DEPART-
MENT. Except as otherwise hereinafter provided, the members of the Police
Department of said City shall work regularly scheduled shifts to be promul-
gated and established from time to time by the City Manager, and all of the
members of said Department shall be subject to call for service at any and
all times. It is provided, however, that where a member of the Police Depart-
ment is required to render more than eight hours service in any one day or
more than forty hours per week, such member shall be entitled to receive,
and there shall be paid to him, additional compensation for such overtime
at one and one -half times his or her regular rate of pay, unless such mem-
ber is the Chief of Police of said City.
Straight time only will be paid all police personnel entitled to
overtime for the following duty assignments:
1. Approved departmental in- service training and specialized train-
ing schools, except that:
a. Officers promoted in rank and who are required to attend
in- service classes to gain the knowledge necessary to per-
form their new duties and responsibilities of said position,
shall not be compensated in overtime pay for the hours spent
in training over and above a normal eight hour day; and
b. Overtime pay shall not be paid to police personnel who spend
more than the eight hour day in a basic recruit school learn-
ing the duties and responsibilities of their new career in law
enforcement.
2. Staff meetings.
3. Public relations appearances (speeches, etc. ).
4. Photograph work.
5. Such other similar duty that may develop in the future.
Police officers required to appear in court during scheduled
off -duty hours will be paid for a minimum of two hours duty.
SECTION 16.00. TEMPORARY EMPLOYEES UNCLASSIFIED.
Temporary employees for whom no classification or range number is provided
or whose compensation is not otherwise fixed by this resolution shall receive
such compensation as the City Council shall designate in the resolution or order

of appointment for such respective temporary employees.
SECTION 16.10. TEMPORARY EMPLOYEES -- FRINGE
BENEFITS: Temporary employees and permanent part -time employees who
by reason of their limited employment schedule do not qualify for coverage
under the Public Employees' Retirement Law, shall not receive paid sick
leaves, paid vacations and paid holidays; permanent part -time employees
who qualify for coverage under the Public Employees' Retirement Law shall
receive the fringe benefits accorded all regular full time employees including
vacation and sick leave on a pro rata basis.
SECTION 17. 00. EMERGENCY APPOINTMENTS: That not-
withstanding any other provision contained in this resolution, it is hereby pro-
vided that in case of any emergency or unusual circumstances or conditions,
which may exist or arise within the city, or in any office or department there-
of, the City Manager shall have the right and he is hereby authorized, either
directly or through the head of the office or department affected or involved,
to employ such number of additional employees as in the opinion of such City
Manager may be necessary in order to meet or properly dispose of any and
all conditions and problems which may arise out of or be due to any such
emergency; together with full power in any and all such cases to fix the res-
pective reasonable compensations to be paid such additional employees, res-
pectively, for such emergency service. Such emergency service shall not
continue, however, for a longer period than twenty -one successive days un-
less by further authority of the City Council expressed by resolution.
SECTION 17. 10. PREPARATION AND CONTENT OF CLASS
SPECIFICATIONS: Class specifications shall be prepared and maintained under
the direction of the City Manager for all positions. The specifications shall
define the duties of the positions in each class and the desirable qualifications
for successful performance of such duties.
SECTION 18.00. RESIDENCE REQUIREMENTS. Within six
months following completion of their probationary period the City Manager,
Chiefs of Police and Fire Departments, Directors of Finance Department,
Building Safety Department, Planning Department, Public Works Department,

and Recreation and Parks Department must live within the El Segundo city
limits, except that the City Council may consent to an extended period of
residence outside the city limits of the city.
SECTION 19.00 HOLIDAYS AND HOLIDAY PAY: Except as
otherwise herein specifically provided, any employee who is required to work
on any of the following days that occur on his regular day of employment, to wit:
January 1st; Thanksgiving Day and Friday thereafter;
The third Monday in February; December 24th;
The last Monday in May; December 25th;
July 4; December 31st; and
The first Monday in September; Every day on which an election is held
The fourth Monday in October; throughout the State,
shall be compensated therefor at the rate of one and one -half times his regular
rate of pay in addition to straight time holiday pay; provided, however, (a) that
in the event any of the hereinbefore mentioned holidays falls on the last day an
employee is off on his regular days off period, the following day shall be
observed as a holiday for the purpose of this section, provided further, how-
ever, (b) that in the event any of the hereinabove mentioned holidays falls on
the first day of an employee's regular days off period, the previous day shall
be considered as a holiday for the purpose of this section.
Police and Fire Department personnel who are regularly required
to work on holidays, pursuant to this section and notwithstanding any provision
herein to the contrary, shall be paid for ten holidays once a year on or about
the 10th day of December.
SECTION 20.00. TEMPORARY SERVICE IN HIGHER CLASSI-
FICATION: In any case, approved by the City Manager, where an employee is
qualified for and is required for an appreciable period of time to temporarily
serve in and have the responsibility for work in a higher class of position,
such employee while so assigned, shall receive the entrance salary rate of
that class or whatever step thereof that is not less than five percent above
his present rate, whichever is higher. For the purpose of this section
"appreciable period of time" is defined as thirty consecutive working days
or longer for department and division heads and ten consecutive working days
or longer for all other classifications.

SECTION 21.00. PROMOTIONS: In all cases where an
employee in any given classification is promoted to a classification for which
a higher rate of compensation is provided, then such employee so promoted
shall enter such higher classification at the lowest rate of compensation pro-
vided for such higher classification which exceeds by not less than five per-
cent the rate of compensation received by said employee in such given classi-
fication at the time of such promotion, unless otherwise ordered by the City
Council. All supervisors shall be paid at a higher rate than any of their
subordinates, exclusive of special and longevity pay. In the event that a
supervisor is paid a rate of pay equal to or lower than one of his regularly
assigned subordinates, the supervisor's rate shall be advanced to a step in
his salary range which is one step higher than any subordinate's pay exclu-
sive of longevity pay and special pay.
SECTION 22. 00. TERMINATION: Upon termination of
employment during a pay period, pay shall be prorated and paid for each day
worked in said pay period and the terminal salary warrant shall include
accrued vacation pay to the time of termination.
SECTION 23. 00 HOURS OF SERVICE -- EXCEPTIONS:
So far as the foregoing rules and regulations relative to hours of service
in any day or hours of service in any week, the same shall not apply to:
1. Elective officers of said City.
2. City Manager.
3. City Attorney.
4. Chiefs of Police and Fire Departments.
5. Directors of Building Safety Department, Finance Department,
Planning Department, Public Works Department, and Recreation
and Parks Department.
6. Administrative Secretary /Assistant Personnel Officer.
7. Assistant Director of Finance.
8. Assistant Director of Public Works.
9. Superintendents of Parks, Recreation, Water and Sanitation,
and Street Maintenance Divisions.
10. Garage Supervisor.

SECTION 24. 00. SICK LEAVE; LEAVE WITH PAY DUE
TO ILLNESS; ACCUMULATION OF SAME: Sick leave with pay may be granted
for absence from duty because of personal illness, injury, or legal quarantine
not compensable under the provisions of the Workmen's Compensation Laws of
the State of California. Regular employees shall accumulate sick leave at the
rate of one day accumulation for each month's service, not to exceed a maxi-
mum of one hundred thirty -two days. Hours worked in addition to a regular
work week shall not entitle an employee to additional sick leave accumulation.
Sick leave taken by an employee shall be deducted from his accumulated credit.
SECTION 24. 10. SICK LEAVE CERTIFICATION. Any em-
ployee taking sick leave shall, upon his return to work, sign a statement certi-
fying the reasons for such sick leave. Employees absent five or more consecu-
tive days must submit a statement from a doctor that the employee was under
his care and is able to return to work. The City Manager may, before allow-
ing such leave or before permitting an employee to return to work, require
submission of a doctor's certificate for absences less than five days in dura-
tion. Any employee who makes a false claim to sick or emergency leave or
who refuses to cooperate in an investigation by the City of his claim, shall be
subject to disciplinary action.
SECTION 24.20. SICK LEAVE -- PAYMENT OF ONE -HALF
OF 132 DAYS ACCRUED: On the first day of December of each year, em-
ployees who maintain a balance of one hundred thirty -two sick leave accrual
shall be paid for one -half the sick leave accumulated and not used during the
preceding twelve month period. Payment shall be made on or before Decem-
ber 10.
SECTION 24.30. SICK LEAVE -- PAYMENT OF ACCRUED -ON
RETIREMENT: In the event an employee, while in the City's employ, retires
under the Public Employees' Retirement System with unused sick leave to his
credit, he shall be compensated in an amount equal to one -half the value of
such sick leave based upon his current salary at the time of retirement with-
out the inclusion of overtime pay or additional compensation.

SECTION 24.40. SICK LEAVE -- PAYMENT OF ACCRUED --
ON DEATH: In the event an employee, while in the City's employ, dies with
unused sick leave to his credit, his estate shall be compensated in an amount
equal to one -half the value of such sick leave based upon his current salary at
the time of his death without the inclusion of overtime pay or additional com-
pensation.
SECTION 24.45. SICK LEAVE -- PAYMENT OF ONE -HALF
ON TERMINATION: The provisions of this section shall apply to all em-
ployees of the City except sworn personnel of the Police Department, Police
Dispatcher Clerks and uniformed employees of the Fire Department. This
section shall not apply to sworn personnel of the Police Department, Police
Dispatcher Clerks and uniformed employees of the Fire Department. In the
event an employee to whom this section applies has completed eight or more
years of service with the City and then resigns, is discharged, or leaves the
service of the City for any reason other than those enumerated in Sections
24. 30 and 24. 40 of this resolution and has unused sick leave to his credit at
the time of termination of his service, such employee shall be compensated
in an amount equal to one -half the value of his sick leave based upon his cur-
rent salary at the time of such termination without the inclusion of overtime
pay or additional compensation.
SECTION 24.50. EMERGENCY LEAVE - FAMILY ILLNESS:
Accumulated sick leave may be used as emergency leave for short periods in
case of serious illness in the immediate family of the employee or employee's
spouse. A maximum of three days emergency leave may be granted in case of
death in the immediate family of the employee or employee's spouse. A
doctor's certificate stating the nature of the illness of the immediate family of
the employee or employee's spouse, or proof of death, may be required before
absence for these reasons shall be charged to emergency leave. Emergency
leave of a maximum of three days may also be granted in cases of extreme and
unusual hardships of an emergency nature.

SECTION 25. 00. WORKMEN'S COMPENSATION PROVISION:
Permanent employees who are members of the Public Employees' Retirement
System and who receive injuries that are compensable under the California Work-
men's Compensation Laws (other than those to whom the provisions of Section 4850
of the Labor Code apply) shall be entitled to receive:
1. The employee's regular salary for any so- called waiting period
provided for in the Workmen's Compensation Laws;
2. Thereafter, the period of up to one year or until retired on disability
pension, the difference between the employee's regular monthly
salary and the amount of any temporary disability payments. Such
payments shall cease when the employee receives a permanent dis-
ability award or is physically able to return to work.
SECTION 25. 10 WORKMEN'S COMPENSATION PAY-
MENTS RECEIVED: The City Manager in preparing demands for compensation
under the provisions of the Workmen's Compensation laws of the State of
California may require the employee concerned to submit to said City Manager,
evidence satisfactory to such City Manager showing the amount of Workmen's
Compensation payments received by such employee (exclusive of medical,
surgical, hospitalization, appliances, or similar items of costs).
In many instances it may be impossible prior to the time pay-
rolls are regularly approved to determine various amounts which may here-
after become payable under the provisions of the Workmen's Compensation
laws of the State of California to various employees due to a variety of rea-
sons and causes, such for example, as delays which may occur in the fixing
of compensation amounts in Industrial Accident cases; the failure of the em-
ployee to monthly or promptly receive his Workmen's Compensation allow-
ances, etc. In all such cases, the City shall be under no obligation to make
to the employee the payments provided for in said Workmen's Compensation
laws until such time as such matters can be properly determined. The City
Manager may present to the City Council any and all problems which may
arise in the Administration of the provisions hereof, and the City Council
reserves the right to consider such problems and to determine the same and
make such adjustments and orders as may be necessary and proper in the
premises.

SECTION 25.20. PHYSICAL EXAMINATION: The City
Council reserves the right, to be exercised in its discretion, to at any time
and from time to time, at the expense of said City, require any employee to
appear before any duly licensed physician or surgeon selected by the City
Manager and submit to a medical and physical examination with respect to
his illness, injury or disability. The failure or refusal of any such employee
to submit himself to any such examination, may, in the discretion of the said
Council, forfeit any further rights to receive sick leave disability benefits or
compensation under the provisions of this resolution.
SECTION 25.30. PHYSICAL EXAMINATION -- WRITTEN
REPORT. The written report of any such physician or surgeon to said Council
may be examined by said Council, the City Manager, and City Attorney of
said City, but shall otherwise be confidential; provided, however, that the
same may be introduced in evidence in any action or proceeding relative to
the subject of illness, injury or disability of the patient or person referred
to therein, and such physician or surgeon may give testimony respecting the
subject of such examination and the physical condition of the employee therein
referred to, and each employee of said City accepting employment, by accept-
ing such employment and rendering service thereunder, does thereby auto-
matically and accordingly so agree.
SECTION 26. 00. VACATIONS: Excepting members of the
Police and Fire Departments who shall receive annual vacations as provided
by law, each officer and employee regularly employed and with less than
eight years of service with said City, subject to the limitations hereinafter
set forth, shall be entitled to and shall receive an annual vacation of twelve
working days with full salary. Vacation leaves may not be taken until an
employee has completed one year's continuous service. Vacation time shall
accrue on a monthly basis. Employees who have completed seven years but
less than fifteen years of service, shall receive an annual vacation or leave
of absence with pay of fifteen working days. Employees who have completed
fourteen or more years of service shall receive an annual vacation or leave
of absence with pay of twenty working days.

SECTION 26. 10. VACATIONS -- POLICE DEPARTMENT:
The sworn personnel of the Police Department shall receive annual vacations
in the same manner provided in Section 26. 00 for other employees, provided,
however, that such annual vacation or leave of absence with pay shall be not
less than as required by Section 38634 of the Government Code.
SECTION 26.20. VACATIONS - -FIRE DEPARTMENT- -FORTY
HOUR WEEK: Members of the fire service working forty hours a week shall
receive vacations the same as provided in Section 26. 00 , provided, however,
that such annual vacation or leave of absence shall be not less than as required
by Section 53250 of the Government Code.
SECTION 26.3Q VACATIONS - -FIRE DEPARTMENT SHIFT
WORK: Members of the fire service that work shifts with less than eight
years service shall receive vacation time of six shifts; employees who have
completed seven years but less than fifteen years of service, eight shifts;
fourteen or more years of service ten shifts; provided, however, that it
shall be not less than as required by Section 53250 of the Government Code.
SECTION 26.40. VACATION TIME ACCUMULATED:
Vacation time shall be accumulated from date of last continuous permanent
employment. All vacations shall be taken at such times as are agreeable
to the head of the department and approved by the City Manager. Earned
vacations shall not be accumulated for a longer period than for two years'
service.
SECTION 27.00. JURY SERVICE. Employees absent for
jury service with the approval of their Department Heads, shall be entitled to,
and receive, full salary upon showing absence occurring by reason thereof,
and paying to the City the amount of jury fees received by them for such
absence.
SECTION 28.00. ACCEPTANCE OF GRATUITIES: Officers
and employees of the City are enjoined against accepting any form of gratuity
from any person with whom they are transacting or have transacted city busi-
ness on behalf of the City of E1 Segundo. By this, all personnel are admon-

ished not to accept anything of value, where such transfer of value can be con-
strued as a favor or as an inducement in any manner affecting their decisions
in the discharging of city business.
SECTION 29.00. ANNUAL SALARY SCALE REPORT. The
City Council in its desire to maintain a salary experience comparable to that
paid by other cities has determined that as a matter of policy it will give care-
ful consideration to the wages paid in the following cities:
Culver City
Los Angeles
Gardena
Manhattan Beach
Hawthorne
Redondo Beach
Hermosa Beach
Santa Monica
Inglewood
Torrance and
Los Angeles County.
A comprehensive report setting forth the scale of wages paid
by the above -named cities together with a detailed report of all fringe benefits
shall be prepared and submitted to the Council members prior to August 1 of
each year. The City Council will review the wage scale of this City at the
first meeting next following its receipt by its members of such report.
SECTION 30. 00. MILEAGE REIMBURSEMENT: Officers
and employees of the City shall be entitled to reimbursement for city autho-
rized use of their privately owned vehicles in the conduct of city business at
the rate of ten cents per mile.
SECTION 31. 00. EMPLOYMENT OF RELATIVES: It is
declared and established as a matter of policy that employment by the City
shall be limited so that employees in any one department shall not be within
the third degree of relationship to each other.
SECTION 32. 00. ADDITIONAL EMPLOYMENT: A Depart-
ment Head who is employed full -time by the City shall not accept other work
or actively participate in the management of a private profit - producing activity
outside of his employment with the City of E1 Segundo, without first obtaining
approval of the City Council, and upon showing that such activity will not con-
flict with his discharge of duties of employment with the City.
SECTION 33.00. PHYSICAL EXAMINATION REQUIRE-
MENTS: Policemen, Firemen, Sanitation Department employees, and Depart-

ment Heads shall be annually examined by a local medical doctor selected by
the City, except Policemen and Firemen under thirty -five years of age, who
shall be examined every two years. Additional examinations of these employees
as well as of all other employees of the City may be ordered by the City Manager
and the medical reports thereof shall become part of the employees' personnel
records.
SECTION 34. 00. REPEALS: Resolution No. 2365 passed
and adopted on the 25th day of January, 1971, and Resolution No. 2391
amending said Resolution No. 2365 and all resolutions and orders of the
City Council heretofore passed and adopted with reference to the same,
or any of the matters and subjects hereinabove set forth or referred to,
are hereby repealed insofar as the same conflict with the provisions
hereof.
SECTION 35.00. In all cases where any employee renders
service in more than one department, and the City Council has not designated
the amount or percentage of the compensation of such employee to be charged
against any particular department or departments, the Director of Finance
may, for accounting purposes, determine and charge accordingly the amount
of percentage of the compensation or salary of any such employee which is to
be charged to each of the respective departments in which such service was
rendered. So far as reasonably practicable, such charges when made against
the various departments shall be substantially in proportion to the service
rendered such respective departments.
SECTION 36.00. The City Clerk shall certify to the passage
and adoption of this resolution; shall enter the same in the book of original
resolutions of said City; and shall make a minute of the passage and adoption
thereof in the records of the proceedings of the City Council of said City in the
minutes of the meeting at which the same is passed,.and adopted.
