CC RESOLUTION 2319RESOLUTION NO. 2319 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO MAKING FINDING OF FEASIBILITY OF AC- QUISITION OF NECESSARY RIGHTS OF WAY AND CON- STRUCTION OF CERTAIN GRADING, PAVING, CURBS, GUTTERS, GAS DISTRIBUTION SYSTEM, WATER DISTRI- BUTION SYSTEM, UNDERGROUND POWER AND TELEPHONE CONDUIT, SIDEWALKS, RETAINING WALLS AND SANITARY SEWERS TOGETHER WITH APPURTENANCES AND APPURTENANT WORK IN ASSESSMENT DISTRICT NO. AD -70 (WEST ELM AVENUE) WHEREAS, the hearing on the Special Assessment Investigation Report for the proposed improvement of West Elm Avenue Extension by the acquisition of necessary rights of way and construction of improvements has been conducted by the City Council of the City of E1 Segundo; and WHEREAS, the City Council has considered said in- vestigation report, as required by Division 4 of the Streets and Highways Code of the State of California; and WHEREAS, protests made or filed against this pro- ceeding represent less than 50% of the assessable area of the district proposed to be assessed for said improvement; WHEREAS, the investigation report shows that the debt limitations provided in said Division 4 will be exceeded as to individual parcels of land and as to the district as a whole, and, therefore, the Council, desiring to proceed with the improvement at this time, should provide that the limitations may be disregarded; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO DOES RESOLVE AS FOLLOWS: SECTION 1. That all protests to said report or improvement heretofore made or filed hereby are overruled and denied. SECTION 2. That the public interest, convenience, and necessity require the acquisition and improvement sub- stantially as set forth in said report, and the project is feasible, and the lands to be assessed for said acquisition and improvement will be able t,) carry the burden of such proposed assessments. Be 11'(4 7 ) SECTION 3. That the limitations on the amounts of assess- ments as prescribed by said Division 4 may be disregarded, both with respect to the limitations on the district as a whole and as to the limitations on the individual specific assessments. SECTION 4. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
