CC RESOLUTION 2275r RESOLUTION NO. 2275 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING THAT WEEDS GROWING UPON AND IN FRONT OF, AND RUBBISH, REFUSE AND DIRT UPON AND IN FRONT OF CERTAIN PRIVATE PROPERTY IN THE CITY ARE A PUBLIC NUISANCE, AND DECLARING ITS INTENTION TO PROVIDE FOR THE ABATEMENT THEREOF. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: BE IT RESOLVED THAT, pursuant to the provisions of Article 3, Chapter 13, Part 2, Division 3, Title 4, of the California Government Code, Sections 39560 to 39587, inclusive, and evidence received by it, the City Council of the City of E1 Segundo, California, specifically finds: SECTION 1. That rubbish, refuse and dirt, and the weeds growing upon the private property hereinafter described and upon the streets and sidewalks in front of said property are weeds which bear seeds of a wingy or downy nature or attain such large growth as to become a fire menance to adjacent improved property when dry, or which are otherwise noxious and dangerous. SECTION 2. That the presence of dry grass, stubble, refuse or other flammable materials are conditions which endanger the public safety. SECTION 3. That by reason of the foregoing facts the rubbish, refuse and dirt, and weeds or dry grass, stubble, refuse or other flammable material growing or existing upon the private property hereinafter described and upon the streets and sidewalks in front of said property constitute a public nuisance and should be abated as such. SECTION 4. That the private property, together with the streets and sidewalks in front of same herein referred to, is more particularly described as follows, to wit: That certain property described in Appendix "A" attached hereto and by this reference made a part hereof as though set forth in full at this point. BE IT THEREFORE RESOLVED, pursuant to the findings of fact by this Council heretofore made, that the rubbish, refuse and dirt, and that the weeds or dry grass, stubble, refuse or other flammable material in and upon and in front of the real property hereinbefore described constitute and are hereby declared to be a public nuisance which should be abated. The Street Superintendent is hereby designated the person to give notice to destroy or remove said rubbish, refuse and dirt, and the weeds or dry grass, stubble, refuse, or other flammable material and shall cause notices to be given to each property owner by United States Mail and said notice shall be substantially in the following form, to wit: "NOTICE TO DESTROY WEEDS AND REMOVE RUBBISHr REFUSE6 AND DIRT Notice is hereby given that on the 23rd day of June, 1969, the City Council of the City of E1 Segundo passed a resolution declaring that noxious or dangerous weeds were growing upon or in front of the property on this street, and that rubbish, refuse, and dirt were upon or in front of property on this street, in the City of El Segundo, and more particularly described in the resolution, and that they constitute a public nuisance which must be abated by the removal of the weeds, rubbish, refuse, and dirt. Otherwise they will be removed and the nuisance abated by the City and the cost of removal assessed upon the land from or in front of which the weeds, rubbish, refuse, and dirt are removed and will constitute a lien upon such land until paid. -2- 10 , ?t� Reference is hereby made to the resolution for further particulars. A copy of said resolution is on file in the office of the City Clerk. All property owners having any objections to the proposed removal of the weeds, rubbish, refuse and dirt are hereby notified to attend a meeting of the City Council of the City of E1 Segundo, to be held July 28, 1969 when their objections will be heard and given due consideration. BE IT FURTHER RESOLVED, that the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
