CC RESOLUTION 2273IUF0?;; RESOLUTION NO. 2273 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, PROVIDING DIRECTIONS TO ITS STAFF IN THE PROCESSING OF AN APPLICATION FOR A FRANCHISE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That in processing applications for franchises the City Staff shall be guided by the following considerations: (a) That franchises shall run for a period not to exceed twenty -five years. (b) That for the first year of any franchise granted or renewed, the fee shall be: (1) $1, 500. 00 for the first mile or less; and (2) $1, 500. 00 for each mile thereafter with a fraction thereof prorated. (c) That a franchise holder who fails to complete the initial installation of a pipeline within the time specified in the Permit to Exca- vate, shall pay $200. 00 per day as liquidated damages for each day con- struction extends beyond the time specified in the permit. (d) That the fees after the first year shall be eight cents per foot with an additional one cent per foot for each inch of internal diameter exceeding eight inches. (e) That the annual payment accruing to the City shall be increased by the percentage that the United States Bureau of Labor Statistics Wholesale Price Index All Commodities (1957 -59 = 100) for the calendar year preceding that in which the payment is due has increased over the annual average Wholesale Price Index All Commodities for the year 1968. (f) That the franchise holder shall be privileged to open the street for line testing, without penalty, two days a year. (g) That a franchise holder shall be permitted to open the street to repair his lines without charge, provided he first obtains a permit from the City Engineer setting forth an agreed upon reasonable number of days within which said work is to be completed. Street opening for a period exceeding the time specified in the permit shall require the franchise holder to pay to the City the sum of $200. 00 per day as liquidated damages. (h) That where private rights -of -way cross the public street easement, the franchise rate of $1, 500. 00 as set forth in (b) above, shall prevail with the additional imposition of a $200. 00 per day opening charge for every day until the street is restored to its previous condition. SECTION 2. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolu- tions of said City, and shall make a minute of the adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
