RESOLUTION NO. 2258A
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF EL SEGUNDO, CALIFORNIA,
OPPOSING SENATE BILL NO. 6 ESTABLISH-
ING AIRPORT HEIGHT ZONING RESTRICTIONS.
WHEREAS, Senate Bill No. 6, introduced on January 7,
1969 and referred to the Committee on Transportation, would create
height restrictions in zones extending approximately ten miles in
length and up to three miles in width from the end of every runway
for airports open to public use in California; and
WHEREAS, no structure, or natural growth designated
as a hazard to air navigation under Part 77 of the Federal Aviation
Agency=s Rules and Regulations would be permitted within the zones
unless a permit for the construction or growth is granted by the Divi-
sion of Aeronautics of the California Department of Public Works; and
WHEREAS, these restrictions would have detrimental
effects upon the industrial and commercial areas of E1 Segundo and,
it is believed, several other cities in California; and
WHEREAS, the use of height restriction zoning as pro-
posed would result in the taking of air easements over property with-
out compensation to the owner; and
WHEREAS, such height restriction zoning has been found
to be unconstitutional in other states;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That it strongly opposes Senate Bill No. 6
as an improper invasion by the State of local municipal exercise of
the police power and as a critical threat to private property rights,
and urges its representatives in the California Legislature to vote
against said bill.
SECTION 2. That it urges other cities which may be
similarly affected to oppose Senate Bill No. 6 and inform their State
Legislators of their opposition to said bill.

SECTION 3. That the City Clerk is hereby authorized
and directed to forward certified copies of this resolution to the follow-
ing:
1. State Senator Robert S. Stevens;
2. Assemblyman Robert G. Beverly;
3. All members of the Committee on Transportation;
4. The League of California Cities, Los Angeles Division;
5. All incorporated cities in Los Angeles County.
PASSED, APPROVED and ADOPTED this 10th day of Febru-
ary, 1969.
