CC RESOLUTION 224210,541 RESOLUTION NO. 2242 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, GRANTING A REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED THE HEIGHT LIMIT FOR THE CONSTRUC- TION OF AN ELEVEN -STORY OFFICE BUILDING AND SEVEN -STORY PARKING STRUCTURE ON PROPERTY COMMONLY KNOWN AS 901 -999 NORTH SEPULVEDA BOULEVARD BY KILROY INDUSTRIES, JOHN B. KILROY, PRESIDENT. WHEREAS, on May 22, 1968, Kilroy Industries filed an application for a Conditional Use Permit to erect an eleven -story office \ building and seven -story parking structure on property commonly known as 999 North Sepulveda Boulevard, more particularly described as follows: That portion of Lot 1 of Map of C. C. Huntts Subdivi- sion in Section 12, Township 3 South, Range 15 West in Rancho Sausal Redondo, in the City of E1 Segundo, County of Los Angeles, State of California, recorded in Book 36, page 36 of Miscellaneous Records, in the office of the County Recorder of said County, included within the following described lines: Beginning at the intersection of the north line of said Section 12, with the northerly prolongation of the east- erly line of Tract No. 15455, as per map recorded in Book 336, Pages 42 and 43 of Maps, records of said County; thence along the said prolongation, said east- erly line and southerly prolongation thereof South 0° 001 48" West 660. 34 feet to the northerly line of El Segundo, Sheet 5 as shown on map recorded in Book 20, Pages 114 and 115 of Maps, records of said County; thence along the said last mentioned northerly line South 890 58t 50" East 700 feet to the true point of begin- ning; thence continuing South 89° 58t 50" East to the east line of said Section 12; thence northerly and westerly along the easterly and northerly lines of said Section 12 to a line parallel with the said east line of Tract No. 15455 and which passes throu�h the true point of beginning; thence thereon South 00 00t 48' West 660. 42 feet to the true point of beginning; and WHEREAS, the Planning Commission did, pursuant to law, hold duly advertised public hearings on such matter in the Council Chamber of the City Hall on June 26, 1968, and continued the public hearing on July 10, 1968, and August 14, 1968; and on August 14, 1968, adopted its Resolution No. 689 entitled: "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF EL SEGUNDO, CALIFORNIA, DENYING A REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED THE HEIGHT LIMIT BY CONSTRUCTION OF AN ELEVEN -STORY OFFICE BUILDING AND SEVEN- 1t154p "STORY PARKING STRUCTURE ON PROPERTY COM- MONLY KNOWN AS 901 -999 NORTH SEPULVEDA BOULEVARD, BY KILROY INDUSTRIES, JOHN B. KILROY, PRESIDENT. "; and by said resolution, denied the request. On August 19, 1968, the appli- cant, Kilroy Industries, acting by and through its attorney, Mr. Walter N. Anderson, filed an appeal from the determination of the Planning Commission; and WHEREAS, on August 26, 1968, the matter of said appeal was set for public hearing before the City Council on September 23, 1968, in the Council Chamber in the City Hall, and notice of said hearing was given in the time, form, and manner prescribed by law; and WHEREAS, on September 23, 1968, at the request of the appli- cant, said hearing was continued until October 14, 1968; and WHEREAS, on October 14, 1968, the City Council duly and regu- larly conducted its public hearing on said application and gave all persons present in the Council Chamber an opportunity to be heard, and at said meet- ing the City Council, pursuant to the authority provided in Section 34. 135 of "The Code of the City of El Segundo, California, 1958," declared that it intended to grant the Conditional Use Permit and referred the matter back to the Planning Commission for a report to be presented to the City Council at the next regular City Council meeting to be held October 28, 1968, there- after the City Council continued the hearing on said application until Mon- day, October 28, 1968, at 7;00 P.M.; and WHEREAS, on October 23, 1968, the City Planning Commission considered said matter and on October 25, 1968, filed its report with the City Clerk; and WHEREAS, the City Council did duly and regularly consider said matter of said application together with the report of the Planning Commission, and gave all persons appearing at said hearing on October 28, 1968, an opportunity to be heard; and WHEREAS, the City Council has now reached its decision in the matter; -2- 11543 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council finds that the application of Kilroy Industries is an application properly made to the City Planning Commission, and properly appealed to the City Council. SECTION 2. The City Council does hereby grant the applica- tion of Kilroy Industries for a Conditional Use Permit to exceed the height limit by construction of an eleven -story office building and a seven -story parking structure on property at 901 -999 North Sepulveda Boulevard, subject to the following conditions: (1) That the applicant dedicate an additional five feet on the north side of Walnut Avenue for street widening purposes and dedicate the northwest corner of Walnut Avenue and Sepulveda Boulevard so as to pro- vide a twenty -three foot radius at the property line, and that the applicant, at its expense, shall perform all work and provide all materials required for paving said five foot strip and said curb return to City specifications, from its westerly property line to Sepulveda Boulevard. This require- ment is imposed due to the increased traffic and circulation problems that will result from construction of applicant's improvement, and will result in a minimum width of paving of twenty -five feet from the center line of Walnut Avenue to the face of the curb. The Director of Building Safety shall not issue a building permit pursuant to this Conditional Use Permit until applicant has dedicated the required right -of -way, and either im- proved the right -of -way or posted a bond or cash deposit in the amount of $4, 000. 00 in the form or manner approved by the City Attorney to guarantee that said improvements will be completed within a time to be fixed by the Director of Planning. (2) That all utilities providing services to the new building normally placed above ground, including without limitation electrical ser- vice lines and telephone service lines, shall be placed underground, except that if it is not possible to place said lines underground, overhead services may be approved by the City Council. (3) The applicant is informed that the City Council does not, -3- 1011141 by this action, intend to impair its authority to modify the traffic and circu- lation restrictions in the neighborhood of applicant's property if the need arises to make such modification. SECTION 3. That the City Clerk of the City of El Segundo is hereby authorized and instructed, pursuant to the requirements of Section 34. 138 of "The Code of the City of E1 Segundo, California, 1958, " to cause a copy of this resolution to be mailed to the applicant and to any other parties requesting notice of the action, and to attach a copy thereof to the Planning Commissions file of said case and to return said file to said Commission for permanent filing. SECTION 4. That this resolution shall take effect immediately. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adop- tion thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
