RESOLUTION NO. 2240
A RESOLUTION OF THE CITY OF EL SEGUNDO,
CALIFORNIA, URGING ADOPTION OF ENABLING
LEGISLATION TO AID CITIES IN THE CONTROL AND
PREVENTION OF BLIGHT BY THE ISSUANCE OF
"CERTIFICATES OF COMPLIANCE" TO PURCHASERS
OF REAL PROPERTY.
WHEREAS, planning agencies, city councils, and interested
citizens are concerned in protecting well- maintained neighborhoods from
the degenerating influence of buildings which fail consistently to meet mini-
mum standards of health and safety and the potential for neighborhood
deterioration resulting from a greater density of dwelling units than that
permitted by zoning ordinances; and
WHEREAS, at great public expense, Federal, State and local
funds have been expended for curative projects to rehabilitate neighbor-
hoods with relatively small efforts to prevent blight and deterioration; and
WHEREAS, by means of a simple administrative tool, entitled
a "Certificate of Compliance, " cities could furnish to building owners, at
nominal cost, a record of a building's use, condition, and legal status and
incorporate into one document an indication of conformance or nonconformance
of the property with existing codes; and
WHEREAS, the device of a "Certificate of Compliance" would
relieve realtors of liability for misrepresentation, put prospective pur-
chasers on notice of deficiencies, aid financial institutions to realistically
value properties on the basis of permitted use and provide governmental
agencies with efficiency of administrative and enforcement operations; and
WHEREAS, the effectiveness of a program of securing compli-
ance with local codes depends upon State Enabling Legislation with authori-
zation for the County Recorder to require evidence of a Certificate of Com-
pliance being furnished a purchaser of real property prior to deed record-
ing; and
WHEREAS, it is deemed to be a paramount concern of the State,
County, City governments and the general public to take all possible remedial
actions to preserve and improve the physical urban environment;

NOW, THEREFORE, the City Council of the City of E1 Segundo,
California, does resolve as follows:
SECTION 1. That the Legislature of the State of California be
petitioned to review the Pennsylvania State Statutes (1955, July 27, P. L.
288, §1, as amended; 1957, July 5, P. L. 502, §1; 1959, May 11, P. L.
303, §1; 1961, September 20, P. L. 1532, No. 652, §1) and adopt comparable
enabling legislation giving cities of California the authority to require an
owner of real property to furnish a buyer with a Certificate of Compliance
and when implemented by City Ordinance, to require evidence of such certi-
ficate as a prerequisite to recording of a deed by the County Recorder.
SECTION 2. That the Legislature of the State of California be
petitioned to adopt enabling legislation to better enable cities to prevent
blight, the misuse of real property and to provide some means of protection
to the unsuspecting and uninformed purchaser of real property.
SECTION 3. That the City Clerk be and is hereby directed to
furnish copies of this resolution to Governor Reagan, Members of the State
Legislature, the Los Angeles Regional Planning Commission, and the
League of California Cities.
