CC RESOLUTION 2117A10907 RESOLUTION NO. 2117a A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, OPPOSING SENATE BILLS NOS. 335 AND 336 PERTAINING TO THE OPERATION OF AIRPORTS. WHEREAS, Senate Bill No. 335 and Senate Bill No. 336, respectively, provide, (1) that property owners near airports must endure those inconveniences that are not harmful to the health or com- fort of ordinary people, and (2) authorizes a county, city or airport dis- trict to acquire, by eminent domain, the air space above private property for airport use such as takeoff and landing pads; and WHEREAS, Senate Bill No. 335 and Senate Bill No. 336 are proposed legislative enactments that will not correct wrongs which have been and are being perpetrated, and are statutory implements directed to the defeat of the rights of the property owner to obtain proper compen- sation for property, the use of which is destroyed or damaged by airport activities; and WHEREAS, these Senate Bills will defeat court determina- tions that airport noises can and do damagingly deprive homeowners of the use of their homes; and WHEREAS, the taking of the air space over a home for take- off and landing patterns also can and does similarly damage the home- owner in his ownership; and WHEREAS, full damages from excessive airport noises and low flying plane noises should be fully compensable, as in other instances of a public taking, unrestricted by biased legislation such as suggested by Senate Bills Nos. 335 and 336; and WHEREAS, these proposed enactments, Senate Bills Nos. 335 and 336 are completely objectionable and directly opposite to the public interest; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of E1 Segundo, 10 is unalterably opposed to the passage and adoption of Senate Bill No. 335 and Senate Bill No. 336 for the reasons hereinabove set forth and urges the defeat of said bills. SECTION 2. That the City Clerk is directed to send certi- fied copies of this resolution to Randolph Collier and Thomas M. Rees, Senators of the State of California; to Donald L. Grunsky, Tom C. Carrell and Charles Edward Chapel, Assemblymen of the State of California; to the cities of Inglewood and Hawthorne; to the Westchester Chamber of Commerce; and to the League of California Cities.
