It is provided, however, that where a member of the Police Department is

SECTION 6. DISABILITY OR SICKNESS: (A) That in addition
to the salaries and benefits otherwise provided for in this resolution, each
regular officer or employee of the City, as a part of his services rendered
shall be entitled to receive, and there shall be paid to him during periods
of physical disability by reason of illness or injury which necessitates
absence from duty, amounts in accordance with the following schedule of
disability payments, to wit:
(1) In cases where such disability is NOT compensable under the
provisions of the Workmen's Compensation Laws of the State of California,
each such employee shall be entitled to one (1) day's absence with pay for
each month of actual service (inclusive of periods of bona fide disability
absences) in the employment of said city, not to exceed a maximum of
132 days; each day of disability leave actually taken by any such employee
shall be deducted from his accumulated credit. Effective September 1,
1964, and on the first day of each December thereafter, employees who
maintain a 132 days unused sick leave balance, shall be paid the regular
compensation for one -half of the sick leave unused during the twelve
months preceding said December 1, which said unused days otherwise
would have been lost by reason of their exceeding the maximum per-
mitted. Payment shall be made on the 10th day of the month following
the period in which the non - cumulative sick leave was earned.
(2) In cases where such disability IS compensable under the pro-
visions of the Workmen's Compensation Laws of the State of California,
each such employee (other than those to whom the provisions of Section
-15-
.1017 3
4850 of the Labor Code of the State of California apply and who
receive benefit thereunder) shall be entitled to receive:
(a) The employee's regular salary for the so- called waiting
period provided for in said Workmen's Compensation Laws;
and
(b) An amount equal to the difference between the regular mon-
thly salary of such employee paid by said city and the amount
of any compensation received by any such employee under
said Workmen's Compensation Laws (exclusive of medical,
surgical, hospitalization, appliances, or similar items of
costs) until the amount paid the employee equals in dollars
the aggregate amount of his accumulated sick leave, com-
puted in the same manner and subject to the same changes,
credits and limitations as hereinabove set forth in para-
graph (1) of this section.
(B) The Director of Finance in preparing demands for compensa-
tion under the provisions of this Section 6, may require the employee con-
cerned to submit to said Director, evidence satisfactory to such Director
showing the amount of Workmen's Compensation payments received by
such employee (exclusive of medical, surgical, hospitalization, appli-
ances, or similar items of costs).
The City Council appreciates that in many instances it may be im-
possible at the time the regular payrolls are presented to the Council
for approval to determine various amounts which may hereafter become
payable under the provisions of this Section 6 to various employees due
to a variety of reasons and causes, such for example, as delays which
may occur in the fixing of compensation amounts in Industrial Accident
cases; the failure of the employee to monthly or promptly receive his
Workmen's Compensation allowances, etc. In all such cases, the City
shall be under no obligation to make to the employee the payments pro-
vided for in this section until such time as such matters can be properly
determined. The City Manager may present to the City Council any and
all problems which may arise in the Administration of the provisions
hereof, and the City Council reserves the right to consider such prob-
lems and to determine the same and make such adjustments and orders
as may be necessary and proper in the premises.
(C) The Council reserves the right, to be exercised in its discre-
-16-
10174
tion, to at any time and from time to time, at the expense of said city,
require any such employee to appear before any duly licensed physician
or surgeon selected by the City Manager and submit to a medical and
physical examination with respect to his illness, injury or disability.
The failure or refusal of any such employee to submit himself to any
such examination, may, in the discretion of the said Council, forfeit
any further rights to receive disability benefits or compensation under
the provisions of this resolution.
The written report of any such physician or surgeon to said Council
may be examined by said Council, the City Manager and City Attorney of
said City, but shall otherwise be confidential; provided, however, that
the same may be introduced in evidence in any action or proceeding re-
lative to the subject of illness, injury or disability of the patient or per-
son referred to therein, and such physician or surgeon may give testi-
mony respecting the subject of such examination and the physical condi-
tion of the employee therein referred to, and each employee of said city
accepting employment, by accepting such employment and rendering ser-
vice thereunder, does thereby automatically and accordingly so agree.
SECTION 7. VACATIONS: (A) Excepting members of the
Police and Fire Departments who shall receive annual vacations as pro-
vided by law, each officer and employee regularly employed in the ser-
vice of said city shall, subject to the limitations hereinafter set forth,
be entitled to and shall receive a vacation of ten (10) working days
with full salary for each year of service to said city. It is provided,
however, that in the cases of all employees who prior to August 29, 1964,
have served the said City for ten (10) years or more, the annual vacation
or leave of absence with pay for each year of service shall be increased
so as to provide:
(1) In the case of police department a total of fifteen (15)
working days;
(2) In the case of fire department a total of nine (9) twenty -
four hour working periods; and
(3) In the case of all other employees of the City a total of
fifteen (15) working days.
17-
lt)17
(B) "Year of Service" within the meaning of this section shall
mean the period of one year from any given date during which the em-
ployee shall have been regularly employed. All vacations shall be
taken at such times as are agreeable to the head of the department and
approved by the City Manager. Earned vacations shall not be accumu-
lated for a longer period than for two years' service.
SECTION 8. ADVANCEMENT (A) No step increase shall be
granted automatically, but each such increase shall be based upon at
least satisfactory performance by the employee, the specific recommenda-
tion for such increase by his immediate superior or department head and
approved thereof by the City Manager.
(B) In the event a report of unsatisfactory service or of miscon-
duct is filed in lieu of a report of satisfactory service, an employee
affected thereby may, upon the recommendation of his department head
and upon the approval of the City Manager, be reassigned to a lower
classification or step range, or may be suspended from active duty with-
out pay for a specified period, during which suspension no fringe benefits
or service time shall accrue.
(C) In the event such entry of unsatisfactory service appears, the
employee affected thereby upon written application therefor to the City
Manager shall have the right to a review of said entry and to a hearing
thereon by the City Manager. Upon such review and hearing, the City
Manager's decision after such review and hearing shall be final and con-
clusive. Any request for review of any such entry must be filed with the
City Manager within fifteen (15) days after the employee affected has
received knowledge or notice of the fact that such entry has been made,
otherwise the City Manager may refuse to consider the same.
SECTION 9. REPEALS, Resolution No. 2057 passed and
adopted on the 23rd day of September, 1963, and all resolutions amending
said Resolution No. 2057, and all resolutions and orders of the City Coun-
cil heretofore passed and adopted with reference to the same, or any of
the matters and subjects hereinabove set forth or referred to, are hereby
-18-
.10176
repealed insofar as the same conflict with the provisions hereof.
SECTION 10. In all cases where any employee renders ser-
vice in more than one department, and the City Council has not desig-
nated the amount or percentage of the compensation of such employee to
be charged against any particular department or departments, the Direc-
tor of Finance may, for accounting purposes, determine and charge accord-
ingly the amount of percentage of the compensation or salary of any such
employee which is to be charged to each of the respective departments in
which such service was rendered. So far as reasonably practicable, such
charges when made against the various departments shall be substantially
in proportion to the service rendered such respective departments.
SECTION 11. EFFECTIVE DATE: This resolution shall take
effect and be in full force and virtue on and after the 29th day of August,
1964.
SECTION 12. CERTIFICATION: The City Clerk shall certify
to the passage and adoption of this resolution; shall enter the same in the
book of original resolutions of said city; and shall make a minute of the
passage and adoption thereof in the records of the proceedings of the City
Council of said city in the minutes of the meeting at which the same is
passed and adopted.
Passed, approved and adopted this 14th day of September, 1964.
