CC RESOLUTION 2076IN11 RESOLUTION NO. 2076 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA GRANTING TO NORTH AMERICAN AVIATION, INC. AND VICKERS INCORPORATED, A CER- TAIN CONDITIONAL ENCROACHMENT PER- MIT TO ENCROACH UPON A CERTAIN POR- TION OF NASH STREET WITHIN SAID CITY. WHEREAS, there has been presented to the City Council of the City of E1 Segundo, California, a request from North American Aviation, Inc. and Vickers Incorporated, for an encroachment permit on a portion of Nash Street within said city, as hereinafter described, which request is accompanied by two maps designated as "SITE PLAN OF PLOT FOR DIRECTORY SIGN - REPORT NO. EDS63 -40" and "SIGN - MAJOR FUNCTIONAL - MAJOR DIRECTION - ILLUMINATED, SHEET NO. 18077- 112C," showing the location and extent of the pro- posed encroachment; and WHEREAS, after due consideration of said matter, the City Council believes that the action hereinafter taken, subject to the terms and conditions hereinafter expressed, is indicated in the premises; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. For the purposes of installing and maintaining a traffic directory sign on Nash Street, and subject to the terms and conditions hereinafter set forth, the said applicants, North American Aviation, Inc. and Vickers Incorporated, are hereby authorized and permitted to encroach upon a certain portion of Nash Street within said city, and more particularly described as follows: The following description is for an area of . 0012 acres at the SE corner of the intersection of E. Imperial Highway and Nash Street.,, City of El Segundo, described as follows: Commencing at NW corner of NE 1/4 of Sec- tion 7, Twn 3S, R14W, S. B. B and M., thence, easterly along section line on said Imperial Highway, bearing N 890 591 20" E a distance of 27 ft. to a point; thence S 0 °00123" E a distance of 45 ft. to the true point of beginning; thence N -1- 89059120" E a distance of 3 ft. to a point on the West property line of adjacent property; thence S 0000123" E a distance of 18 ft. along said prop- erty line to a point; thence S 89 °59120" W a dis- tance of 3 ft. to a point; thence N 0 100123" W a distance of 18 ft. to the true point of beginning. SECTION 2. That the terms and conditions upon and sub- ject to which the permit herein above referred to is authorized and granted are as follows: (A) That the City of El Segundo is to be put to no cost or expense in connection with: (1) the installation, main- tenance or repair of the improvements in or upon said "encroachment portion" so long as this permit remains in effect; or (2) the relocation of existing fire hydrants, water meters and other utilities that lie within the "en- croachment portion ", to a position or location satisfac- tory to the City Engineer of said City. (B) That said permittees by acceptance of this permit shall thereby agree to indemnify and save the City of El Se- gundo, its officers, agents, servants and employees harmless from any and all loss or damage which may be occasioned to, or suffered by, either persons or property as a result of the exercise by permittees of any rights granted under this permit, or be due to the existence of said encroachment facilities, appurten- ances and materials in or upon said public thoroughfare. (C) That this permit is temporary only and may be revoked by the City Council of said City at any time on thirty (30) dayst written notice of such revocation to said permittees, which right said City Council does specifically reserve. Such revocation may be made for any reason which the City Council, in the exercise of its sole discretion, deems sufficient. No such revocation, however, shall be made or ordered unless and until the permittees are afforded an -2- P" I f () opportunity to be heard before said City Council on the question of such revocation upon at least ten (10) days prior written notice to said permittees of the time, place and purpose of such hearing. The de- cision of the City Council in said matter, however, shall be final and conclusive. (D) That in the event this permit is revoked, the per- mittees shall at their own cost and expense promptly remove from the "encroachment portion ", if the City Council so requires, any improvement or portion thereof which the City Council in its discretion may designate for such removal, if any. (E) That this permit shall not become effective unless and until the permittees shall have accepted the same and have agreed to the terms and conditions hereof by endorsing their approval and acceptance upon a certifiied copy of this resolution to be filed with the City Clerk. SECTION 3. That the City Clerk shall furnish to said per- mittees as many certified copies of this resolution as permittees may reasonably require and one of such certified copies shall be returned to the City Clerk with the endorsement of the permitteest approval and acceptance of the authority and permit herein granted, upon and subject to the terms and conditions herein expressed. This resolution and the certified copy thereof so endorsed and filed shall constitute and be the actual authority and permit in the premises. SECTION 4. That the City Clerk shall certify to the pass- age and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed -3- and adopted.
