CC RESOLUTION 194196A RESOLUTION OF INTENTION NO. 1941 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUND09 CALIFORNIA, DECLARING ITS INTEN- TION TO ORDER THE VACATION (SUBJECT TO THE RESER- VATION AND EXCEPTION OF CERTAIN EASEMENTS AND RIGHTS OF WAY) OF CERTAIN PORTIONS OF IMPERIAL AVENUE, ACACIA AVENUE, SYCAMORE AVENUE, MAPLE AVENUE, OAK AVENUE, PALM AVENUE AND MARIPOSA AVENUE WITHIN SAID CITY. The City Council of the City of E1 Segundo, California, pursuant to the provisions of the „Street Vacation Act of 1941", being Part 3 of Division 9 of the Streets and Highways Code of the State of California, does hereby resolve, declare, deter- mine and order as follows: SECTION 1. That it is the intention of the City Coun- cil of the City of E1 Segundo, California, to order the vacation (subject to the reservation and exception of easements and rights of way as set forth hereinafter) of all those portions of Imperial Avenue (formerly Imperial Highway), Acacia Avenue, Sycamore Avenue, Maple Avenue, Oak Avenue, Palm Avenue and Mariposa Avenue lying within the boundaries of the City of E1 Segundo as said Avenues are shown on Map MR 16$1, being Exhibit A -1 in Superior Court Case Number 644172 of May 13, 19552 The City of Los Angeles, a muni- cipal corporation and the Department of Water and Power of the City of Los Angeles, Plaintiffs, vs. Higgins et al, Defendants; on file with the Clerk of Superior Court, County of Los Angeles, State of California. All those portions of Imperial Avenue, Syca- more Avenue, Maple Avenue, Oak Avenue and Palm Avenue lying west- erly of a line described as follows, to wit; PARCEL ONE Beginning at the point of intersection of the northerly prolongation of the westerly line of Lot 5, Block 12, - 1 - 0 Tract 16$5 with the northerly line of Imperial Avenue (80 feet wide) THENCE south 0 °0114$" east along said prolongation and the westerly line of said Lot 5 and the northerly prolongation and a portion of the west line of Lot 11, Block 12, Tract 16$5, a distance of 464.49 feet to a point in the northerly prolongation of the easterly right -of -way line bearing south 11° 2$117" east as shown on said Map MR 16$1; THENCE along said prolongation and said easterly right -o£ -way line south 11 °2$117" east a distance of 2,777.0$ feet more or less to a point in the centerline of Pine Avenue, 50 feet in width, said point being located south $9° 5515011 west a distance of 49$.69 feet from the inter- section of said centerline of Pine Avenue with the centerline of Hillcrest Street as said Avenues are shown on said Map MR 16$1. PARCEL TWO That portion of Acacia Avenue 40 feet in width, lying westerly of a circular curve concave easterly having a radius of 35.00 feet the center of which is located on the centerline of said Acacia Avenue and distant thereon 2$.71 feet westerly from its intersection with the above described line. PARCEL THREE That portion of Mariposa Avenue, 50 feet wide, as shown on said Map MR 16$1, lying westerly of a circu- lar curve concave easterly and having a radius of 30.00 feet the center of which is located on the centerline of said Mariposa Avenue and is distant thereon 16.13 feet easterly from its intersection with the above described line. For further particulars as to the proposed vacation of said portions of Imperial Avenue, Acacia Avenue, Sycamore Avenue, Maple Avenue, Oak Avenue, Palm Avenue and Mariposa Ave- nue, reference is hereby made to map, entitled "MAP SHOWING PORTIONS OF CERTAIN STREETS IN TRACT NO. 16$5, MAP BOOK 210 PAGE 9$, PROPOSED TO BE VACATED UNDER RESOLUTION OF INTENTION NO. 1941 ", on file and open to public inspection in the office of the City Clerk of the City of E1 Segundo, California, in the City Hall of said city. SECTION 2. The City Council does hereby determine that the public convenience and necessity require the reserva- tion of certain easements and rights of way for structures enumerated in Section $330 of the Streets and Highways Code of the State of California, and these proceedings are taken, sub- - 2 - 3� 37 Jf G3& ject to such reservations and exceptions. The easements and rights of way hereby reserved and excepted from the vacation are the following, to wit; "The permanent easement and right at any time or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street, or part, or portion thereof proposed to be vacated hereby and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, main- tain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other con- venient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines and lines for the transportation or distribution of electric energy, petroleum and its products, ammonia, water and incidental purposes, in- cluding access and the right to keep the property free from inflammable materials, and wood growth, and other- wise protect the same from all hazards in, upon, and over the public street proposed to be vacated hereby." SECTION 3. That the hour of 700 P. M., on Monday, December 12, 1960, in the Council Chamber in the City Hall, 350 Main Street, in said city, be and the same is hereby fixed as the time and place when and where any and all persons in- terested in or objecting to the proposed vacation of said por- tion of said public street may appear before said City Council and be heard and offer testimony and submit evidence in rela- tion thereto. SECTION 4. That the Superintendent of Streets of the City of E1 Segundo, California, be and he is hereby directed to cause "NOTICE OF STREET VACATION (PORTIONS OF CERTAIN STREETS - 3 - IN TRACT NO. 1685, MAP BOOK 21, PAGE 98) AND OF PUBLIC HEAR- ING THEREON ", to be posted as required by the said "Street Vacation Act of 1941 ", being Part 3 of Division 9 of the Streets and Highways Code of the State of California; and the City Coun- cil of said city hereby elects to proceed under the provisions of said Act. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution, and shall cause the same to be published once in the E1 Segundo Herald, a bi- weekly newspaper of general circulation, published and circulated in said city and hereby designated for that purpose by the said City Council.
