CC RESOLUTION 1916A:, RESOLUTION OF INTENTION NO. 1916 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTEN- TION TO ORDER THE VACATION (SUBJECT TO THE RESERVA- TION AND EXCEPTION OF CERTAIN EASEMENTS AND RIGHTS OF WAY) OF A CERTAIN PORTION OF MARYLAND STREET WITHIN SAID CITY. The City Council of the City of E1 Segundo, California, pursuant to the provisions of the "Street Vacation Act of 194111, being Part 3 of Division 9 of the Streets and Highways Code of the State of California, does hereby resolve, declare, determine and order as follows: SECTION 1. That it is the intention of the City Coun- cil of the City of El Segundo, California, to order the vacation (subject to the reservation and exception of easements and rights of way as set forth hereinafter) of a certain portion of Maryland Street within said City, which is more particularly described as follows, to wit: All that portion of Maryland Street shown on Map of Tract No. 12812, Recorded in Map Book 247, Pages 34 and 35, in the Office of the Recorder of the County of Los Angeles, State of California, lying within the following described boundary: Beginning at the northwesterly corner of Lot 157 in said Tract; thence South 89° 59' 40" East along the north line of said Lot, a distance of 40.60 feet to the true point of beginning, a point in a tangent curve concave southwesterly, having a radius of 15.00 feet; thence southeasterly along said curve 23.56 feet; thence South 00 00' 20" West, along the easterly line of said lot 118.21 feet to a point in a curve concave southerly, having a radius of 929.946 feet and a radial line through said last mentioned point bearing North 5° 14' 58" East; thence easterly along said curve 50.36 feet, more or less, to a point in the west line of Lot 156, which lies westerly along said 929.946 foot radius curve 5.58 feet from a point in the southerly line of said Lot 156 which lies North $9° 59' 40" West, 49.93 feet from the southeast corner of said Lot 156; thence North 0° 00' 20" East, 124.17 feet to the beginning of a tangent curve concave southeasterly, having a radius of 15.00 feet; thence northeasterly along said curve 23.56 feet; thence North $9° 59' 40" West, $0.00 feet to the true point of beginning. - 1 - For further particulars as to the proposed vacation of said portion of Maryland Street, reference is hereby made to map, entitled "MAP SHOWING PORTION OF MARYLAND ST. PROPOSED TO BE VACA- TED UNDER RESOLUTION OF INTENTION NO. 141611, on file and open to public inspection in the office of the City Clerk of the City of E1 Segundo, California, in the City Hall of said city. SECTION 2. The City Council does hereby determine that the public convenience and necessity require the reservation of the easements and rights of way for structures enumerated in Sec- tion $330 of the Streets and Highways Code of the State of Cali- fornia, and these proceedings are taken, subject to such reserva- tions and exceptions. The easements and rights of way hereby re- served and excepted from the vacation are the following, to wit: The permanent easement and right at any time or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street, or part, or portion thereof proposed to be vacated hereby and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, main- tain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other con- venient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines and lines for the transportation or distribution of electric energy, petroleum and its products, ammonia, water and incidental purposes, in- cluding access and the right to keep the property free from inflammable materials, and wood growth, and other- wise protect the same from all hazards in, upon, and over the public street proposed to be vacated hereby. - 2 - ".W: MRJ SECTION 3. That the hour of 7:00 P. M., on Monday, May 9, 1960, in the Council Chamber in the City Hall, 350 Main Street, in said City, be and the same is hereby fixed as the time and place when and where any and all persons interested in or objecting to the proposed vacation of said portion of said public street may appear before said City Council and be heard and offer testimony and submit evidence in relation thereto. SECTION 4. That the Superintendent of Streets of the City of E1 Segundo, California, be and he is hereby directed to cause "NOTICE OF STREET VACATION (PORTION OF MARYLAND STREET) AND OF PUBLIC HEARING THEREON ", to be posted as required by the said "Street Vacation Act of 1941 ", being Part 3 of Division 9 of the Streets and Highways Code of the State of California; and the City Council of said City hereby elects to proceed under the provisions of said Act. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution, and shall cause the same to be published once in the E1 Segundo Herald, a bi- weekly newspaper of general circulation, published and circulated in said City and hereby designated for that purpose by the said City Council. Passed, approved and adopted this 11th day of April, 1960.
