A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, DETERMIN-
ING THAT THERE IS ONLY ONE CONTRACTOR
PRACTICALLY CAPABLE OF SERVING THE STREET
LIGHTING SYSTEM OF SAID CITY AS HEREINAFTER
SET FORTH.
WHEREAS, the City Council of the City of E1 Segundo,
California, in Resolution No. 1885 of said Council, pursuant
to the provisions of the "Street Lighting Act of 1919" of the
State of California (Part 1 of Division 14 of the Streets and
Highways Code of said State), as amended, and particularly as
contemplated under the provisions of Section 18041 of said law
and under the alternative procedure for installment assessments
provided for in Chapter 8 of said "Street Lighting Act of 191911,
did require the City Engineer of said City to make and file with
the Clerk of said Council a report in writing, presenting cer-
tain matters relating to a proposed lighting maintenance and
service district for Maryland Street and Other Streets in said
City, as contemplated, under the provisions of said itStreet
Lighting Act of 1919 "; and
WHEREAS, the City Engineer, pursuant to the require-
ments of said City Council, expressed in said Resolution No.
1$$5 and of said law, did make and on the 20th day of November,
1959 did file in the office of the City Clerk (who is Ex- officio
Clerk of the City Council) of said City his report in writing
responsive to the requirements of the said Resolution No. 1$$5
and of said law relating to the proposed lighting maintenance
and service district in said City, referred to in said Resolu-
tion No. 1$$5 and as contemplated under the provisions of said
"Street Lighting Act of 1919 "; and
WHEREAS, the provisions of the Streets and Highways
Code relating to the obtaining of bids for the making of the
improvement contemplated by said proceedings particularly pro-

vides among other things that if the City Council determines
there is only one contractor practically capable of serving
the street lighting system to be improved in the manner pro-
vided in the plans and specifications contained in the report
provided for in Chapter 3 of said Code, and that such con-
tractor is subject to the jurisdiction of the Public Utilities
Commission of the State of California, the City Council may,
in its discretion without competitive bidding, order the
improvement to be carried out by such contractor in accord-
ance with rates and rules filed by such contractor from time
to time with said Public Utilities Commission; and
WHEREAS, the Director of Public Works has reported
receiving the bid of Southern California Edison Company, which
proposal, dated November 10, 1959 is as follows:

SUBJECT: Edison Wood Street Light Poles being replaced
with Steel Electroliers.
Dear Mr. Webb:
Enclosed you will find our work order map and a print
showing the red circle area including 26 Edison wood
poles with which you are concerned. The breakdown of
the costs to convert this area to steel electroliers
is as follows:
1. Installation cost per existing wood pole X142.53
2. Plus removal cost per existing wood pole. 57.65
3. Less salvage credit for each existing wood polell3.91
4. Plus cost differential between steel and wood
poles. 135.00
5. Total collectible cost per unit. 221.27
6. Number of poles in red circle - 26 x 221.27
Total cost to City for conversion of red circle area
to steel electroliers. $5,753.02
Specifications for the installation of steel electroliers
vary as to the installation due to the soil, location,strees
and so on, and will be kept to the highest standards of

construction. Any variation in good construction
practices will be corrected. The steel electroliers
will remain the property and will be maintained by
the Southern California Edison Company.
The location of the new steel electroliers will be
immediately adjacent to the existing wood poles, but
at no time can the wood poles be removed before the
steel electroliers are erected.

WHEREAS, the facts compellingly indicate that the
provisions of the Code hereinabove cited provide for the
specific instance herein and by reason thereof said provi-
sions of the Code should be employed by an appropriate resolu-
tion and determination of this Council;
NOW, THEREFORE, the City Council of the City of
El Segundo, California, does hereby find, declare and deter-
mine as follows:
SECTION 1. That there is only one contractor practi-
cally capable of serving the hereinabove described and contem-
plated street lighting system to be improved in the manner pro-
vided in the plans and specifications and the Street Lighting
Act of 1919, and that said contractor is Southern California
Edison Company; that said company is subject to the jurisdic-
tion of the Public Utilities Commission of the State of Cali-
fornia;
SECTION 2. That accordingly in the City Council's
discretion said company should be, and hereby is, employed
without competitive bidding and pursuant to the terms and
provisions of its proposal herein on file in the office of the

City Clerk of said City, to carry out and complete the
installation of said lighting fixtures and appliances on
Maryland Street and Other Streets within said City, in
accordance with plans and specifications prepared by the
City Engineer and heretofore approved by said City Council
which said plans and specifications also are on file in the
office of the City Clerk of said City;
SECTION 3. Further said improvements be, and the
same hereby are ordered to be carried out by Southern Cali-
fornia Edison Company in accordance with the rates and rules
filed by it from time to time with said Public Utilities
Commission. The bid of said company is accepted, the con-
tract for said improvement is awarded to it.
SECTION 4. That the City Clerk shall prepare copies
of this resolution after the passage and adoption thereof, and
shall affix to such copies at the end thereof, after the Clerk's
Certificate, forms for the approval of the Southern California
Edison Company and on the part of the said City; and such copies
of this resolution, so approved and accepted by the Southern
California Edison Company and by and on behalf of said City,
shall constitute the contract for said work and materials; and
the Mayor of the City of E1 Segundo is hereby authorized oa
behalf of said City to affix the approval and acceptance of said
City to such contract, and said City Clerk is hereby authorized
and instructed to attest the same on behalf of said City and to
affix the seal of said City thereto.
SECTION 5. That the City Clerk shall certify to the
passage and adoption of this resolution; shall enter the same
in the book of original resolutions of said City; and shall make
a minute of the passage and adoption thereof in the records of
the proceedings of the City Council of said City in the minutes
of the meeting at which the same is passed and adopted.
Passed, approved and adopted this 28th day of December,
1959.
