RESOLUTION NO. 1873
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, GRANTING TO IN-
DUSTRIAL ASPHALT OF CALIFORNIA, INC. A CERTAIN
CONDITIONAL USE PERMIT FOR AN ASPHALT MIXING
PLANT ON A CERTAIN PARCEL OF PROPERTY LOCATED
ON ROSECRANS AVENUE WITHIN SAID CITY.
WHEREAS, Industrial Asphalt of California, Inc. did
duly and regularly file with the City Planning Commission of
the City of El Segundo its application for a conditional use
permit for an asphalt mixing plant at the location hereinafter
referred to; and
WHEREAS, after proceedings duly and regularly had
and taken with reference to said application, said City Plan-
ning Commission did on the 1st day of July, 1959, duly and
regularly adopt its Resolution No. 406, in words and figures
as follows:
"RESOLUTION NO. 406
A RESOLUTION OF THE CITY PLANNING COMMISSION
OF THE CITY OF EL SEGUNDO, CALIFORNIA, GRANT-
ING REQUEST OF THE INDUSTRIAL ASPHALT OF CALI-
FORNIA, INC. FOR A CONDITIONAL USE PERMIT TO
LOCATE AN ASPHALT MIXING PLANT IN AN M -2 ZONE.
WHEREAS, application was made on June 10, 1959,
by the Industrial Asphalt of California, Inc., to lo-
cate an asphalt mixing plant in the M -2 zone within
the City of El Segundo, California, on certain property
known and described as a portion of Section 1$, Town-
ship 3 South, Range 14 West, (on Rosecrans Avenue
approximately 1000 feet east of Sepulveda Boulevard);
and
WHEREAS, under Section 1201 (Item 22) of Ordinance
No. 507 (the Comprehensive Zoning Ordinance), the es-
tablishment or operation of an asphalt mixing plant in
an M -2 zone shall not be permitted unless a Conditional
Use Permit authorizing such use has been granted; and
WHEREAS, said application was duly and regularly
set for public hearing before the Planning Commission
on June 24, 1959; and
WHEREAS, said hearing was duly held and testimony
was taken both for and against the issuing of the pro-
posed Conditional Use Permit; and
WHEREAS, a Staff Report was introduced showing
the results of a study to determine the nature of as-
phalt mixing plants operating in the southwest area; and
WHEREAS, several members of the Planning Commission
of the City of E1 Segundo reported to the Commission
upon their individual inspection of the Industrial As-
phalt of California, Inc.'s asphalt mixing plant at

Stanton, California, and advised the Commission
that they did not find, upon such inspection, any
features of an objectionable nature or incompatible
with an M -2 use;
NOW THEREFORE, the Planning Commission of the
City of E1 Segundo does resolve, declare determine and
order as follows:
SECTION 1. Said Planning Commission does hereby
find that the facts recited in the preamble of this
Resolution and in the Staff Report hereinabove referred
to in said preamble, are true.
SECTION 2. That the Planning Commission, in con-
sideration of the foregoing facts, finds that an asphalt
mixing plant, as proposed by the applicant, is a com-
patible use in the M -2 Zone, in the area in which it is
intended to be located, with certain limitations and
restrictions as hereinafter set forth and defined.
SECTION 3. By reason of the findings and reci-
tations hereinabove set forth, it is the opinion of
the Planning Commission that the granting of the Con-
ditional Use Permit is reasonable and necessary to
carry out the provisions and general purpose of Ordin-
ance No. 507, and the Planning Commission hereby approves
the said application to allow the location of Industrial
Asphalt of California, Inc.'s asphalt mixing plant at
the above described property, subject to the following
conditions:
1. That the entire area leased by the In-
dustrial Asphalt of California, Inc. be completely paved.
2. That the area be fenced with a chain link
fence at least six feet in height.
3. That the sump be fenced with a chain link
fence at least six feet in height with three strands of
barbed wire fence above.
4. That the plant to be erected on this prop-
erty shall be equal in every respect, to the plant at
Stanton, California, insofar as smoke, fumes, dust, odor,
noise, vibration or hazard is concerned.
5. That the mixing plant shall not be closer
than 150 feet to the north line of Rosecrans Avenue.
6. That the dump hopper shall not be closer
than 125 feet to the north line of Rosecrans Avenue.
7. That the gates shall be at least 43 -1/2
feet north of the north line of Rosecrans Avenue and
the fence on the east and west sides of each gate shall
be at an angle in order to widen the means of ingress
and egress.
8. That the equipment, facilities and oper-
ation shall be maintained to the standards as set forth
in the application.

9. That the material from the sump shall
be disposed of while in a moist condition.
10. That the quantity of aggregates at no
time shall exceed the capacity of the bunkers.
FINALLY RESOLVED, that a copy of this resolution
shall be forwarded to the City Council for its infor-
mation.
Passed, approved and adopted this 1st day of July,

WHEREAS, Resolution No. 406 was duly and regularly
transmitted to and filed with the City Council of said City;
and
WHEREAS, within the time permitted by law, and on
the 10th day of July, 1959, the City of Manhattan Beach did
duly and regularly file with the City Clerk of said City, its
appeal from the decision of said Commission as set forth in
its said resolution above mentioned; and
WHEREAS, upon receipt of said appeal, said City Coun-
cil did duly and regularly set the matter of said appeal and
the matter of said conditional use permit for public hearing
before said City Council on the 27th day of July, 1959; and
WHEREAS, on said last mentioned date said City Coun-
cil did duly and regularly hear the matters of said appeal and
of the conditional use permit referred to and described in said
Resolution No. 406 of said Commission and has afforded all
parties and persons interested a full and fair opportunity to
be heard with reference thereto and has concluded said hearing;
and
WHEREAS, said Council after having held said hearing
and having reviewed the complete file of the City Planning Com-
mission with reference thereto and all evidence adduced at the

public hearing before said Council has reached its decision
in said matter as hereinafter set forth;
NOW, THERE
SEGUNDO, CALIFORNIA,
TERMINE AND ORDER AS
SECTION 1.
the facts recited in
SECTION 2.
FORE, THE CITY COUNCIL (F THE CITY OF EL
DOES HEREBY RESOLVE, DECLARE, FIND, DE-
FOLLOWS:
Said City Council does hereby find that
the preamble of this resolution are true.
That said City Council does hereby grant
the said conditional use permit applied for upon and subject
to the terms and conditions set forth and recited in said
Resolution No. 406 of the said City Planning Commission herein -
above quoted.
SECTION 3. Responsive to the requirements of Section
1713 or Ordinance No. 507 (the Comprehensive Zoning Ordinance)
of said City, as amended, said City Council does hereby refer
to the facts and reasons set forth by the City Planning Com-
mission in its said Resolution No. 406 hereinabove quoted for
the granting of the conditional use permit above referred to,
and by this reference does hereby incorporate the said facts
and reasons in this resolution at this point as fully and for
all intents and purposes as though the same were herein set
forth at length, and said City Council does hereby so recite
the said facts and reasons and does hereby adopt the same as
the facts and reasons, which in the opinion of this City Council
make the granting of said conditional use permit necessary to
carry out the general purpose of said Ordinance No. 507. Said
Council does hereby accordingly hold that the said conditional
use permit be granted, subject to such conditions and limitations
imposed by this Council.
SECTION 4. That the City Clerk of the City of E1
Segundo is hereby authorized and instructed, pursuant to the
requirements of Section 1715 of said Ordinance 507 of said City

to cause a copy of this resolution to be mailed to the appli-
cant and to any other parties requesting notice of the action,
and to attach a copy thereof to the Planning Commission's file
of said case and to return said file to said Commission for
permanent filing.
SECTION 5. That this resolution shall take effect
immediately.
SECTION 6. That the City Clerk shall certify to
the passage and adoption of this resolution; shall enter the
same in the book of original resolutions of said City; and
shall make a minute of the passage and adoption thereof in the
records of the proceedings of the City Council of said City
in the minutes of the meeting at which the same is passed and
adopted.
