33 ZS RESOLUTION NO. 1$71 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, FIXING THE COMPENSATION OF THE VARIOUS OFFICERS AND HEADS OF DEPARTMENTS OF SAID CITY, AND OF THE VARIOUS EMPLOYEES THEREOF; AND REPEALING RESOLUTION NO. 1$1$ OF SAID COUNCIL AND ALL RESOLUTIONS AMENDATORY OF SAID RESO- LUTION NO. 1818. WHEREAS, the salaries or compensation of the members of the City Council of the City of El Segundo, California, are fixed by the electors of said city at the sum of Fifty Dollars ($50.00) per month, each, and may not be changed except by the vote of the electors; and, WHEREAS, the salary of the City Clerk, as such, is fixed at Two Hundred Fifty Dollars ($250.00) per month, and the salary of the City Treasurer, as such, is fixed at the sum of Two Hundred Fifty Dollars ($250.00) per month under and pursuant to the provisions of Ordinance No. 404 of said City, and may not be changed except by ordinance adopted by the City Council and as pro- vided by law; and, WHEREAS, the City Council of the City of E1 Segundo, California, now desires to fix and determine the salaries or com- pensations of the various other officers, heads of departments, and of the various employees of said City, all as hereinafter set forth; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: PART I RATES AND SCHEDULES SECTION 1. FIXED SERIES: That subject to the other provisions of this resolution, each of the incumbents of the fol- lowing offices or positions in the service of the City of E1 Segundo shall be entitled to receive for his or her services, in his or her office or position, the rate or rates of compensation herein- after set forth: - 1 - 9346 (A) CITY ATTORNEY ------------ - - - - -- -$512 per month and in addition thereto, he shall receive such reasonable additional fees or com- pensation as the City Council may allow for suits, appearances or proceedings before any Court, Board, Officer or Com- mission in, or before which he has been directed to act or appear, and also when allowed by the Council, extra compensation for bond issues of all kinds and for any service which the Council may deem extra- ordinary. (B) CITY MANAGER ------------ - - - - -- $1,360 per month (C) CITY PROSECUTOR --------- - - - - -- $272 per month (D) DIRECTOR OF PUBLIC WORKS - - - - -- $1,088 per month (who is in such capacity, the City Engineer, Water Superintendent, Sewer Superintendent and Street Superintendent). SECTION 2. The first advancement of a new employee from Step A shall be made at the beginning of the pay period next ensuing after the completion of his first six months' service. All other advancements shall be at the beginning of the pay period next ensuing after the anni- versary date of the employee. This date once established shall remain unchanged; provided, however, in those instances where the Council advances an employee in Step, the employee auto- matically thereby shall be assigned the effective date of said order as his new anniversary date. If the Council advances an employee who is on Step E to a different step in another range, the employee automatically thereby shall be assigned the effective date of said order as his new anniversary date. (2) With respect to SCHEDULE NOS. 1 and 2, each employee of the City shall have the range number hereinafter designated for his classification and shall have the same step number in that classification that he last had in any classifi- cation prior to the adoption of this resolution. (B) It is provided further: (1) That the City Coun- cil reserves the right at any time, and in its sole discretion, to change the range number assigned to any officer or employee and to determine the particular step in any range number which is to be thereafter assigned to any such officer or employee; (2) Temporary employees for whom no classification or range number is provided or whose compensation is not other- wise fixed by this resolution shall receive such compensation as the City Council shall designate in the resolution or order of appointment for such respective temporary employees; and (3) Temporary employees and part -time employees who by reason of their limited employment schedule do not qualify for benefits under the State Employees Retirement Act shall not - 4 - 9329 receive paid sick leaves, paid vacations, and paid holidays; those who qualify for benefits under the State Employees Retire- ment Act shall receive the fringe benefits accorded all regular full time employees including vacation and sick leave on a pro rata basis, but excluding paid holidays. SECTION 3. The Chief of Police is authorized to conduct in his Department, drills, practices or tests in the use and firing of side- arms and small arms by the members of his department in order to in- crease the efficiency of the members of his department in the use of such firearms. Such practices, tests or drills shall be held at such times and at such places as said Chief shall designate and shall be participated in by such members of the department as the Chief may from to time authorize so to do. In addition to any compensation otherwise provided for any officer or member of said Police Department authorized to participate in any such drill, test or practice, there shall be paid a compensation in accordance with the following schedule to each such member of the depart- ment for his proficiency in the use and firing of such sidearms or small arms, and in the accuracy of such fire as indicated in the following schedule, to wit; Class Score Out of Compensation for Possible 300 Proficiency per month Marksman 200 to 239 $2.00 Sharp Shooter 240 to 279 4.00 Expert 280 to 289 8.00 Distinguished Expert 290 to 300 16.00 In addition to the above, each officer selected to serve on the pistol team, not to exceed seven l7) members of the department with the highest proficiency in firearms, shall receive an additional $5.00 per month during the time they serve on the team. Said additional compensation shall be payable only upon certification by the Chief of Police that the particu- lar officer or member has qualified during the quarter preceding the certi- fication in one of the classes (indi- cating same) of the foregoing schedule, and that such person is entitled to the additional compensation for such class as set forth in such schedule. 10. The Fire Chief, for causes which in his opinion are deemed adequate and sufficient, shall have the authority to excuse attendance at any drill, special assignment or actual alarm, and the particular excused attendance shall be credited as having been attended for the pur- poses of determining compensation hereunder. 18. Uniform Allowances: Following the effective date of this resolution, firefighting and police employees who are required to purchase and continuously maintain prescribed items of uniform clothing and personal equipment shall be compensated for a portion of the initial and maintenance costs thereof according to the following: (1) (a) All police officers, except officers assigned to motorcycle duty, and those firefighting personnel required to regularly wear dress uniform while on duty ------------ $6.00 per month (b) Police officers assigned to motorcycle duty --------------- 12.00 per month (2) All other firefighting personnel-- - ------------------ - - - - -- -3.00 per month (3) Newly appointed police officers and fire department personnel shall be provided with uniform allowances at the time of appoint- ment and thereafter as follows: (a) At the time of appointment - 150% of annual allowance (b) At first anniversary of appointment - 50% of annual allowance (c) After first anniversary - 100% of monthly allowance (D) PLANNING SERIES: Planning Commission Members $10.00 each per meeting attended, not to exceed three (3) meetings per calendar month. EMERGENCY APPOINTMENTS: That notwith- standing any other provision contained in this resolution, it is hereby provided that in case of any emergency or unusual circumstances or conditions, which may exist or arise within the city, or in any office or department thereof, the City Manager shall have the right and lie is hereby authorized, either directly or through the head of the office or department affected or in- volved, to employ such number of additional employees as in the opinion of such City Manager may be necessary in order to meet or properly dispose of any and all conditions and problems which may arise out of or be due to any such emergency; together with full power in any and all such cases to fix the respective reasonable compensations to be paid such additional employees, respectively, for such emergency service. Such emergency service W1030 9335 shall not continue, however, for a longer period than 7 suc- cessive days unless by further authority of the City Council expressed by resolution. SECTION 2. PREPARATION AND CONTENT OF CLASS SPECI- FICATIONS: Class specifications shall be prepared and main- tained under the direction of the City Manager for all positions. The specifications shall define the duties of the positions in each class and the desirable qualifications for successful per- formance of such duties. SECTION 3. RESIDENCE REQUIREMENTS. All police and fire department personnel herein classified as "policeman" and "fireman" must maintain a permanent residence within a 10 mile radius of the El Segundo Civic Center. All other personnel of said departments (excluding clerical) must maintain permanent residence within the incorporated limits of the city. SECTION 4. PAYMENT OF COMPENSATION: The monthly com- pensation above provided for shall be payable in two equal semi- monthly installments. (A) Compensation for services rendered during the payroll period from the lst to the 15th of the month (both dates inclusive) shall be paid on or before the 25th day of such month and compensation for services rendered during the payroll period from the 16th to the last day of any month (both days inclusive) shall be paid on or before the 10th day of the suc- ceeding month. (B) Call Men in the Fire Department shall be paid on a quarterly basis, subject to the right of the Council at any time during a quarter to authorize payment of any accrued fees up to such time of authorization. (C) Members of the Planning Commission, Recreation and Parks Commission, and employees of the Recreation Department serving on an hourly basis shall be paid monthly on the 10th of each month. - 11 - 9336 SECTION 5. WORKING SCHEDULES AND RULES AND REGULATIONS RELATING TO HOURS AND PERIODS OF SERVICE: That salaries, fees or pay, as same are hereinabove stated, and as same may hereafter be amended, contemplate service to be rendered by the various employees of said city substantially in accordance with the following rules and regulations relating to hours and periods of service which are hereby established, to wit: (A) Eight (8) hours shall be deemed to constitute a day's work, except in the Police and Fire Departments in which the members shall be subject to call at all times. (B) A week shall be deemed to mean any period of 7 consecutive days. (C) Unless the context otherwise indicates, Sun- days and legal holidays shall be construed as such. (D) The year shall be taken as having 365 days and the month as having 30 days. (E) Length of service, except as may be otherwise specially provided in this resolution, shall be computed upon the length of time an employee has been continuously in the ser- vice of the city in any capacity. An absence from duty for less than 90 consecutive calendar days shall not be considered as a break or interruption in the service of an employee; but an absence for a period of 90 or more consecutive calendar days shall constitute a break or interruption of service in the case of any employee, unless such absence shall have been approved by the City Council by action spread upon the minutes of such Council. (F). That all employees of said city (excepting those to whom these rules do not apply, as hereinabove or here- inafter set forth), shall render their respective services on a working schedule of 8 hours per day or 40 hours per week, and the head of the department under whose jurisdiction the respective employees serve, shall designate the particular days upon which such respective employees are to render service to the said city. -12- (G) Heads of departments having jurisdiction over the employees subject to rule "(F)" above are hereby granted the power and authority, subject to the approval of the City Manager, to require any such employee or employees to render service for more than 8 hours per day or 40 hours per week in any and all cases where such department head feels that such additional service is essential for the best interests of the city at the time. (H) OVERTI14E PAY: Any employee, subject to the rule of 8 hours per day and 40 hours per week who is required to put in more time on his classification on an occasion not an emergency resulting from war or civil defense (or protective effort), shall receive for any such overtime compensation at one and one -half (1 -1/2) times his regular rate of pay. (I) HOLIDAYS AND HOLIDAY PAY: Any employee who works on any of the following holidays, to wit: January lst February 12th February 22nd May 30th July 4th First Monday in September September 9th 9337'' October 12th November 11th Thanksgiving December 25th Every day on which an election is held through- out the State shall be compensated therefor at the rate of 2 times the rate of his regular pay; provided, however, in the event any of the hereinbefore mentioned holidays falls on the last day of his regular days off period, the following day shall be observed as a holiday for the purpose of this section; provided further, however, that in the event any of the hereinabove mentioned holidays falls on the first day of an employee's regular days off period, compensation shall be determined pursuant to the provisions of paragraph (H) of this section, and the provisions of this paragraph shall not apply. (J) TEMPORARY SERVICE IN HIGHER CLASSIFICATION: In any case, approved by the City Manager, where an employee is qualified for and is required for an appreciable period of - 13 - :33'& time to temporarily serve in and have the responsibility for work in a higher class of position, such employee while so assigned, shall receive the entrance salary rate of that class or one step above his present rate, whichever is higher. (K) PROMOTIONS: In all cases where an employee in any given classification is promoted to a classification for which a higher rate of compensation is provided, then such employee so promoted shall enter such higher classification at the lowest rate of compensation provided for such higher classification which exceeds the rate of compensation received by said employee in such given classification at the time of such promotion, unless otherwise ordered by the City Council. (L) TERMINATION: Upon termination of employment during a pay period, pay shall be prorated and paid for each day worked in said pay period and the terminal salary warrant shall include accrued vacation pay to the time of termination. (M) EXCEPTIONS: So far as the foregoing rules and regulations relative to hours of service in any day or hours of service in any week, the same shall not apply to: (1) (a) Elective officers of said city (b) City Manager (c) City Attorney (d) City Prosecutor (e) Chiefs of Police and Fire Departments (f) Deputy Chief of Police (g) Directors of Finance Department, Build- ing and Safety Department, Public Works Department and Recreation and Parks Department (h) Assistant Street Superintendent (i) Assistant Director of Public Works (j) Supervisors of Sanitation Service, Water Service, Parks, Recreation and Garage (2) The members of the Police Department of said city, who shall respectively work regularly scheduled shifts to be promulgated and established from time to time by the Chief of Police, as all of the members of said department shall be subject to call for service at any and all times. It is provided, however, that where a member of the Police Department is required - 14 - 9339 to render more than 8 hours service in any one day or more than 40 hours per week, such member shall be entitled to re- ceive, and there shall be paid to him, additional compensation for such overtime at one and one -half (1 -1/2) times his or her regular rate of pay, unless: (a) Such member is the Chief of Police or the Deputy Chief of Police of said City; or (b) Such member is a Captain of Police, and such overtime served is not a regular overtime shift established for such captain by the Chief of Police. (3) The members of the Fire Department of said city shall work on a 67.3$ hour per week schedule in shifts to be promulgated and established from time to time by the Chief of the Fire Department, and all of the members of said department shall be subject to call for service at any and all times. It is provided, however, that all members of the department off duty (with the exception of the Chief) in addition to the com- pensation hereinbefore fixed shall be entitled to additional compensation at the rate of "5.00 per call, regardless of time, for responding to fires and rescue calls, and pay at the rate of time and one half (1 -1 /2), based on 40 hours per week for special details and assignments other than fire and rescue calls. Members of the department required to work overtime on a regular fire fighting company assignment shall be paid his regular rate of compensation or be given compensatory time off. SECTION 6. DISABILITY OR SICKNESS: (A) That in addition to the salaries and benefits otherwise provided for in this resolution, each regular officer or employee of the city, as a part of his services rendered shall be entitled to receive, and there shall be paid to him during periods of physical disability by reason of illness or injury which necessitates absence from duty, amounts in accord- ance with the following schedule of disability payments, to wit: - 15 - 934© (1) In cases where such disability IS NOT compensable under the provisions of the Workmen's Compensation Laws of the State of California, each such employee shall be entitled to one (1) day's absence and pay for each month of actual service (inclusive of periods of bona fide disability absences) in the employment of said city, not to exceed a maxi- mum of 132 days. Each day of disability leave actually taken by any such employee shall be deducted from his accumulated credit. (2) In cases where such disability IS com- pensable under the provisions of the Workmen's Compensation Laws of the State of California, each such employee (other than those to whom the provisions of Section 4$50 of the Labor Code of the State of California apply and who receive benefit thereunder) shall be entitled to receive: (a) The employee's regular salary for the so- called waiting period provided for in said Workmen's Compensation Laws; and (b) An amount equal to the difference between the regular monthly salary of such em- ployee paid by said city and the amount of any compensation received by any such employee under said Workmen's Compensation Laws (exclusive of medical, surgical, hospitalization, appliances, or similar items of costs) until the amount paid the employee equals in dollars the aggregate amount of his accumulated sick leave, computed in the same manner and subject to the same changes, credits and limitations as hereinabove set forth in paragraph (1) of this section. (B) The Director of Finance in preparing demands for compensation under the provisions of this Section 6, may require the employee concerned to submit to said Director, evi- dente satisfactory to such Director showing the amount of Work- men's Compensation payments received by such employee (exclusive of medical, surgical, hospitalization, appliances, or similar items of costs). The City Council appreciates that in many instances it may be impossible at the time the regular payrolls are pre- sented to the Council for approval to determine various amounts - 16 - 1341;1 which may hereafter become payable under the provisions of this Section 6 to various employees due to a variety of reasons and causes, such for example, as delays which may occur in the fixing of compensation amounts in Industrial Accident cases; the failure of the employee to monthly or promptly receive his Workments Compensation allowances, etc. In all such cases, the city shall be under no obligation to make to the employee the payments provided for in this section until such time as such matters can be properly determined. The Director of Finance may present to the City Council any and all problems which may arise in the Administration of the provisions hereof, and the City Council reserves the right to consider such prob- lems and to determine the same and make such adjustments and orders as may be necessary and proper in the premises. (C) The Council reserves the right, to be exercised in its discretion, to at any time and from time to time, at the expense of said city, require any such employee to appear before any duly licensed physician or surgeon selected by the City Manager and submit to a medical and physical examination with respect to his illness, injury or disability. The failure or refusal of any such employee to submit himself to any such ex- amination, may, in the discretion of said Council, forfeit any further rights to receive disability benefits or compensation under the provisions of this resolution. The written report of any such physician or surgeon to said Council may be examined by said Council, the City Manager and City Attorney of said city, but shall other- wise be confidential; provided, however, that the same may be introduced in evidence in any action or proceeding relative to the subject of illness, injury or disability of the patient or person referred to therein, and such physician or surgeon may give testimony respecting the subject of such examination - 17 - 9342- and the physical condition of the employee therein referred to, and each employee of said city accepting employment, by accept- ing such employment and rendering service thereunder, does thereby automatically and accordingly so agree SECTION %. VACATIONS: (A) Excepting members of the Police and Fire Departments who shall receive annual vacations as provided by law, each officer and employee regularly em- ployed in the service of said city shall, subject to the limita- tions hereinafter set forth, be entitled to and shall receive a vacation of 10 working days with full salary for each year of service to said city. It is provided, however, that in the cases of employees who have served said city for 15 years or more, the annual vacation or leave of absence with pay for each year of service shall be increased so as to provide: (1) In the case of Police Department a total of fifteen (15) working days; (2) In the case of Fire Department a total of nine (9) twenty -four hour working periods; and (3) In the case of all other employees of the city a total of fifteen (15) working days. (B) "Year of Service" within the meaning of this section shall mean the period of one year from any given date during which the employee shall have been regularly employed. All vacations shall be taken at such times as are agreeable to the head of the department and approved by the City Manager. Earned vacations shall not be accumulated for a longer period than for two years' service. SECTION 8. ADVANCE14ENT AUTOMATIC UNLESS UNSATISFACTORY SERVICE REPORTED: (A) Advancement from one schedule step to another shall be automatic unless a specific entry of unsatisfactory service appears on the service record for the officer or em- ployee affected, for the service period immediately preceding his anniversary date. If such specific entry of unsatisfactory 3343. service during said period does occur, then and in that event no advancement in step shall be made, and such employee shall continue to remain on the service step occupied by him during the period to which such entry of unsatisfactory service re- lates, unless otherwise ordered by the City Council by specific resolution. (B) In the event a report of unsatisfactory service or of misconduct as hereinabove provided, an employee affected thereby may, upon the recommendation of his department head and upon the approval of the City Manager, be reassigned to a lower classification or step range, or may be suspended from active duty without pay for a specified period, during which time no fringe benefits or service time shall accrue. (C) In the event such entry of unsatisfactory service appears, the employee affected thereby upon written application therefor to the City Manager shall have the right to a review of said entry and to a hearing thereon by the City Manager. Upon such review and hearing, the City Manager's decision after such review and hearing shall be final and conclusive. Any request for review of any such entry must be filed with the City Manager within 15 days after the employee affected has received knowledge or notice of the fact that such entry has been made, otherwise the City Manager may refuse to consider the same. SECTION 9. REPEALS: Resolution 1818 passed and adopted on the 14th day of July, 1958, and all resolutions amending said Resolution No. 1$18, and all resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects here - inabove set forth or referred to, are hereby repealed insofar as the same conflict with the provisions hereof. SECTION 10. In all cases where any employee renders service in more than one department, and the City Council has not designated the amount or percentage of the compensation of - 19 - such employee to be charged against any particular department or departments, the Director of Finance may, for accounting purposes, determine and charge accordingly the amount of per- centage of the compensation or salary of any such employee which is to be charged to each of the respective departments in which such service was rendered. So far as reasonably practicable, such charges when made against the various departments shall be substantially in proportion to the service rendered such respective departments. SECTION 11. EFFECTIVE DATE: This resolution shall take effect and be in full force and virtue on and after the 1st day of August, 1959. SECTION 12. CERTIFICATION: The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted.
