CC RESOLUTION 1841923,5 RESOLUTION OF INTENTION NO. 1541 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTEN- TION TO ORDER THE CONSTRUCTION OF CERTAIN Ii,i- PROVEIVENTS IN PORTION OF KANSAS STREET AND FRANKLIN AVENUE IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES, AND FIXING THE TIME AND PLACE OF HEARING OBJECTIONS TO SAID WORK. The City Council of the City of E1 Segundo, pursuant to the provisions of the "Improvement Act of 191111, being Division 7 of the Streets and Highways Code of the State of California, DOES RESOLVE as follows: DESCRIPTION OF WORK SECTION 1. That the public interest and convenience re- quire, and it is the intention of the City Council of the City of El Segundo, California, to order the following work to be done, to wit: First: The grading, paving with asphaltic concrete, con- struction of cement concrete curbs and driveway aprons, vitrified clay pipe sanitary sewers, house connections, manholes, removal of certain curb, driveway and asphalt pavement and appurtenant work in connection therewith; in KANSAS STREET between the north line of El Segundo Boulevard and a line 250 feet northerly from and parallel with the center line of Franklin Ave- nue. Second: The grading, paving with asphaltic concrete, con- struction of cement concrete curbs and driveway aprons, vitrified clay pipe sanitary sewers, house connections, manholes and the removal of certain asphalt pavement and appurtenant work in con- nection therewith; in FRANKLIN AVENUE between Orelon Street and Illinois Street. - 1 - 9236 Third: The grading, pavins, with asphaltic concrete, construc- tion of cement concrete curbs and appurtenant work in connection therewith; in the Northerly 5 feet of EL SEGUNDO BOULEVARD between lines 30 feet Easterly and 30 feet Westerly from the pro- duced center line of Kansas Street; and in OREGON STREET between lines 30 feet Northerly and 40 feet Southerly from the produced center line of Franklin Avenue; and in CALIFORNIA STREET between the Northerly line of Franklin Avenue and a line 10 feet Northerly from and parallel therewith; and in ILLINOIS STREET and its intersection with Franklin Avenue, between the produced Northerly line of Franklin Avenue and a line 60 feet Southerly from and parallel with said Northerly line. PLANS, PROFILES, DRAWINGS, AND SPECIFICATIONS SECTION 2. That all of the said work and improvement to be done shall be constructed upon the grades, along the lines, be- tween the points, of the dimensions, at the places and in the manner shown on the plans, profiles and drawings for the construction of said improvement in a portion of Kansas Street and Franklin Avenue, being Plan and Profile No. 58 -10, Sheets 2 to 6, inclusive, and Standard Street Drawing No. 550000, all on file in the office of the City Engineer of said city and except as otherwise provided on said plans, in further accordance with Specifications No. 58 -100 being on file in the office of the City Clerk of said city and to which plans, profiles, drawings and specifications heretofore ap- proved by the City Council of said city reference is hereby made for a further, full and more particular description of said work and by reference thereto, the same are incorporated herein and made a part hereof. - 2 - 923 DESCRIPTION OF ASSESSMENT DISTRICT SECTION 3. That the said contemplated work and improve- ment, in the opinion of the said City Council, is of more than local or ordinary public benefit and the said City Council hereby makes the expenses of the said work and improvement chargeable upon a district, which said district the said City Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, and which district is described as follows: All that certain territory in the City of El Segundo, California, exclusive of streets and alleys, included within the exterior boundary line shown upon that certain map or plat, being Sheet 1 of Plan No. 5$ -10, heretofore approved by the City Council of said city on the 10th day of November, 1955, indicating by said boundary line the extent of the territory included within the pro- posed assessment district, and which map or plat is on file in the office of the City Engineer of said city. Reference is hereby made to said map or plat for a further, full and more particular de- scription of said assessment district, and the said map or plat so on file shall govern for all details as to the extent of the said assessment district. PROFILE GRADES SECTION 4. NOTICE IS HEREBY GIVEN that the finished grade of the improvement will be different from the existing grade of the streets as they now exist, and such different or new grade is that shown on the plans and profiles herein referred to. DESCRIPTION OF BONDS SECTION 5. That serial bonds, bearing, interest at the rate of six per cent (6 %) per annum, shall be issued to represent each assessment of Fifty Dollars (,�W-00) or more remaining unpaid for thirty (30) days after the date of recording the warrant. Said - 3 - 3238 serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October 15th following, their date. Payments on the principal of unpaid assess- ments and interest thereon shall be made by property owners to the City Treasurer, all as provided in the "Improvement Act of 191111, hereinafter referred to. PORTION OF COSTS AND EXPENSES TO BE PAID BY CITY SECTION 6. NOTICE IS HEREBY GIVEN that the City Council of the City of E1 Segundo has determined and declared that the city will pay out of its General Fund an estimated amount of '6,030.75 toward the costs and expenses of the removal and replace- ment of certain asphalt pavement, concrete curbs, driveways and appurtenances, and the construction of certain vitrified clay pipe sewer, the exact amount of said contribution to be determined upon receipt of bids setting forth the unit prices for such removal and construction. The liability and obligation to pay such sum as provided herein shall accrue and become fixed upon the date of vhe confirmation of the assessment by the City Council of said city. TI1,1E A14D PLACE OF HEARING SECTION 7. NOTICE IS HEREBY GIVEN that on the 8th day of December, 1958, at the hour of seven o'clock (7:00) P. Id., in the chambers of the City Council in the City Hall of said city, any and all persons having any objections to the proposed work or improvement, or in the extent of the assessment district, or to the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with this Resolution of Inten- tion. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. IDIPROVEIrENT ACT SECTION 8. That all of the work herein proposed shall be done and carried through in pursuance of an act of the legislature - 4 - �.3 ij 9 of the State of California, designated the "Improvement Act of 191111, being Division 7 of the Streets and Highways Code of the State of California. PUBLICATION OF RESOLUTION OF INTENTION SECTION o. That Lhe "El Segundo Herald ", a weekly news- paper published and of general circulation in the City of E1 Se- gundo, California, is hereby designated as the newspaper in which tais Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law, and for making all other publications in the proceedings under this Resolution of Intention. The City Clerk is directed to mail notices of the adop- tion of this Resolution of Intention to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessmen t roll for city taxes, all in the manner and form provided for under Section 5070, 5194 and 5195 of the said "Improvement Act of 1911" of said Streets and f:i -hways Code. POSTING OF NOTICE OF IT,iPROVEYELIT SECTION 10. That the Superintende_it of Streets of the City of El Segundo shall cause to be conspicuously posted alon,, the line of said contemplated work, or improvement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention in the time, form and manner provided by said Code. ESTIMATED COSTS AND EXPENSES SECTION 11. That the estimated costs and expenses of said improvement, inclusive of incidental expenses of the proceed- ings under this Resolution of Intention, is the sum of lw42,103.37. SECTION 12. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of said city, and shall make a minute of -5- 9240 the passa, ,-e and adoption thereof in the records of the proceed- in-s of the City Council of said city in the minutes of the meet- in,- at which the same is passed and adopted.
