RESOLUTION NO. 1783
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, CONCURRINGr IN THE
FINDINGS AND DETERMINATIONS OF THE CITY PLAN-
NING COMMISSION OF SAID CITY AS SET FORTH IN
ITS RESOLUTION NO. 343; DENYING THE APPEAL OF
ROBERT L. SOBRASKE IN SAID MATTER; AND ACCORD-
INGLY DENYING THE ZONE CHANGE APPLIED FOR.
WHEREAS, an application for a zone change for Lots 35
and 36 of Block 59, El Segundo Tract, from Zone R -2 to Zone P was
heretofore filed by Robert L. Sobraske with the Planning Commis-
sion of the City of El Segundo, California, and said application
was thereupon and thereafter duly, regularly and lawfully processed
and heard by said Planning Commission; and
WHEREAS, after such processing and hearing said Commis-
sion did duly and regularly, at a meeting of said Commission held
on December 4, 1957, adopt the following resolution, to wit:
"RESOLUTION NO. 343
"A RESOLUTION OF THE CITY PLANNING COMMIS-
SION OF THE CITY OF EL SEGUNDO, CALIFORNIA,
DENYING CHANGE OF ZONE REQUEST OF MR. ROBERT
SOBRASKE FOR CHANGE OF ZONE FROM R -2 TO P
FOR LOTS 35 AND 36, BLOCK 59, EL SEGUNDO
"WHEREAS, application was made on October 2$, 1957, by
Mr. Robert Sobraske, for a change of zone from R -2 to P for
Lots 35 and 36, Block 59, E1 Segundo; and
"WHEREAS, the City Planning Commission did on November
27, 1957, hold a duly advertised public hearing on such mat-
ter in the Council Chamber of the City Hall of the City of
E1 Segundo as prescribed by law; and
"WHEREAS, as a result of said hearing, from the testi-
mony, evidence presented, and subsequent investigation, the
Planning Commission finds as follows:
"1. That both sides of Standard Street, between Holly
Avenue and Mariposa Avenue, are zoned R -2; and
"2. That the uses presently established in such blocks
are conforming R -2 uses or of a more restrictive use; and

"3. That the proposed reclassification of subject lots
would be tantamount to establishing a tspot zone' in an other-
wise conforming block; and
"4. That the proposed zone change would establish a
precedent of imposing a semi - commercial use in a residential
zone; and
115. That an overwhelming majority of property owners
in subject block vigorously opposed the proposed change of
zone; and
"6. That the applicant has failed to prove that the
proposed encroachment in a residential zone is a public nec-
essity; and
"7. That the applicant failed to prove that no damage
would result to existing residential property values if pro-
posed development were permitted; and
"8. That the rights and investiments of the residen-
tial property owners take precedence over the proposed en-
croachment of heavier land use by the applicant who has no
developed investment in the block in question, and that they
are entitled to the protection of the zoning ordinance in the
case in question.
"NOW THEREFORE BE IT RESOLVED, that in view of the
above facts and circumstances, the Commission recommends that
the application in question be denied; and
"FINALLY RESOLVED, that a copy of this resolution be
forwarded to the City Council for its action as required by
law.
"Passed, approved and adopted this 4th day of December,
1957.

and
WHEREAS, thereafter and within the time permitted under
the provisions of Ordinance No. 507 of said City, an appeal in
writing from the decision of said Planning Commission was duly and
regularly filed by Mr. Sobraske with the City Council of said City;
and
WHEREAS, said City Council did thereafter duly, regular-
ly and lawfully process and hear the matter of said application,
the action of said Planning Commission in denying the application

for zone change, and the said appeal; and
WHEREAS, said City Council has now reached its decision
in the said matter;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SE-
GUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That said Council does hereby (1) make the

same findings and determinations with reference to the application
of said applicant as were made by the City Planning Commission
and as set forth in its Resolution No. 343, hereinabove set forth
in the preamble of this resolution; (2) sustain the findings,
determinations and action of said Planning Commission with refer-
ence to said application; and (3) in view of the foregoing recitals,
findings and determinations, deny the said application of said
applicant and deny the said appeal of said applicant.
SECTION 2. That the City Clerk is hereby authorized and
instructed to forward a copy of this resolution to the City Plan-
ning Commission and a like copy to the applicant for their files
and information in the premises.
SECTION 3. That the City Clerk shall certify to the
passage and adoption of this resolution; shall enter the same in
the book of original resolutions of said City; and shall make a
minute of the passage and adoption thereof in the records of the
proceedings of the City Council of said City, in the minutes of
the meeting at which the same is passed and adopted.
Passed, approved and adopted this 13th day of January,
1958.
