CC RESOLUTION 1733RESOLUTION NO. 1731 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AUTHORIZING COMPROMISE AND SETTLEMENT OF ACTION FOR CONDEMNATION OF LOTS 51 AND 52, BLOCK 123, EL SEGUNDO SHEET NO. 8. WHFIREA.S, the City of E1 Segundo on August 27, 1956, found that the public interest and necessity required the acquisition for storm drain purposes of Lots 51 and 52, Block 1231 E1 Segundo Sheet No. 8, and authorized Auten. F. Bush, City Attorney, and Robt. E. Rosskopf, Special Counsel, to prepare and prosecute an action for condemnation of said real property; and WHEREAS, action for condemnation No. Ingl. C 1501, was filed in the Superior Court of the State of California, in and for the County of Los Angeles by said attorneys; and WHEREAS, issue has been joined in said action and the same has been set for jury trial in said court on July 30, 1957; and WHEREAS, negotiations for settlement have been conducted with the owners of said properties as a result of which offers of compromise have been received whereby ALLAN E. TOMBLIN as owner of said Lot 51, has offered to convey said property to the City of El Segundo for the sum of $19,000.00; and ALLAN E. TOMBLIN and PHYLLIS I. JONES, as owners of said Lot 52, have offered to convey said property to the City of El Segundo for the sum of $12,000.00; as evidenced by letters from said defendants dated June 19, 1957, and addressed to Robt. E. Rosskopf; and WHEREAS, the expenses of further litigation and employment of appraisers will be saved and the title to said real property will be immediately acquired by accepting said compromise; and WHEREAS, the City Engineer, the City Attorney and said Special Counsel have recommended the acceptance of said offers of compromise, NOW, THEREFORE, TIE CITY COUNCIL OF THE CITY OF EL 3EGUNDO, CALIFORNIA, DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: SECTION 1. That it is to the best interests of the City of E1 Segundo that that certain action No. Ingl. C 1501 now pending in the Superior Court of the State of California, in and for the County of Los Angeles, entitled "City of El Segundo, a municipal corporation, Plaintiff, vs. Allan E. Tomblin, et al., Defendants," be compromised by accepting the offer of Allan E. Tomblin to convey to the City of El Segundo said Lot 51, Block 123, E1 Segundo Sheet No. 8 on payment of the sum of $19,000.00; and the offer of Allan E. Tomblin and Phyllis I. Jones to convey to the City of E1. Segundo, Lot 52, Block 123, El Segundo Sheet No. 8, upon payment of the sum of $12,000.00. SECTION 2. That said offers be and the same are hereby accepted. SECTION 3. That warrants issue and be charged to the general fund of the City of E1 Segundo, to the following persons in the following amounts: To Allan E. Tomblin in the sum of $19,000.00; and To Allan E. Tomblin and Phyllis I. Jones in the SLIM of $12,000.00. That deeds from said respective parties to said real properties be accepted on behalf of the City of El Segundo. SECTION 4. That said warrants and said deeds, with resolutions of acceptance attached, be forwarded to Robt. E. Rosskopf, Special Counsel for the City, who is hereby author- ized and instructed to forward said deeds with a Dismissal of said action to the Title Insurance and Trust Company with authority to use the same when and only when, it can issue its policies of Title Insurance with liability of $19,000.00 as to said Lot 51, and X12,000.00 as to said Lot 52, guaran- teeing title to said properties to be vested in the City of E1 Segundo, California, free and clear of all encumbrances except 1957 -1958 taxes, a lien not yet payable, and easements, covenants, conditions and restrictions of record. SECTION 5. Upon the issuance of said policies of title insurance as aforesaid, said Robt. E. Rosskopf is authorized to deliver said warrants to the payees named. therein. SECTION 6. Upon completion of said settlement as aforesaid and issuance of said policies of title insurance said Robt. E. Rosskopf is instructed to take the necessary steps to secure the return to the City of El Segundo of the funds heretofore deposited with the Clerk of the Superior Court as security for taking immediate possession of said properties. SECTION 7. The City Clerk is directed to forward to said Robt. E. Rosskopf a certified copy of this resolution, together with said original deeds with resolutions of accep- tance attached, and said warrants.
