CC RESOLUTION 1729r ". RESOLUTION NO. 1729 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ESTABLISHING CER- TAIN RULES AND REGULATIONS WITH REFERENCE TO THE SERVICE OF WATER FROM THE MUNICIPAL 'NATER- WORKS SYSTEM OF SAID CITY; FIXING A SCHEDULE OF RATES TO BE CHARGED IN CONNECTION WITH SUCH SERVICE; AND REPEALING RESOLUTION IO. 1007, AS AMENDED, AND ALL OTHER RESOLUTIONS AND PARTS OF RESOLUTIONS IN CONFLICT THEREWITH. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That on and after the 1st day of September, 1957, and until the further order of the City Council of said City, the rules, regulations and rates hereinafter set forth in this resolution, shall be, and the same are hereby fixed, adopted and established, as the rules, regulations and rates for and governing the service of water from the waterworks system of the said City of El Segundo; and such service shall be rendered subject to each and all of said rules, regulations and rates, and in conformity there- with. SECTION 2. INSTALLATION OF SERVICE (METER INSTALLATIO)_d COST): (:) Application for Service: Before service is delivered a written application therefor on a blank furnished by the Water De- partment of the City of El Segundo must be signed by the person desiring such service, giving in addition to such information as the said department may require, his status as owner, agent or tenant. (B) Deposits: Deposits are required as a condition of ser- vice in the amounts and under the conditions set forth hereunder: - 1 - P31 ti (1) Where service is to be delivered to other than a bona fide owner of the property, a cash deposit must be made to cover the Department's estimate of the average bill for two months'service to the subject property, and in no case shall such deposit be less than five dollars ($5.00). Said deposit will be refunded at the time such service is discontinued and all bills for water furnished such service are paid. (2) Each application for a new service installation (as differentiated from an order to turn on an existing service connection) shall be accompanied by a cash deposit of five dollars ($5.00). Said deposit shall be held by the Department for a period of six (o) months from the date such new service is installed and turned on. At the end of this fifteen months' period said deposit shall be credited to the account of the subject service to apply on subsequent billings until depleted. In the event that service is dis- continued prior to the time that such credit is consumed, the balance of the deposit on hand in the Department will be refunded after all bills for water furnished such service are paid. (C) Temporary Service: Connection for temporary use will be made upon a deposit equal to the department's estimate of the total cost of labor, materials and overhead necessary to make the instal- lation. This amount shall remain on deposit with the mater Depart- ment until the termination of such use, during which time regular rates will be charged for water used, when the deposit will be re- turned to the depositor, less 10% per year depreciation on material and labor, etc., cost. (D) Relocation of Service: Services will be relocated at the request of the owner of the premises being served at such time as said owner pays to the Water Department a sum equal to the Depart- ment's estimate of the cost of moving such service. - 2 - SECTION 3. METER INSTALLATION COSTS: All meters instal- led shall be and remain the property of the City of El Segundo and the installation costs and charges shall be based upon cost of me- ter, materials, labor, including excavation and repavinz;, plus 10�;o of said cost for administration and incidentals, and the total of such cost must be borne and paid by applicant. The meter will be supplied and installed by the City of E1 Segundo Water Department at such time as the applicant pays said Department an amount equal to the estimated cost of said installation as determined by the Water Superintendent. After the installation is completed, the Water Superintendent shall compute the total actual installation charges and costs and shall add to this sum 10� for cost of administration and incidentals. If the total actual installation char,ves and costs plus 101% is less than the deposit, the balance shall be refunded to the depositor. If the total actual installation charges and costs plus 10% is in excess of the deposit, this excess shall be billed to the depositor and shall be paid by him on the next billing for water service rendered. SECTION 5. SECTION 6. The rates and charges for water service from the municipal waterworks system of the City of El Segundo shall be, and the same are hereby fixed and established as follows: (A) GENERAL RATES: (1) For meters billed each month, the monthly minimum charges for water involving the following meter sizes are hereby fixed and established, to wit: a) 5/$" x 3/4" Meter - First 500 cubic feet $1.75 b) 1" Meter - First 500 cubic feet 2.15 c) 1 -1/2" Meter - First 500 cubic feet 2.40 d) 2" Meter - First 500 cubic feet 2.75 e) 3" Meter - First 500 cubic feet 4.00 f) 4" Meter - First 500 cubic feet 5.50 g) 6" Meter - First 500 cubic feet 7.80 h) 8" Meter - First 500 cubic feet 10.50 i) 10" Meter - First 500 cubic feet 13.20 j) 12" Meter - First 500 cubic feet 16.00 k) 14" Meter - First 500 cubic feet 18.60 1) 16" Meter - First 500 cubic feet 21.30 m) For water used in excess of first 500 cubic feet per month: First 3500 cubic feet @ X0.12 per 100 cubic feet or major fraction thereof; Next 16,000 cubic feet @ '$0.11 per 100 cubic feet or major fraction thereof; Next 50,000 cubic feet @ ;0.10 per 100 cubic feet or major fraction thereof; Next 60,000 cubic feet @ $0.08 per 100 cubic feet or major fraction thereof; and All water used in excess of 130,000 cubic feet @ $0.072 per 100 cubic feet or major fraction thereof. (2) For meters billed each two months, the bi- monthly minimum charges for water involving the following meter sizes are hereby fixed and established, to wit: (a) 5/$" x 3/4" Meter - First 1000 cubic feet 0.50 - 4 - b) 1" Meter - First 1000 cubic feet ,4.30 c) 1 -1 %2 Meter -First 1000 cubic feet 4.80 d) 2" Meter - First 1000 cubic feet 5.50 e) 3" Meter - First 1000 cubic feet 8.00 f) 4" Meter - First 1000 cubic feet 11.00 g) 6" Meter - First 1000 cubic feet 15.60 h) 81, Meter - First 1000 cubic feet 21.00 i) 10" Meter - First 1000 cubic feet 26.40 j) 12" Meter - First 1000 cubic feet 32.00 k) 1411 Meter - First 1000 cubic feet 37.20 1) 1611 Meter - First 1000 cubic feet 42.60 m) For water used in excess of first 1000 cubic feet per two months: First 7000 cubic feet @ 40.12 per 100 cubic feet or major fraction thereof; Next 32,000 cubic feet ` 40.11 per 100 cubic feet or major fraction thereof; Next 100,000 cubic feet (Z-D ;;0.10 per 100 cubic feet or major fraction thereof; Next 120,000 cubic feet �:,_b ;0.08 per 100 cubic feet or major :fraction thereof; and All water used in excess of 260,000 cubic feet O .w0.072 per 100 cubic feet or major fraction thereof. (B) CONSTRUCTION RATES: (1) All water used on construction jobs, other than pipe line trenching, will be metered and the cost will be the same as that set forth under "(A) GENERAL RATES" above, ex- cept that a returnable deposit of $100.00 for each meter must be made upon application for same, which deposit shall secure the payment to said city of any damage suffered and of charges for water served and which has not otherwise been paid. (2) The rates for flooding pipe line trenches are hereby fixed and established as follows: (a) For first 100 lineal feet or less of pipe trench less than six feet in depth 1p2.00 plus 1 -1/2¢ per lineal foot over 100. (b) For first; 100 lineal feet or less of pipe trench six feet or more in depth 1;'4.00 Plus 3¢ per lineal foot over 100. (C) AUTOMATIC FIRE SPRINKLERS, FIRE HYDRANTS, AND SEWER MAN- HOLE FLUSH TANKS rates shall be and the same are hereby established as follows: (1) Automatic Sprinkler System - 2" - - - - -- -2.75 per month; - 5 - f,. Automatic Sprinkler System - 3" ­­$4.00 per month; Automatic Sprinkler System - 4 -- - - - -- 5.50 per month; Automatic Sprinkler System - 511 - - -- -10.00 per month; Automatic Sprinkler System - $'- = ---- 15.00 per month; Automatic Sprinkler System - 1011 - -- -20.00 per month; Automatic Sprinkler System - 1211 - -- -25.00 per month; The monthly rates herein specified are to be applied to each such automatic sprinkler system. '2) City owned Fire Hydrants, each - - -- -32.00 per month. SECTION 7. All services on any premises, whether used or not, shall be considered as used and shall be charged for se long as the same remain connected. SECTION 8. DELINQUENCIES: Bills become delinquent fif- teen days after presentation, and if not paid the water may be shut off without further notice. SECTION 9. No allowance or rebate shall be made in water rates charged against any property or premises so long as the water remains connected therewith, and full rates shall be charged against any and all property or premises as hereinbefore specified until the Water Department has been notified in writing to shut off or disconnect the water therefrom. Any complaint in regard to the rating of property must be made at the office of the Water Depart- ment and the Adjustor will properly rate the premises. Collectors shall not make rebates or adjust rates. SECTION 10. All water rates shall be charged against the property on which it is furnished and against the owner thereof, and if for any cause any sums owing therefor become delinquent, the water shall be cut off, and in no case shall it be turned on to the same property until all such delinquencies shall have been paid in full. No change in ownership or occupancy shall affect the appli- cation of this section. SECTION 11. Any damage to meters or appurtenances re- sulting from carelessness, wilfulness or neglect, or any of them, as well as any damage which may result from hot water or steam from boiler, or otherwise, shall be paid for to said Water Depart- ment on presentation of bill and in case such bill is not paid, - 6 - the water may be shut off from said premises without further no- tice and not turned on until all charges are paid. SECTION 12. On failure to comply with the rules and regulations established as a condition to the use of water, or to pay rates or meter rent, or any charge or penalty imposed, in the time and manner as herein provided, the water may be shut off until payment of the amount due is made, with one dollar ($1.00) in addition for expense of turning water off and on. SECTION 13. Should the owner or occupant of any prem- ises turn on the water or cause it to be turned on, or cause the disconnected premises to be connected either directly or indirectly with the municipal waterworks system or water supply, after it has been shut off at the curb cock, it shall be shut off at the main, and a charge of !10.00 will be made by the said City for the turn- ing off and turning on, which must be paid before the premises will be again connected to the municipal system. It is further provided that if any owner, occupant or tenant of any premises connected to the municipal waterworks system, either directly or indirectly connects or permits the connection of such premises, or water ser- vice, with that of any owner, tenant, occupant or consumer, of any other premises whose water has been turned off by the Water Depart- ment, that then and in that event the service through which such disconnected premises is served may likewise be turned off on 24 hours notice to the owner, occupant, tenant or consumer of such premises or service, and same shall not be again connected unless and until a penalty of X10.00 shall have been paid to said City. SECTION 14. That all services applied for, or installed, on and after the effective date of this resolution, and until the further order of the City Council (excepting only such services as the Water Superintendent of said City shall class as emer -ency or temporary services, and to which a flat rate to be determined by him shall apply) shall be metered; provided, however, that nothin - 7 - c3 1 . herein contained shall be construed as requiring more than one metered service to a hotel or apartment house where the halls and reception rooms are used in common by all families occupying the same; nor as requiring more than one metered service to any store or office building for services to the respective stores or offices actually contained in and made a part of such store or office building; nor as requiring the immediate discontinuance of exist- ing services where single family units are served through a single present connection, but whenever in the future any such existing services are discontinued, or abandoned, or changed, or the owner- ship of the property is divided, no new connection will be made unless same be metered as hereinabove required for services applied for or installed on and after said effective date of this resolution. SECTION 15. That notwithstanding any action heretofore taken by said Council to the contrary, metered rates as herein pro- vided for shall apply and be collected from all metered services on the Municipal Waterworks System of said City, beginning on and after the effective date of this resolution. SECTION 16. This resolution and the rules and regulations and rates therein contained and established thereby shall repeal and supersede Resolution No. 1007 and amendments thereof, and all other resolutions, rules, regulations and rates upon the same sub- ject or subjects, heretofore adopted. This resolution and the rules, regulations and rates herein contained and set forth shall be in full force and effect and shall control on and after the said effective date of this resolution. SECTION 17• That this resolution shall take effect and be in full force and virtue on and after the 1st day of September, 1957• SECTION 18. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the same to - 8 - s� be entered in the Book. of Resolutions of said City and shall make a minute of the passa -e and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
