CC RESOLUTION 16561 CV RESOLUTION NO. 1656 A RESOLUTION OF THE CITY COUIICIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ACCEPTING TIME PROPOSAL OF OSWALD BROS. CO. FOR FURNISHING THE ASPHALTIC CONCRETE REQUIREv,ENTS TO SAID CITY FOR A PERIOD OF ONE YEAR, BEGINNING AS OF AUGUST 15, 1956. WHEREAS, the City N'anager has heretofore requested quotations on the asphaltic concrete requirements for the City of El Segundo for a period of one year, beginning as of August 15, 1956; and WHEREAS, said City Manager has recommended that the proposal of Oswald Bros. Co. be accepted; and ;WHEREAS, the City Council concurs in the recommenda- tion of said City Manager and has reached its decision in the said matter; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS: SECTION 1. That the quotation of OS'WALD BROS. CO which said Council determines to be substantially as follows, to wit: "ITEM: 2. Approx. 3,900 Tons Asphaltic Concrete as State Brand per Section 21, Standard Specifications California Divi- sion Highways, August 1954. . 4.45 per ton at bidder's plant loaded in City Truck. Plus Sales Tax. 0.45 per ton delivered to any point in City of El Segundo and dumped into spreader box. BIDDER: OSWALD BROS. CO. BY: /s/ N. T. Oswald ADDRESS: 366 East 58th St. Los Angeles, Calif. TEL. NO. AD 26151 "Date Aug. 10th, 1956", (Part two under Item 2 should read 44.90 per ton delivered to any point in City of E1 Segundo and dumped into spreader box. Plus Sales Tax.) - 1 - be and the same is hereby accepted at the prices therefor set forth in said proposal, which is now on file in the office of the City Clerk of said City, and which said proposal so on file is hereby expressly referred to and by this reference incorpora- ted herein and made a part hereof for all further particulars. SECTION 2. The Contractor, insofar as said Contrac- tor is legally required so to do, must observe and abide by the provisions of all laws of the State of California and of the United States of America relating to contracts of the nature contemplated herein, whether herein specifically mentioned or not. SECTION 3. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerk's Certificate, forms for the approval of the Contractor and on the part of the said City; and such copies of this resolution, so approved and accepted by the contractor and by and on behalf of said City, shall constitute the contract for furnishing to said City its asphaltic concrete requirements for a period of one year, beginning as of the 15th day of August, 1956, pursuant to the award hereinabove made; and the Mayor of the City of E1 Segundo is hereby authorized on behalf of said City to affix the approval and acceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the seal of said City thereto. SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of oriinal resolutions of said City; any, shall ;hake a minute of the passa,,e and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted. - 2 - Passed, approved and adopted this 11th day of September, 1956.
