CC RESOLUTION 1642RESOLUTION NO. 1642 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA DECLARING THE PUBLIC NECESSITY AND AUTH6RIZING THE CON- DEMNATION FOR PUBLIC STREET PURPOSES CER- TAIN PORTIONS OF LOTS 154, 1559 AND 179, BLOCK 123, EL SEGUNDO TRACT, FOR IMPROVE- MENTS OF CALIFORNIA STREET. WHEREAS, the City of El Segundo has unsuccessfully ne- gotiated for the acquisition of easements for street purposes over and across the real property hereinafter described; and WHEREAS, many of such easements have been obtained from the owners of property with the exception of the parcels hereinafter particularly described and it is necessary that said easements be obtained without delay so that the work on said easements may proceed; and WHEREAS, an action in condemnation appears necessary for the acquisition thereof; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SE- GUNDO, CALIFORNIA, DOES HEREBY RESOLVE AND DETERMINE, AS FOLLOWS: SECTION 1. That the public interest and necessity re- quire the acquisition of easements for public street purposes over and across the real property in the City of E1 Segundo, County of Los Angeles, State of California, described as follows, to wit: The East 25.00 feet of Lots 154 and 155, and the West 25.00 feet of Lot 179, of Block 123, E1 Se- gundo Sheet No. $, as per map recorded in Book 22, Pages 106 and 107 of Maps, on file in the office of the County Recorder of said County and State. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury. SECTION 2. That the City of El Segundo is hereby au- thorized and empowered to acquire by condemnation, in the name of - 1 - the City of E1 Segundo to be used for public street purposes, ease- ments to the said properties in accordance with the provisions of the Code of Civil Procedure and of the Constitution of California relating to eminent domain. SECTION 3. That Auten F. Bush, City Attorney, and Robert E. Rosskopf, Special Counsel, are hereby authorized to prepare and prosecute in the name of the City of E1 Segundo, such proceeding or proceedings in the proper court having jurisdiction thereof, as are necessary for such acquisition; and in connection there - and with to incur on behalf of said City any/all reasonable expenses and charges, including the procuring of title reports and apprai- sals as may be convenient or required in said matter; and to pre- pare and file such pleadings, documents, briefs and other instru- ments, and to make such arguments and generally take such action as may be necessary in the opinion of said attorneys to acquire for said City the easements to said real properties. SECTION 4. Upon adoption of this resolution the City Clerk is instructed to certify a copy thereof and forward it to Robert E. Rosskopf, Esq., 224 North Canon Drive, Beverly Hills, California.
