CC RESOLUTION 1641RESOLUTION NO. 1641 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING AND IN THE FINDINGS, DETERMINATION, INTERPRETATION AND ACTION OF THE CITY PLAN- NING COMMISSION OF SAID CITY AS SET FORTH IN RESOLUTION NO. 272 OF SAID COMMISSION, CLARI- FYING AMBIGUITY CONCERNING RESIDENCES EASTERLY OF LOMITA STREET IN AN "M" ZONE. WHEREAS, the City Planning Commission of the City of El Segundo, California, did at the adjourned regular meeting of said Commission held on the 18th day of July, 1956, adopt the follow- ing resolution, to wit: "RESOLUTION NO. 272 "A RESOLUTION OF INTERPRETATION OF THE CITY OF EL SEGUNDO, CALIFORNIA, CLARI- FYING AMBIGUITY CONCERNING RESIDENCES EASTERLY OF LOMITA IN AN tMt ZONE. "WHEREAS, Section 1402 of Ordinance No. 434 (Zoning) provides that if ambiguity arises concerning the use of property or other provisions of the ordinance, the Commis- sion may, by Resolution of Interpretation, clarify such ambiguity, and "WHEREAS, a situation has been called to the at- tention of the Planning Commission wherein the strict in- terpretation of the provisions of Ordinance No. 434 prohib- its the moving of a nonconforming building in an 'Mt Zone, and "WHEREAS, Ordinance No. 434 declares that in the M -1 Zone, in the area easterly of Lomita Street in the City of E1 Segundo, no residences are permitted, and "WHEREAS, Section 1601 of Article 16 of Ordinance No. 434 sets forth that where a nonconforming building exists, such building may be continued to be used, pro- vided no additions or enlargements or structural altera- tions are made therein and thereto, and "WHEREAS, there are instances in areas now zoned tCt or tMt where established residences exist, which resi- dences were established prior to the zoning of the City, and - 1 - ti ri� "WHEREAS, because of the encroachment of the fast growing industrial development in such areas some residen- tial buildings are being used as accessory to such in- dustrial development and to existing agricultuual uses in such zones, and "WHEREAS, such residences used as accessory build- ings to house tools, etc. must be moved because of changes in boundary lines of property by reason of sale or lease, and 'WHEREAS, because such residential buildings are de- clared by Ordinance No. 434 to be nonconforming buildings in 'M' Zones and, as such, may not be moved, enlarged or structurally altered, and "WHEREAS, to require demolition of such building, or buildings, and the erection of a new building in another location on the same site to serve the same purpose would appear to be unreasonable, "NOW, THEREFORE BE IT RESOLVED, that the Planning Commission finds as follows: 111. That where an existing residence in a 'C' or 'M' Zone is being used as an accessory building in connection with commercial, industrial or agricultural uses on the same site and such building is necessary to carry on the uses legally permitted on the property on which such building is located the provisions of Ordinance No. 434 prohibiting structural alterations or moving shall not apply to such buildings, provided -- "(a) no enlargements are made in such build- ing and only those structural alterations shall be made as are necessary to the moving of such building, and "(b) the costs incurred in such moving and necessary alterations shall not be considered as adding to the capital investment in such building as a basis for ex- tending the time of any application of abatement proceedings on a nonconforming use, if enforced, and "FINALLY RESOLVED, that a copy of this resolution of interpretation be forwarded to the City Council for its in- formation and, if concurred in by the City Council, that all officers of the City having the responsibility for adminis- tering the provisions of the Zoning Ordinance be instructed to so carry out the purpose and intent of this interpreta- tion. 1956.
