CC RESOLUTION 1616RESOLUTION OF INTENTION NO. 1616. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTEN- TION TO ORDER THE CONSTRUCTION OF CERTAIN IM- PROVEMENTS IN MAPLE AVENUE AND OTHER STREETS IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DE- SCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES, AND FIXING THE TIME AND PLACE OF HEARING OBJECTIONS TO SAID WORK. The City Council of the City of E1 Segundo, pursuant to the provisions of the "Improvement Act of 1911", being Diaision 7 of the Streets and Highways Code of the State of California, DOES RESOLVE as follows: DESCRIPTION OF WORK SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of E1 Segundo, California, to order the following work to be done, to wit: First; The grading, paving with 3 inch asphaltic concrete, re- surfacing existing pavement with 1 -1/2 inch asphaltic concrete, construction of cement concrete curbs, sidewalks and driveways, removal of certain curbs, sidewalks and fences, and appurtenant work in connection therewith; in MAPLE AVENUE between Center Street, and Sepulveda Boulevard, as shown on Sheets 3 to 5, inclusive, of the plans hereinafter referred to. Second: The grading, paving with 3 inch asphaltic concrete, re- surfacing existing pavement with 1 -1/2 inch asphaltic concrete, construction of cement concrete curbs and sidewalks, removal of certain curb and sidewalk and appurtenant work in connection therewith; in the easterly 13 feet of CENTER STREET between lines 33 feet northerly and 33 feet southerly from the produced center line of Maple Avenue, as shown on Sheet 3 of said plans. - 1 - 4lx: Third: The re- surfacing of existing pavement with 1 -1/2 inch asphaltic concrete, construction of cement concrete curbs and sidewalks, removal of certain curbs and sidewalks and appurtenant work in connection therewith; in CALIFORNIA STREET between lines 33 feet northerly and 33 feet southerly from the center line of Maple Avenue, as shown on Sheets 3 and 4 of said plans; and in WASHINGTON STREET between lines 33 feet northerly and $3 feet southerly from the center line of Maple Avenue, as shown on Sheets 4 and 5 of said plans. Fourth: The grading, paving with 3 inch asphaltic concrete, re- surfacing existing pavement with 1 -1/2 inch asphaltic concrete, and appurtenant work in connection therewith; in INDIANA COURT between the southerly line of Maple Avenue and a line 8 feet southerly from and parallel therewith, as shown on Sheet 5 of said plans. Fifth: The grading, paving with 3 inch asphaltic concrete, construction of cement concrete curbs and sidewalks, relocate existing fire hydrant, remove certain curb and appurtenant work in connection therewith; in the westerly 13 feet of SEPULVEDA BOULEVARD between lines 38 feet northerly and 38 feet southerly from the produced center line of Maple Avenue, as shown on Sheet 5 of said plans. PLANS, PROFILES, DRAWINGS, AND SPECIFICATIONS SECTION 2. That all of the said work and improvement to be done shall be constructed upon the grades, along the lines, between the points, of the dimensions, at the places and in the - 2 - z . manner shown on the plans, profiles and drawings for the construc- tion of said improvements in Maple Avenue and other streets, being Plan and Profile No. 560327, Sheets 3 to 5, inclusive, and Stand- ard Street Drawing No. 550000, all on file in the office of the City Engineer of said city and except as otherwise provided on said plans, in further accordance with Specifications No. 560327, being on file in the office of the City Clerk of said city and to which plans, profiles, drawings and specifications heretofore ap- proved by the City Council of said city reference is hereby made for a further, full and more particular description of said work and by reference thereto, the same are incorporated herein and made a part hereof. PROFILE GRADES SECTION 3. NOTICE IS HEREBY GIVEN that the work of grading said streets in many instances will bring the finished grade to a different one which now exists in portions of said streets, and such difference in new grade is shown on the profiles attached to the plans and to which reference is hereby made for the finished grade of the improvement of said streets. DESCRIPTION OF ASSESSMENT DISTRICT SECTION 4. That the said contemplated work and improve- ment, in the opinion of the said City Council, is of more than local or ordinary public benefit and the said City Council hereby makes the expenses of the said work and improvement chargeable upon a district, which said district the said City Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, and which district is described as follows: All that certain territory in the City of El Segundo, California, exclusive of streets and alleys, included within the exterior boundary line shown upon that certain map or plat, being Sheets 1 and 2 of Plan No. 560327, heretofore approved by the City Council of said city on the 14th day of May, 1956, indicating - 3 - by said boundary line the extent of the territory included within the proposed assessment district, and which map or plat is on file in the office of the City Engineer of said city. Reference is hereby made to said map or plat for a further, full and more particular description of said assessment district, and the said map or plat so on file shall govern for all details as to the ex- tent of the said assessment district. DESCRIPTION OF BONDS SECTION 5. That serial bonds, bearin-, interest at the rate of six per cent (6 %) per annum, shall be issued to represent each assessment of Twenty -fire dollars ($25.00) or more remaining unpaid for thirty (30) days after the date of recording the war- rant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October 15th following their date. Payments on the principal of unpaid assessments and interest thereon shall be made by property owners to the City Treasurer, all as provided in the "Improvement Act of 191111, hereinafter referred to. PORTION OF COSTS AND EXPENSES TO BE PAID BY CITY SECTION 6. NOTICE IS HEREBY GIVEN that the City Coun- cil of the City of E1 Segundo has determined and declared that the city will pay out of its General Fund the sum of $1,349.60 toward the costs and expenses of the removal and replacement of certain existing improvements. The liability and obligation to pay such sum as provided herein shall accrue and become fixed upon the date of the confirmation of the assessment, by the City Council of said city. TIME AND PLACE OF HEARING SECTION 7. NOTICE IS HEREBY GIVEN that on the 25th day of June, 1956, at the hour of seven otclock (7;00) P. M., in the chambers of the City Council in the City Hall of said city, any - 4 - and all persons having any objections to the proposed work or im- provement, or to the extent of the assessment district, or to the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with this Resolution of Intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. IMPROVEMENT ACT SECTION &. That all of the work herein proposed shall be done and carried through in pursuance of an act of the legis- lature of the State of California, designated the "Improvement Act of 1911 ", being Division 7 of the Streets and Highways Code of the State of California. PUBLICATION OF RESOLUTION OF INTENTION SECTION 9. That the "E1 Segundo Herald ", a weekly news- paper published and of general circulation in the City of E1 Se- gundo, California, is hereby designated as the newspaper in which this Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law, and for making all other publications in the proceedings under this Resolution of Inten- tion. The City Clerk is directed to mail notices of the adoption of this Resolution of Intention to all persons owning real proper- ty proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for city taxes, all in the man- ner and form provided for under Sections 5070, 5194 and 5195 of the said "Improvement Act of 1911" of said Streets and Highways Code. POSTING OF NOTICE OF IMPROVEMENT SECTION 10. That the Superintendent of Streets of the City of E1 Segundo shall cause to be conspicuously posted along the line of said contemplated work or improvement and along all - 5 - open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention in the time, form and manner provided by said Code. ESTIMATED COSTS AND EXPENSES SECTION 11. That the estimated costs and expenses of said improvement, inclusive of incidental expenses of the proceed- ings under this Resolution of Intention, in the sum of $35.962.19. SECTION 12. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of said city, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted.
