CC RESOLUTION 1597N1,11 RESOLUTION OF INTENTION NO. 1597 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION OF CERTAIN IMPROVEMENTS IN OAK AVENUE BETWEEN BAYONNE STREET AND VIRGINIA STREET IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES, AND FIXING THE TIME AND PLACE OF HEARING OBJECTIONS TO SAID WORK. The City Council of the City of El Segundo, pursuant to the provisions of the "Improvement Act of 1911 ", being Di- vision 7 of the Streets and Highways Code of the State of Cali- fornia, DOES RESOLVE as follows: DESCRIPTION OF WORK SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of E1 Segundo, California, to order the following work to be done, to wit: First: The grading and paving with asphaltic concrete, construction of cement concrete sidewalks, cribs and driveway approaches or aprons, remove and replace certain concrete side- walk and driveways, reconstruct sewer manholes to grade, and ap- purtenant work in connection therewith; in OAK AVENUE between Bayonne Street and Virginia Street, as shown on Sheet 2 of the plans hereinafter referred to. Second: The grading and paving with asphaltic concrete, remove and replace certain sidewalks and curbs, and appurtenant work in connection therewith; in the Easterly 11 feet of BAYONNE STREET between lines 32 feet Northerly and 32 feet Southerly from the produced center line of Oak Avenue; and in the Westerly 11 feet of - 1 - VIRGINIA STREET between lines 42 feet Northerly and 32 feet Southerly from the produced center line of Oak Avenue, as shown on Sheet 2 of said plans. PLANS, PROFILES, DRAWINGS, AND SPECIFICATIONS SECTION 2. That all of the said work and improvement to be done shall be constructed upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, profiles and drawings for the con- struction of said improvements in Oak Avenue between Bayonne Street and Virginia Street, being Plan and Profile No. 550415, Sheet 2, and Standard Street Drawing No. 550000, all on file in the office of the City Engineer of said city and except as other- wise provided on said plans, in further accordance with Specifi- cations No. 550415, being on file in the office of the City Clerk of said city and to which plans, profiles, drawings and specifi- cations heretofore approved by the City Council of said city reference is hereby made for a further, full and more particular description of said work and by reference thereto, the same are incorporated herein and made a part hereof. DESCRIPTION OF ASSESSMENT DISTRICT SECTION 3. That the said contemplated work and improve- ment, in the opinion of the said City Council, is of more than local or ordinary public benefit and the said City Council hereby makes the expenses of the said work and improvement chargeable upon a district, which said district the said City Council hereby declares to be the district benefited by said work and improve- ment and to be assessed to pay the costs and expenses thereof, and which district is described as follows: All that certain territory in the City of E1 Segundo, California, exclusive of streets and alleys, included within the - 2 - 3313 exterior boundary line shown upon that certain map or plat, being Sheet 1 of Plan No. 550415, heretofore approved by the City Coun- cil of said city on the 9th day of April, 1956, indicating by said boundary line the extent of the territory included within the proposed assessment district, and which map or plat is on file in the office of the City Engineer of said city. Reference is hereby made to said map or plat for a further, full and more par- ticular description of said assessment district, and the said map or plat so on file shall govern for all details as to the extent of the said assessment district. DESCRIPTION OF BONDS SECTION 4. That serial bonds, bearing interest at the rate of six per cent (6 %) per annum, shall be issued to represent each assessment of Twenty -five dollars ($25.00) or more remaining unapid for thirty (30) days after the date of recording the war- rant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October 15th following their date. Payments on the principal of unpaid assessments and interest thereon shall be made by property owners to the City Treasurer, all as provided in the "Improvement Act of 1911", hereinafter referred to. PORTION OF COSTS AND EXPENSES TO BE PAID BY CITY SECTION 5. NOTICE IS HEREBY GIVEN that the City Coun- cil of the City of E1 Segundo has determined and declared that the City will pay out of its General Fund the sum of $531.12 toward the costs and expenses of the removal and replacement of certain curb and sidewalk. The liability and obligation to pay such sum as provided herein shall accrue and become fixed upon the date of the confirmation of the assessment by the City Coun- cil of said city. - 3 - -; in TIME AND PLACE OF HEARING SECTION 6. NOTICE IS HEREBY GIVEN that on the 14th day of May, 1956, at the hour of seven otclock (7:00) P. M., in the chambers of the City Council in the City Hall of said city, any and all persons having any objections to the proposed work or improvement, or to the extent of the assessment district, or to the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with this Reso- lution of Intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. IMPROVEMENT ACT SECTION 7. That all of the work herein proposed shall be done and carried through in pursuance of an act of the legis- lature of the State of California, designated the "Improvement Act of 19110, being Division 7 of the Streets and Highways Code of the State of California. PUBLICATION OF RESOLUTION OF INTENTION SECTION 8. That the "E1 Segundo Herald ", a weekly news- paper published and of general circulation in the City of El Se- gundo, California, is hereby designated as the newspaper in which this Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law, and for making all other publications in the proceedings under this Resolution of Intention. The City Clerk is directed to mail notices of the adop- tion of this Resolution of Intention to all persons owning real property proposed to be assessed, whose names and addresses ap- pear on the last equalized assessment roll for city taxes, all in the manner and form provided for under Sections 5070, 5194 and 5195 of the said "Improvement Act of 1911" of said Streets and Highways Code. POSTING OF NOTICE OF IMPROVEMENT - 4 - SECTION 9. That the Superintendent of Streets of the City of E1 Segundo shall cause to be conspicuously posted along the line of said contemplated work or improvement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention in the time, form and manner provided by said Code. ESTIMATED COSTS AND EXPENSES SECTION 10. That the estimated costs and expenses of said improvement, inclusive of incidental expenses of the pro- ceedings under this Resolution of Intention, is the sum of #$,531.76. SECTION 11. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of said city, and shall make a minute of the passage and adoption thereof in the records of the proceed- ings of the City Council of said city in the minutes of the meet- ing at which the same is passed and adopted.
