A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, APPROVING AND CON-
CURRING IN THE FINDINGS, DETERMINATION, IN-
TERPRETATION AND ACTION OF THE CITY PLANNING
COMMISSION OF SAID CITY AS SET FORTH IN RE-
SOLUTION NO. 252 OF SAID COMMISSION, CLARIFY-
ING SETBACKS WITH REFERENCE TO CHURCHES, ETC.
WHEREAS, the City Planning Commission of the City of
E1 Segundo, California, did at the regular meeting of said Com-
mission held on the 28th day of March, 1956, adopt the follow-
ing resolution of said Commission, to wit:
"RESOLUTION NO. 252
"A RESOLUTION OF INTENTION OF THE CITY PLAN-
NING COMMISSION OF THE CITY OF EL SEGUNDO,
CALIFORNIA, TO CLARIFY SETBACKS IN REFERENCE
TO CHURCHES, ETC., SO FAR AS STREETS ARE CON-
CERNED.
"WHEREAS, Section 1520 of Ordinance No. 434 provides
that *In all 'Rt Zones no building shall be erected, struc-
turally altered or used for aschool, church, institution
or other similar use permitted under the use regulations
of this ordinance unless such buildings are removed at
least fifteen (15) feet from every boundary line of prop-
erty included in any tRt Zone', and
"WHEREAS, where a boundary line also represents the
street lines for corner lots, the strict application of
Section 1520 imposes a restriction that in no sense serves
the intended purpose of said Section 1520, and
"WHEREAS, Section 1402 of Ordinance No. 434 provides
for interpreting any element of ambiguity in the provisions
of Ordinance No. 434, and
"WHEREAS, the known and obvious purpose of Section
1520 is to assure that schools, churches and other permit-
ted institutions involving the congregating of large num-
bers of persons shall not encroach unreasonably upon ad-
joining residences, and
"WHEREAS, in the case of corner lots, those lot lines
that also constitute the street lines have no abutting
residential property but, on the contrary, the distance be-
tween the street sides of such corner lots and the closest
property that may be classified for tRt purposes is repre-
sented by the full dedicated width of the street, and

"WHEREAS, to require the retention of the 15 -foot
distance from the structure to the property line on the
side street sides would in no sense serve the basic pur-
pose of Section 1520 but, rather, would to some degree
represent a discriminatory application of an otherwise
proper restriction, and
"WHEREAS, the Planning Commission finds that in other
jurisdictions where this question has arisen subsequent
to the enactment of Ordinance No. 434 by the City of E1
Segundo, the zoning ordinances, insofar as they deal with
this subject matter, consistently stipulate that require-
ments similar to those set forth in Section 1520 of Ordi-
nance No. 434, when they relate to those lot boundaries
which side upon a dedicated street, are set aside and for
the reasons above noted,
"NOW THEREFORE BE IT RESOLVED, that in order to fully
carry out the purposes of Section 1520 of Ordinance No.
434 while, at the same time, conforming to recognized
principles of regulation, it be the conclusion of the Plan-
ning Commission that if and when the question arises it
shall be the policy of the City to recognize the circum-
stances above noted and that the yard requirements as
they pertain to the front and side street side of a corner
lot shall be such as is required for residential develop-
ment in the particular tRt Zone in which the property is
located, and
"FINALLY RESOLVED, that these findings and recommen-
dations be forwarded to the City Council and, if the City
Council concurs, that thereafter this interpretation shall
be conformed to by all administrative departments of the
City.

NOW, THEREFORE, the City Council of the City of E1 Se-
gundo, California, does hereby resolve, declare, find, determine
and order as follows:
SECTION 1. That the City Council, as contemplated
under the provisions of Section 1402 of Article 14 of Ordinance
No. 434 (The Comprehensive Zoning Ordinance) of said City, does
hereby concur in, approve and confirm the findings, determinations,

interpretations and action of the City Planning Commission of the
City of E1 Segundo as hereinabove quoted and set forth in Resolu-
tion No. 252 of the said Commission.
SECTION 2. That all executive and administrative of-
ficials of the City of E1 Segundo whose official responsibility
in any manner involves the administration of Ordinance No. 434
(The Comprehensive Zoning Ordinance) of said City, as same now
exists or may hereafter be amended, be directed henceforth to
conform to the said findings and interpretations.
SECTION 3. That this resolution shall take effect im-
mediately.
SECTION 4. That the City Clerk shall certify to the
passage and adoption of this resolution; shall enter the same in
the book of original resolutions of said City; shall make a min-
ute of the passage and adoption thereof in the records of the
proceedings of the City Council of the said City, in the minutes
of the meeting at which the same is passed and adopted; and shall
forward a copy to the Planning Commission and to each of the de-
partment heads concerned, for their information and files in the
premises.
Passed, approved and adopted this 9th day of April,
1956.
