CC RESOLUTION 1579RESOLUTION NO. 1579 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING A CERTAIN CONTRACT TO AMERICAN CAST IRON PIPE COMPANY FOR FURNISHING AND DELIVERING TO SAID CITY CERTAIN CAST IRON PIPE. WHEREAS, the City Council of the City of El Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bidders en- titled "NOTICE INVITING BIDS ON CAST IRON PIPE FOR THE CITY OF EL SEGUNDO ", dated December 22, 1955, which is now on file in the office of the City Clerk, open to public inspection, and hereby referred to and by this .reference incorporated herein and made a part hereof, for furnishing and delivering certain cast iron pipe to said City; and WHEREAS, at the time fixed for opening and considering said bids, to wit: the hour of 7:00 o'clock P. M., on Wednesday, the 25th day of January, 1956, said Council did publicly open, examine and declare all bids received; and did refer the same to the City Engineer for tabulation and to report back to said Coun- cil later in said meeting; and WHEREAS, said City Engineer has reported and recommends that the bid of American Cast Iron Pipe Company, the low bidder, be accepted; and WHEREAS, said Council concurs in the recommendation of said City En, -ineer and has reached its decision in the said matter; NOW, THEREFORE, THE CITY COUNCIL OF TIIE CITY OF EL SEGUN- DO, CALIFORNIA, DOES RESOLVE, DECLARE, DETERIvINE AND ORDER AS FOL- LOWS: SECTION 1. You will note we have listed prices on the basis of being, exclusive of California State Use Tax of 3% as well as including; this particu- lar tax, the latter where the 6alifornia State Use Tax of 3� is included applies to foundry value. Terms are net 30 days. - 2 - "Based on the above unit prices exclusive of California State Use Tax of 3% the total for the pipe would amount to 442,906.60, and for the fittings :1,335.36. Including California State Use Tax of 3% the total for the pipe would amount to 443,863.70, and for the fittings $1,370.60. "Our Mono -Cast pipe, on which we have quoted, would conform strictly to your specifications, and be in accordance with Fed- eral Specification WW- P -421a, and would have our tEnamelinet lining. Fittings would be in accordance with American Standards Association Specification A21.10 to which you also refer. "As required, we are attaching bid bond in the amount of ',k5,000.00. "If favored with your order, we could commence delivery within approximately 40 days and complete within approximately 60 days after receipt of order, sooner if possible, but subject to delays beyond our control. Brown ttCRB :f Att. it and which said bid was submitted in response to and under the terms, conditions, provisions and requirements set forth in said "NOTICE INVITING BIDS ON CAST IRON PIPE FOR THE CITY OF EL SEGUN- DO ", be, and the same is, hereby accepted on the basis of delivery as set forth in the above quoted bid and at the prices set forth in said bid, which is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this reference incorporated herein and made a part hereof for all further particulars. SECTION' 2. The Contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this contract is made, that only American -made materials, and, so far as reasonably pos- sible, Californ.ia -made materials will be used in the work or im- provement contemplated under this contract, all in conformity with the provisions of Sections 4300 to 4305, both inclusive, and Sec- tions 4330 to 43340 both inclusive, of the Government Code of the State of California. - 3 - SECTION 3. The Contractor, insofar as said Contractor is legally required so to do, must observe and abide by the provi- sions of all laws of the State of California and of the United States of America relating to contracts of the nature contemplated herein, whether herein specifically mentioned or not. SECTION 4. That all bids received for said cast iron pipe are hereby rejected with the exception of the bid of AMERICAN CAST IRONTT PIPE COMPANY, hereinabove referred to, and the City Clerk is hereby authorized and instructed to return the checks of all unsuccessful bidders. SECTION 5. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerk's Cer- tificate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this resolution, so approved and accepted by the successful bidder and by and on be- half of said City, shall constitute the contract for furnishing and delivering to said City certain cast iron pipe, pursuant to the award hereinabove made; and the Mayor of the City of El Se- gundo is hereby authorized on behalf of said City to affix the approval and acceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the seal of said City thereto. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of El Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City - 4 - o� ' m_ Council of said City, in the minutes of the meeting; at which the same is passed and adopted.
