RESOLUTION NO. 1577
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORI,iIA, AWARDING
TO BURROUGHS CORPORATION A CERTAIN CON-
TRACT OR ORDER FOR FURNISHING SAID CITY
ONE ACCOUNTING MACHINE FOR USE OF SAID
CITY.
WHEREAS, the City Council of the City of El Segundo,
California, has heretofore in the manner provided by law, duly
and regularly advertised for bids under a notice to bidders, en-
titled "NOTICE INVITING BIDS ON CERTAIN ACCOUNTING EQUIPMENT AND
CASH REGISTER FOR THE CITY OF EL SEGUNDO. ", dated November 22,
1955, which is now on file in the office of the City Clerk, open
to public inspection, and hereby referred to and by this refer-
ence incorporated herein and made a part hereof, for furnishing
certain accounting equipment and cash register to said City; and
WHEREAS, at the time fixed for opening and considerins;
said bids, to wit: the hour of 7:00 o'clock P. I., on Wednesday,
the 11th day of January, 1956, said Council did publicly open,
examine and declare all bids received; and
WHEREAS, at said hour said Council did take all of said
bids on the accounting machine (Item No. 1 under said notice in-
viting bids) under advisement and consideration until January
25, 1956; and
WHEREAS, said last mentioned date has now arrived and
the City administrative Officer has reported that the Committee
appointed to check said bids and the equipment recommend that the
contract for the accounting machine be awarded to Burroughs Cor-
poration, the low bidder; and
WHEREAS, said Council approves the recommendation of
said Administrative Office and committee and has reached its de-
cision in the said matter;

d0'1d, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SE-
GUNDO, CALIFORNIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:
SECTION 1. That the bid of BURROUGHS CORPORATION, of
1649 Wilshire Boulevard, Los Angeles 17, California, which said
Council determines to be substantially as follows, to wit:

"Bidders Terms and Conditions
1. The prices quoted are firm prices for a period of
thirty days after which the prices are subject to
change to prices in effect at the time a firm order
is placed. (February 13, 1956)
2. Terms: Net within thirty days from date of invoice.
(Billed after delivery)
3. Delivery will require approximately 30 to 45 days
after receipt by the bidder of an acceptable order.
4. During the installation period, the bidder will super-
vise and instruct the purchaser's employees who are
to operate the machines so as to familiarize them with
the operation and with the routine in connection with
the use of the machines.
5. The bidder will make at any time within one year frorg
the delivery of the equipment specified 'herein, free
of charge during ordinary business hours, all needed
repairs thereto not necessitated by accident or abuse,
or by damage arisinm from acts of third persons or any
force of nature, provided that no repairs, alterations
or additions have been made to such equipment except
by the bidder or its authorized representatives.
"The bidder will save and keep you harmless from all
legal liability which may be established against you
on behalf of any person or persons or corporations
whomsoever for, or growing out of, any infringement
of letters patent of the United States in respect of
the normal use of said equipment.
"The bidder shall not be liable for any loss, damage,
detention or delay caused by fires, strikes, civil or
military authority, or by insurrection or riot, or from
any other cause which is unavoidable or beyond its rea-
sonable control, nor in any event for consequential
damage.
"Certified check for $500.00 is enclosed.
"We shall be glad to serve you and hope that we may be favored
with your order.

and which said bid was submitted in response to and under the
terms, conditions, provisions and requirements set forth in said
"NOTICE INVITING BIDS ON CERTAIN ACCOUNTING EQUIPMENT AND CASH
REGISTER FOR THE CITY OF EL SEGUNDO.", be and the same is hereby
accepted for an accounting machine as set forth in "Item No. 1"
of said notice inviting bids, at the total price of $4,129.79;
and the contract or purchase order for said equipment is hereby
awarded to said Burroughs Corporation. In the event that immedi-
ate delivery of said equipment can be made, a purchase order may
be issued therefor, and in such case it will not be necessary to
execute and deliver a formal contract. Said bid is now on file
in the office of the City Clerk of said City, and said bid so on
file is hereby expressly referred to and by this reference incor-
porated herein and made a part hereof for all further particulars.
SECTION 2. That the City Clerk shall certify to the pass-
age and adoption of this resolution; shall cause the original of
the same to be entered in the book of resolutions of the said
City of El Segundo, and shall make a minute of the passage and
adoption thereof in the records of the proceedings of the City

Council of said City, in the minutes of the meeting at which the
same is passed and adopted.
Passed, approved and adopted this 25th day of January,
1955.
