A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, AWARDING
TO TORRANCE DESK & OFFICE EQUIPMENT CO. A
CONTRACT FOR FURNISHING SAID CITY WITH ALL
OF ITS METAL OFFICE FURNITURE REQUIREIMENTS
FOR ONE YEAR COMiENCING OCTOBER 15, 1955,
AND THEREAFTER, SUBJECT TO CANCELLATION.
WHEREAS, the City Council of the City of El Segundo,
California, has heretofore in the manner provided by law, duly and
regularly advertised for bids under notice to bidders, entitled
"NOTICE INVITING BIDS ON PURCHASE OF FURNITURE A.ND ON SALE OF
FURNITURE ", dated the 27th day of July, 1955, which is now on file
in the office of the City Clerk, open to public inspection, and
hereby referred to and by this reference incorporated herein and
made a part hereof, for the furnishin- to said City for one year
commencing October 15, 1955, and thereafter, subject to cancella-
tion, all of its new wood and /or metal furniture requirements dur-
ing said period; and
WHEREAS, at the time for openin; and considering all of
said bids, to wit: the hour of 7 :00 o'clock P. M. on 'Wednesday,
the 14th day of September, 1955, said Council did publicly open,
examine and declare all bids received; and
WHEREAS, at said hour said Council did take all of said
bids under consideration until the regular meeting of said Ccuncil
to be held. October 13, 1955, and referred the same to Finance Com-
missioner Gordon, City Administrative Officer Udall and City Account-
ant Wanderer for tabulation and report and recommendations; and
—t'EREAS, said last mentioned date has now arrived and
the Administrative Officer has reported to this Council with refer-
ence to all bids submitted; and

WHEREAS, the Administrative Officer and members of the
committee heretofore appointed have carefully inspected and com-
pared the various items of equipment submitted by the respective
bidders as to price, quality, fitness and suitability for, and
adaptability to, the City's needs and requirements, the po'r,ential-
ities of fuyt ure servicing features and other factors affecting the
requirements and best interests of said City with reference to the
procuring, placement and use of the equipment to be furnished; and
WHEREAS, after due consideration of all of such factors,
the City Council bel-LeTes that the equipmen, of the successful bid-
der, hereinafter named, will best meet the metal office furniture
needs and requirements of said City;
NOW, THEREFORE, THE CITY COU14CIL OF THE CITY OF EL SE-
GUNDO, CALIFORNIA, DOES RESOLVE, DECLARE AND DETERfINE AS FOLL09S:
SECTION 1. That the facts recited in theFreamble of this
resolution are true.
SECTION 2. That in view of the proceedings had and the
facts as hereinabove found and determined, said City Council does
hereby further specially declare and determine that the metal of-
fice furniture offered under the bid of TORRAdCE DESK & OFFICE,
EQUIP -ENT CO., of 20$1 Torrance Boulevard, Torrance, California,
dated September 14, 1955, which said Council determines to be sub-
stantially as follows, to wit:

"Bid is hereby made by this company on furniture for the
City of El Segundo, Calif. Enclosed. herewith are brochures
on various lines upon, which we wish to bid, and included
is a price list on each line. Below is shown the discount
percentages which this company will ;rant to the City of
El Segundo from list prices included herein:

'TThis bid and above discounts are offered on basis of con-
sumers price lists as published by the manufacturers pre -
vailinh at the time of order by the City of E1 Segundo,
and not necessarily those prices presently applying on
price lists included herein. These prices do not include
California State Sales Tax or Use Tax.

be and the same is hereby accepted at the terms set forth in said
bid and for the period of one year commencin.- October 15, 1955,
and thereafter, subject to cancellation, and under the terms and
conditions as set forth in said "NOTICE INVITING BIDS CN PUHCHASE
OF FURNITURE AND OP', SALE OF FURNITURE", dated July.27, 1955. Said
bid ro on file is hereby expressly referred to and by this refer-
ence incorporated herein and made a part hereof.
SECTION 4. The contractor agrees, responsive to the
preference of the City Council of said City as expressed in the
notice to bidders, pursuant to which this contract is made, that
only American -made materials and, wherever possible, California -
made materials will be used in the work or improvement contemplated
under this contract, all in conformity with the provisions of Sec -
ticns 4300 to 4305, both inclusive, and Sections 4330 to 4334,
both inclusive, of the Government Code of the State of California.
SECTION 5. That all bids received for metal office fur-
niture, with the exception of the said bid of TORRANCE DESK & OF-
FICE EQUIP__MENT CO., be and the same are hereby rejected; and the
City Clerk is hereby authorized and instructed to return the checks
of all unsuccessful bidders.

SECTION 6. The contractor, insofar as said contractor
is le -ally required so to do, must observe and abide by the pro-
visions of all laws of the State of California and of the United
States of America relating to contracts of the nature contemplated
herein, whether herein specifically mentioned or not.
SECTION %. That the City Clerk shall prepare copies of
this -resolution after the passage and adoption thereof, and shall
affix to such copies at the end thereof, after the Clerk's cer-
tificate, forms for the approval of the successful bidder and on
the part of the said City; and such copies of this resolution, so
approved and accepted by the successful bidder and by and on be-
half of said Cit-r, shall constitute the contract for the furnishin=
to said City all of its metal office furniture requirements for and
during the period of one year commencing October 15, 1955, and
thereafter until either party shall 'nave given the other thirty
(30) days' written notice of cancellation of contract for furnish -
inI said furniture, pursuantto the award hereinabove made; and the
Mayor of the City of El Segundo is hereby authorized, on behalf of
said City, to affix the approval and acceptance of said City to
such contract, and said City Clerk is hereby authorized and instructed
to attest the same on behalf of said City and to affix the official
seal of said City thereto.
SECTION 8. That the City Clerk shall certify to the
passage and adoption of this resolution; shall cause the original
of the same to be entered in the book of resolut ions of the said
City of El Segundo, and shall make a minute of the passa ;e and
adoption thereof in the records of the proceedings of the City
Council of said City, in the minutes of the meeting; at which the
same is passed and adopted.
Passed, approved and adopted this 13th day of October,
1955.
