CC RESOLUTION 1549RESOLUTION NO. 1549 A RESOLUTION OF THE CITY COU=NCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO BARKER BROS. CORPORATION A CONTRACT FOR FURNISHING SAID CITY WITH ALL OF ITS LOBBY AND LOUNGE FURNITURE AND ALL OF ITS WOOD AND LEATHER FURNITURE REQUIREMENTS FOR ONE YEAR COIvUVIENCING OCTOBER 15, 1955, AND THEREAFTER, SUBJECT TO CANCELLA'iION. WHEREAS, the City Council of the City of EJ_ Se undo, California, has heretofore in the manner provided by law, duly and remularly advertised for bids under notice to bidders, entitles. "NOTICE INVITING BIDS ON PURCHASE OF FURNITURE AND ON SALE OF FURNITURE ", dated the 27th day of July, 1955, which is now on file in the office of the City Clerk, open to public inspection, and hereby referred to and by this reference incorporated herein and made a part hereof, for the furnishing to said City for one year commencing October 15, 1955, and thereafter, subject to can- cellation, all of its new wood and /or metal furniture requirements durinr, said period; and WHEREAS, at the time for opening and considering all of said bids, to wit: the hour of 7 :00 o'clock P. M. on Wednesday, the 14th day of September, 1955, said Council did publicly open, examine and declare all bids received; and WHEREAS, at said hour said Council did take all of said bids under consideration until the re,,ular meeting of said Ccu:-icil to be held October 13, 1955, and referred the same to Fina *ice Com- missioner Gordon, City Administrative Officer Udall and City Ac- countant Wanderer for tabulation and report and recommendations; and - 1 - P� �i_4.tnl WHEREAS, said last mentioned date has now arrived and the Administrative Officer has reported to this Council with reference to all bids submitted; and WHEREAS, the Administrative Officer and members of the committee heretofore appointed have carefully inspected and com- pared the various items of equipment submitted by the respective bidders as to prce, quality, fitness and suitability for, and adaptability to, City's needs and requirements, the potential- ities of future servicing; features and other factors affecting the requirements and best interests of said City with reference to the procuring, placement and use of the equipment to be fur- nished; and WHEREAS, after due consideration of all of such factors, the City Council believes that the equipment of the successful bidder, hereinafter named, will best meet the lobby and lounge and wood and leather furniture needs and requirements of said City; NOW, THEREFORE, THE CITY COUNCIL OF TTE CITY OF EL SE- CUNDO, CALIFORNFIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS; SECTION 1. That the facts recited in the preamble of this resolution are true. SECTION 2. That in view of the proceedings had and the facts as hereinabove found and determined, said City Council does hereby further specially declare and determine that the lobby and lounge and wood and leather furniture offered under the bid of BARKER BROS. CORPORATIOINT will best meet and serve the requirements of the City of El Segundo, all factors considered, and does, there- fore, make the award for such equipment as hereinafter set forth. SECTION 3. That the bid of BARKER BROS. CORPORATION, of 733 South Flower Street, Los Angeles 17, California, dated Sep- tember 12, 1955, which said Council determines to be substantially as follows, to wit: - 2 - ij_'r i, x "PARKER BROS. Fleck, Manager Office Furniture Division ", be and the same is hereby accepted at the terms set forth in said bid and for the period of one year commencing October 15, 1955, and thereafter, subject to cancellation, and under the terms and conditions as set forth in said "NOTICE INVITING BIDS ON PURCHASE OF FURNITURE AND ON SALE OF FURNITURE ", dated July 27, 1955. Said bid so on file is hereby expressly referred to and by this refer- ence incorporated 'herein and made a part hereof. SECTION 4. The contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice to bidders, pursuant to whicr this contract is made, that only American -made materials and, wherever possible, California - made materials will be used in the work or improvement contem- plated under this contract, all in conformity with the provisions of Sections 4300 to 4305, both inclusive, and Sections 4330 to 4334, both inclusive, o_P the Government Code cf the State of Cali- fornia. - 3 - SECTION 5. That all bids received for lobby and lounl,e furniture and for wood and leather furniture, with the exception of the said bid of BARKER BROS. CORPORATION, be and the sa,e are hereby rejected; and the City Clerk is hereby authorized and in- structed to return the checks of all unsuccessful bidders. SECTIOu 6. The contractor, insofar as said contractor is legally required so to do, must observe and abide by the pro- visions of all laws of the State of California and of the United States of America relating to contracts of the nature contemplated herein, whether herein specifically mentioned. or not. SECTIO14 7. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerk's certifi- cate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for the furnishini; to said City all of its lobby and lounge and wood and leather furni- ture requirements for and during the period of one year commencing: October 15, 1955, and thereafter until either party shall have given the other thirty (30) days' written notice of cancellation of contract for furnishing said furniture, pursuant to the award hereinabove made; and the Mayor of the City of El Segundo is hereby authorized, on behalf of said City, to affix the approval and ac- ceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the official seal of said City thereto. SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of El Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
