CC RESOLUTION 1544s'a RESOLUTION NO. 1544 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO AMERI- CAN SEATING COMPANY THE CONTRACT FOR FURNISH- ING SAID CITY AUDITORIUM SEATING. WHEREAS, the City Council of the City of El Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bidders, en- titled "NOTICE INVITING BIDS ON PURCHASE OF FURNITURE AND ON SALE OF FURNITURE ", dated July 27, 1955, a full, true and correct copy of which is hereunto attached, designated as "Exhibit All and here- by referred to and by this reference incorporated herein and made a part hereof; and WHEREAS, at the time for opening and considering all of said bids, to wit: the hour of 7:00 o'clock P. M. on Wednesday, the 14th day of September, said Council did publicly open, examine and declare all bids received; and WHEREAS, at said hour said Council did take all of said bids under consideration until the regular meeting of said Coun- cil to be held October 13, 1955, and referred the same to Finance Commissioner Gordon, City Administrative Officer Udall and City Accountant Wanderer for tabulation and report and recommendations; and WHEREAS, the said officers reported to this Council that they are prepared to report on the auditorium seating equip- ment referred to in said notice, and that in their opinion the matter of the acquisition of said seating equipment should receive immediate attention if same is to be in place at the dedication ceremonies to be held in December; and WHEREAS, the City Council concurred in such opinion and did receive the report of said officers and has at this meeting - 1 - permitted each of the two bidders on said auditorium seating equipment to address this Council and present their respective offerings and demonstrate the same; and WHEREAS, this Council is now fully informed in the premises and has reached its decision as hereinafter set forth; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS: SECTION 1. That the City Council does hereby find and determine that in its opinion the auditorium seating equipment offered by the American Seating Company in its bid on said equip- ment will best suit and serve the needs and requirements of the City of E1 Segundo. SECTION 2. That the bid of American Seating Company, of 6900 Avalon Boulevard, Los Angeles, California, dated Septem- ber 14, 1955, which said Council determined to be substantially as follows: "September 14, 1955 "City Council of the City of E1 Segundo City Administrative Office City Hall El Segundo, California "RE: Furniture Bid for City of E1 Segundo Civic Center Closing September 14, 1955 at 7 :00 P. M. "Gentlemen: "Pursuant to your request for bids, we are pleased to quote the following chair numbers and prices which are based on 13 rows of 6 chairs per row for a total of 78 chairs. "These chairs will be delivered and installed on concrete floor with asphalt tile covering. Seats and backs of all chairs will be covered with American Seating Long Pile mo- hair. All seats to be furnished with Luxaire padded seat. Aisles to have American Seating Company #146 Wood End Standards. " #16 -001 Auditorium Chairs . . . . . . . . . t2,819.70 - 2 - "Applicable seales taxes are not included in the above prices. Delivery can be made on or about December 15, 1955• Federal Insurance Company Bond ;7961051 -J in the amount of $325.00 which is equal to not less than 10% of the above bid, is attached. Zimmerman Sales Manac,er it and which said bid was submitted in response to and under the terms, conditions, provisions and requirements set forth in said notice, be and the same is hereby accepted at the bid price of 92,819.70, plus tax ('tax included making the total 2,904.29). Said bid is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this reference incorporated herein and made a part here- of for all further particulars. SECTION 3. That this award is made on the further term, condition and understanding that the equipment, which is the sub- ject of this award, will be delivered and installed in the Coun- cil Chambers of the new City Hall on or before the 10th day of December, 1955. SECTION 4. Nothing in this resolution contained shall be construed as in any manner affecting the bids received under the said notice ( "Exhibit A") on other items, as this resolution relates only to the auditorium seating equipment. SECTION 5. That all bids received under said notice on auditorium seating equipment, only, are hereby rejected with the exception of the bid of American Seating Company, hereinabove referred to, and the City Clerk is hereby authorized and instructed to return the checks of any unsuccessful bidder who bid upon such item only. SECTION 6. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and - 3 - shall affix to such copies at the end thereof, after the Clerk's certificate, forms for the approval of the successful bidder anc. on the part of the said City; and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for furnishing to said City certain auditorium seatin.- equipment, pursuant to the award hereinabove made; and the Mayor of the City of E1 Se- ;undo is hereby authorized on behalf of said City to affix the approval and acceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the seal of said City thereto. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall siake a minute of the passage and adoption thereof in the records of the proceedin {;s of the City Council of said City, in the minutes of the meetinm at which the same is ;passed and adopted.
