A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING AND CON- CURRING IN THE FINDINGS, DETERMINATION, INTER- PRETATION AND ACTION OF THE CITY PLANNIiNG COMMISSION OF SAID CITY AS SET FORTH IN RESO- LUTION NO. 228 OF SAID COMMISSION, DETERMINING THE ZONE CLASSIFICATION OF LOT 53, BLOCK 123, EL SEGUNDO TRACT, TO BE R -1. WHEREAS, the City Planning Commission of the City of E1 Segundo, California, did at the regular meeting of said Commission held on the 12th day of September, 1955, adopt the following reso- lution of said Commission, to wit; "RESOLUTION NO. 228 A RESOLUTION OF THE CITY PLANNING COM- MISSION OF THE CITY OF EL SEGUNDO, CALIFORNIA, CLARIFYING THE ZONE CLASSI- FICATION OF LOT 53, BLOCK 123, EL SE- GUNDO TRACT, AS ZONE R -1. WHEREAS, there has come to the attention of the Planning Commission what appears to be an oversight in the printing of the map which is a part of Ordinance No. 434 (The Comprehen- sive Zoning Ordinance), and WHEREAS, such oversight is one of omission of zone desig- nation on the property on the southwest corner of Pine Avenue and Nevada Street, more particularly described as, Lot 53, Block 123; of E1 Segundo Sheet No. 8, as recorded on Pages 106 and 107 of Map Book 22, on file in the office of the Re- corder of Los Angeles County, California, and WHEREAS, under Ordinance No. 306, the map which was a part thereof indicated such property as being zoned R -1, and WHEREAS, it was the intention of the Planning Commission to maintain such zoned classification on such property at the time of the adoption of the map, which is a part of Ordinance No. 434, and that the omission of such R -1 designation of such prop- erty was purely an oversight in the drafting of the map itself, and WHEREAS, until the omission was noted, it has been assumed by both the City Planning Commission members and the owners of - 1 - such property that the R -1 classification would, in fact, exist and was so indicated on the zoning map, and WHEREAS, the Planning Commission is in possession of no facts, and is aware of no circumstances that would indicate that such property should be zoned other than R -1, and WHEREAS, it was not the intent of the Commission to change the zone classification of such property as evidenced by the fact that no change from R -1 was indicated on the proposed land use map, upon which hearings were held pursuant to the adoption of Ordinance No. 434, and WHEREAS, the property owners within such area are desirous of maintaining the R -1 classification of such property, and WHEREAS, Section 1402 of Article 14 of Ordinance No. 434 establishes the manner by which ambiguities with reference to zone boundaries may be resolved, and that the Commission may by resolution of record set forth its findings and interpre- tation, NOW, THEREFORE, BE IT RESOLVED, that the Planning Commis- sion does find as follows: 1. That with reference to such property there is no evi- dence and no record that it was ever intended to zone such property other than R -1, 2. That the owners of such property as well as the owners of surrounding properties are all desirous that the property should be zoned R -1, and 3. That this finding in no way changes the situation from what it has been, from the original zoning of such property, but merely reiterates and records the intent of the Planning Commission that in adopting the map or land use portion of Ordinance No. 434 it was intended that such property should be zoned R -1, FINALLY RESOLVED, that a copy of this resolution be for- warded to the City Council for its action according to law, and should such action be to adopt the policy hereinabove set forth, that all departments and employees of the City having to do with the administration of Ordinance No. 434 be instructed to conform to such findings. SECTION 3. That this resolution shall take effect im- mediately. SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; shall make a min- ute of the passage and adoption thereof in the records of the pro- ceedings of the City Council of the said City, in the minutes of the meeting at which the same is passed and adopted; and shall forward a copy to the Planning Commission and to each of the de- partment heads concerned, for their information and files in the premises.
