RESOLUTION NO. 1535
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, APPROVING AND CON-
CURRING IN THE FINDINGS AND DETERMINATIONS OF
THE CITY PLANNING COMMISSION WITH REFERENCE
TO "HEAT TREATING AND DESCALING PLANT° AND
THE CLASSIFICATION THEREOF NOT SPECIFICALLY
MENTIONED IN THE ZONING ORDINANCE OF SAID CITY,
AND AS SET FORTH IN RESOLUTION NO. 226 OF SAID
COMMISSION.
WHEREAS, the City Planning Commission of the City of
E1 Segundo, California, did at an adjourned regular meeting of
said Commission held on the 22nd day of August, 1955, adopt the
following resolution of said Commission, to wit:
"RESOLUTION NO. 226
A RESOLUTION OF THE CITY PLANNING COMMIS-
SION OF THE CITY OF EL SEGUNDO, CALIFORNIA,
CLARIFYING SECTION 1101 OF ORDINANCE NO.
434 WITH REFERENCE TO PERMITTING A HEAT
TREATING AND DESCALING PLANT AS AN M -1 USE.
WHEREAS, question has been raised concerning the in-
tent and purpose of Section 1101 of Ordinance No. 434 with
reference to permitting the location of a heat treating
and descaling plant in the M -1 Zone, and
WHEREAS, the list of permitted uses as set forth in
Section 1100 contains certain ones concerning which there
is a minimum amount of smoke, dust, odor, vibration and
noise, and
WHEREAS, it was the intent that the list of permitted
uses in the M -1 Zone should be inclusive and not exclusive,
there being no possible way of adopting a complete list of
uses to be permitted in any zone, and
WHEREAS, Section 1101 of said ordinance sets forth
the stipulation that uses permitted in an M -1 Zone shall not
be obnoxious by reason of smoke, dust, odor, vibration and
noise, thus establishing performance standards for thereby
establishing the measuring stick for unlisted uses, and
WHEREAS, in using such phrase and establishing such
performance standards it was the intent of the Planning

Commission and the City Council that uses which were not
more obnoxious by such standards than those specified
would be permitted in the M -1 Zone, and
WHEREAS, Section 1402 of Ordinance No. 434 establishes
the means and procedure by which the meaning and intent of
Ordinance No. 434 could be ascertained with reference to
any particular use,
NOW, THEREFORE, BE IT RESOLVED, that the Planning
Commission determines that a heat treating and descaling
plant is no more obnoxious or hazardous to surrounding
properties than those already established as permitted uses
in the M -1 Zone, and that had the matter been brought to
the attention of the authorities at the time of considering
the ordinance the use would have been included in those
permitted specifically as follows:
'Heat treating and descaling, provided such equip-
ment as may emit fumes shall be equipped with vents
in which are installed adequate fume washer facili-
ties.'
and
FINALLY RESOLVED, that a copy of this Resolution be
transmitted to the City Council for its attention in the
manner provided by law and, if approved by the City Coun-
cil, that all administrative officials in the City be ad-
vised of these findings and conclusions and be directed to
administer the zoning ordinance accordingly.
Passed, approved and adopted this 22nd day of August,
1955.

WHEREAS, the City Council of said City has duly consid-
ered the said Resolution No. 226 hereinabove set forth and the
findings and recommendations made therein and is satisfied that
the designated classification for the use therein described and
referred to is correct and should be approved by this Council;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SE-
GUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND, DETERMINE
AND ORDER AS FOLLOWS:
SECTION 1. That said City Council does hereby make the
same findings with reference to the use described and referred to

in said Resolution No. 226 hereinabove quoted as are made by the
City Planning Commission of said City with reference thereto.
SECTION 2. That said City Council does hereby approve
the findings, determinations, and recommendations of said Commis-
sion as set forth in its said Resolution No. 226 with reference
to "Heat Treating and Descaling Plant" and does hereby according-
ly designate the classification "M -1" under Ordinance No. 434 of
said City (The Comprehensive Zoning Ordinance), as amended, for
the use described in and referred to in said Resolution No. 226.
SECTION 3. That the City Clerk is hereby authorized
and instructed to forward a copy of this resolution to the ad-
ministrative agents of the City of E1 Segundo, who are hereby
directed to conform to the findings, determinations and designa-
tions hereby approved and made.
SECTION 4. That the City Clerk shall certify to the
passage and adoption of this resolution; shall enter the same in
the book of original resolutions of said City; and shall make a
minute of the passage and adoption thereof in the records of the
proceedings of the City Council of said City, in the minutes of
the meeting at which the same is passed and adopted.
SECTION 5. That this resolution shall take effect im-
mediately.
Passed, approved and adopted this 24th day of August,
1955.

resolution, being Resolution No. 1535, was passed and adopted by
the said City Council, approved and signed by the Mayor pro tem
of said City, and attested by the City Clerk of said City all at
a regular meeting of the said Council held on the 24th daj of
August, 1955, and that the same was so passed and adopted by the
following vote:
AYES: Councilmen Frederick, Gordon, Swanson and
Mayor pro tem Baker;
NOES: Councilmen None;
ABSENT: Mayor Selby.
