CC RESOLUTION 1532RESOLUTION NO. 1532 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO G. J. PAYNE COMPANY THE CONTRACT FOR FURNISHING THE CITY OF EL SEGUNDO WITH ITS ASPHALTIC EMULSION REQUIREMENTS FOR A ONE YEAR PERIOD BEGINNING AUGUST 15, 1955• WHEREAS, the City Council of the City of E1 Segundo, Cali- fornia, has heretofore in the manner provided by law, duly and regu- larly advertised for bids under notice to bidders entitled "NOTICE TO BIDDERS ON GASOLINE, OIL, LUBRICANTS, PETROLEUM PRODUCTS AND ASPHALTIC EMULSION TO BE FURNISHED THE CITY OF EL SEGUNDO, CALI- FORNIA", dated the 22nd day of June, 1955, which is now on file in the office of the City Clerk, open to public inspection, and hereby referred to and by this reference incorporated herein and made a part hereof, for furnishing said City with the materials referred to in said notice; and WHEREAS, at the time for opening and considering all of said bids, to wit: the hour of 7 :00 o'clock P. M. (California Day- light Saving Time) on Wednesday, the 27th day of July, 1955, said Council did publicly open, examine and declare all bids received; and WHEREAS, at said hour said Council did take all of said bids under advisement until its next regular meeting to be held August 10, 1955, and referred said bids to the City Administrative Officer for checking, tabulation and report; and WHEREAS, said last mentioned date has now arrived and the City Administrative Officer has reported that the bid of G. J. Payne Company was the lowest, regular bid received on asphaltic emulsion requirements and recommends that the contract for said asphaltic emulsion requirements be awarded to said G. J. Payne Company; and - 1 - WHEREAS, said Council concurs in the recommendation of said City Administrative Officer, and has reached its decision in the said matter; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUN- DO, CALIFORNIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS: SECTION 1. That the bid of G. J. PAYNE COMPANY, of 6$10 Crenshaw Boulevard, Los Angeles 43, California, dated July 27, 1955, which said Council determines to be substantially as follows, to wit: "To the Honorable City Council City of E1 Segundo, California Gentlemen: The undersigned hereby proposes to furnish to the City of El Segundo, California, in said City, during the period August 15, 1955 to and inclusive of August 14, 1956, at midnight, the following petroleum products at the prices stated in the schedule below and all in accordance with the Nortice to Bidders attached hereto and further in accord- ance with Specifications G -0 - -5, heretofore approved and adopted by the City Council of said City and on file in the office of the City Clerk of said City, as follows, to wit: ITEM 16. Approx. 3,000 Gal. RS -1 Penetration Type Asphaltic Emulsion, as follows: A. Delivered to the City Warehouse in 200 gallon lots as requested, $0.25 per Gal. B. FOB Bidder's plant in 200 gallon lots, $0.1075 per Gal. American Bitumuls & Asphalt Plant, 1401 W. Florence Ave., Inglewood Exclude all Federal Excise Taxes. Certificate of exemption will be furnished. As required in said *Notice to Bidders *, there is enclosed bidder's bond in amount of TWO HUNDRED DOLLARS ($200.00); and as further required in said *Notice to Bidders', bidder hereby states that California 'Sales Tax' or 'Use Tax', or any other State or Federal Tax IS NOT included in the amount bid. PLeasant 8 -0516 DATED July 27, 1955. n , be and the same is hereby accepted as to the asphaltic emulsion re- quirements for said City for a one year period, beginning August - 2 - 15, 1955, and ending at midnight August 14, 1956, at the respective prices therefor set forth in said bid, which is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this reference incor- porated herein and made a part hereof for all further particulars. SECTION 2. The contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this contract is made, that only American -made materials and California -made materials will be used in the work or improvement contemplated under this contract, all in conformity with the provisions of Sections 4300 to 4305, both inclusive, and Sections 4330 to 4334, both inclusive, of the Government Code of the State of California. SECTION 3. The contractor, insofar as said contractor is legally required so to do, must observe and abide by the provi- sions of all laws of the State of California and of the United States of America relating to contracts of the nature contemplated herein, whether herein specifically mentioned or not. SECTION 4. That all bids received for said asphaltic emulsion requirements are hereby rejected with the exception of the bid of G. J. PAYNE COMPANY, hereinabove referred to, and the City Clerk is hereby authorized and instructed to return the checks of all unsuccessful bidders. SECTION 5. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerkts Certifi- cate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this resolution, so ap- proved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for furnishing the asphaltic emulsion requirements for said City for a one year period, pursuant to the award hereinabove made; and the Mayor of the City - 3 - of El Segundo is hereby authorized on behalf of said City to af- fix the approval and acceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the seal of said City thereto. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
