CC RESOLUTION 1528RESOLUTION NO. 1528• RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING THE PUBLIC NECESSITY AND AUTHORIZING THE CONDEMNATION FOR PUBLIC PARK PURPOSES OF PROPERTY IN THE VICINITY OF HOLLY AVENUE AND EUCALYPTUS DRIVE. WHEREAS, the City of El Segundo has unsuccessfully negotiated for the purchase of the real property hereinafter described; and WIiEREAS, the acquisition of the fee simple title to said real property is necessary for the public use herein- after set forth; and VREREAAS, an action in condemnation appears necessary for the acquisition thereof; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE AND DETERMINE, AS FOLLOWS: 1. That the public interest and necessity require the establishment by the City of E1 Segundo for the health, safety and welfare of its citizens of public park and recreation areas; and that the public interest and necessity require the acquisition for public park purposes of a fee simple estate to the real property in the City of El Segundo, County of Los Angeles, State of California, described as follows, to -wit: That portion of lot "A" of Tract No. 2111, in the City of E1 Segundo, County of Los Angeles, State of California, as per map recorded in Book 22, page 141 of Maps, in the office of the County Recorder of said county, described as follows: Beginning at the northwest corner of said lot A; thence along the westerly line of said lot A, South 00 061 34" East 100 feet to the northeast corner of lot G of Tract No. 1826, as per map recorded in book 21, page 93 of Maps, records of said county; thence parallel with the northerly line of said lot A. North 890 541 33" East to the southeasterly line of said lot A; thence northeasterly, along the southeasterly line of said lot A, to the most easterly corner of said lot A; thence along the northerly line of said lot A, South 890 521 07" West 357.23 feet and South 890 541 331' West 325.04 feet to the point of beginning. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury. 2. That the City of El Segundo is hereby authorized and empowered to acquire in the name of the City of E1 Segundo to be used. for public park purposes, the fee simple title to said lands by condemnation in accordance with the provisions of the Code of Civil Procedure and of the Constitution of California relating to eminent domain. 3. That Clyde Woodworth, City Attorney, and Robt. E. Rosskopf, Special Counsel, are hereby authorized to prepare and prosecute in the name of the City of E1 Segundo, such proceeding or proceedings in the proper court having juris- diction thereof, as are necessary for such acquisition; and in connection therewith to incur on behalf of said City any and all reasonable expenses and charges, including the procuring of title reports and appraisals as may be convenient or required in said matter; and to prepare and file such pleadings, documents, briefs and other instruments, and to make such arguments and generally take such action as may be necessary in the opinion of said attorneys to acquire for said City the fee simple title to said real properties. 4. Upon adoption of this resolution the City Clerk is instructed to certify a copy thereof and forward it to Robt. E. Rosskopf, Esq., 224 North Canon Drive, Beverly Hills, California.
