CC RESOLUTION 1527RESOLUTION NO. 1527 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO LE ROI -RI% MACHINERY CO. THE CONTRACT OR ORDER FOR FURNISHING SAID CITY WITH ONE NEW SKIP LOADER FOR USE OF THE WATER DEPARTMENT OF SAID CITY. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bidders en- titled *NOTICE TO BIDDERS ON SKIP LOADER FOR THE WATER DEPART- MENT OF THE CITY OF EL SEGUNDO *, dated June $, 1955, which is now on file in the office of the City Clerk, open to public in- spection, and hereby referred to and by this reference incorpor- ated herein and made a part hereof, for furnishing said City with the item referred to in said notice; and WHEREAS, at the time for opening and considering all of said bids, to wit: the hour of 7'00 o'clock P. M. on Wednes- day, the 13th day of July, 1955, said Council did publicly open, examine and declare all bids received; and WHEREAS, at said hour said Council did take all of said bids under consideration until the next regular meeting of said Council to be held July 27, 1955, and referred the same to City Administrative Officer Udall, City Engineer Webb and Garage Supervisor Grow, for investigation and report thereon; and WHEREAS, said last above mentioned date has now ar- rived and the City Engineer has submitted his report to this Council in words and figures as follows, to wit: *Date July 27, 1955 To: The Honorable City Council From: City Engineer Subject: Bids on Skiploader for Water Department - 1 - and "On July 13, 1955, your Honorable Body received and opened bids for a Skiploader for the Water Department. An analysis of the bids, and inspection of the equipment proposed for the various bids, including a sur- vey of the availability of spare parts, was conducted by Mr. Jim Grow, Maintenance Supervisor, and the undersigned. This analysis indicates that certain bids should be re- jected in view of noncompliance with the specifications, as set forth below: 1. Gilmore & Wilcox - Ferguson Loader; insuffici- ent horsepower (34) 2. Southwest Tractor Sales - Ford Loader; insuf- ficient bucket capacity (11 cu. ft.) 3. Electric Tool & Supply Co - Case Loader; in- sufficient bucket capacity (12 cu. ft.) Of those bids remaining of equipment that complies with the specification, a tabulation of bids, plus certain other information is shown below: TYPE OF HORSE- DISPLACE - BIDDER LOADER POWER MENT BID Brown -Bevis Ind. Allis Chalmers 40.01 226 4,094.25 It is respectfully recommended that the Oliver Tractor, as bid by the Le -Roi Rix Machine Co., for $3,589.55, in- cluding tax, be declared the best bid, and an award be made to them for the following reasons: 1. This bid is 484.46 more than the lowest acceptable bid, and for this slight additional cost, the Oliver Trac- tor furnishes 38 horsepower, as contrasted to 35; has 216 displacement as contrasted to 165; and has six forward and two reverse speeds, as contrasted to 5 forward and one re- verse. It is the opinion of Mr. Grow and the undersigned, that the Oliver Tractor represents the best buy for the City. Respectfully submitted /s/ E. J. Grow /s/ Robert L. Webb, Jr. Robert L. Webb, Jr. City Engineer a; WHEREAS, the said Council accepts the recommendation made by said City Engineer and feels that the action hereinafter taken is in the best interest of said City; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO* CALIFORNIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS: - 2 - SECTION 1. That the bid of LE ROI -RI% MACHINERY CO., of 6403 East Slauson Avenue, Los Angeles 22, California, dated July 7, 1955, which said Council determined to be substantially as follows: City of E1 Segundo City Hall 203 Richmond E1 Segundo, California Attention: Mrs. Neva M. Elsey City Clerk Dear Mrs. Elsey: "July 7, 1955 Subject: Request for Bids on Skip Loader due July 139 1955 We are pleased to submit for your consideration our bid for furnishing your City with one (1) new Skip Loader for use in the Water Department. We are bidding our Oliver Industrial Tractor, Model 77. This tractor will be complete with the following: Gasoline engine; 216 cu. in. displacement, 45 H.P., 38 drawbar pull Six forward and two reverse speeds. 1/2 yd. Baker -Lull hydraulic front end loader. 3 point hitch for tractor w /power take -off. Power steering. Gannon scraper. Electric lights for night operation. The equipment described above will sell for three thousand four hundred eighty -five dollars ($3,4$5.00) f.o.b. the City Yards at E1 Segundo, California. This price does not include any City, State or applicable Federal taxes. Attached please find our Bid Bond for 10% of the total amount of our bid. This Bid Bond is on the Glens Falls Insurance Company. Delivery of this unit can be made within ten to fifteen days of date of order. Deane - President a; f and which said bid was submitted in response to and under the terms, conditions, provisions and requirements set forth in said - 3 - "NOTICE TO BIDDERS ON SKIP LOADER FOR THE WATER DEPARTMENT OF THE CITY OF EL SEGUNDO ", be and the same is hereby accepted at the bid price of $3,4$5.00, plus tax (tax included making the total $3,5$9.55)• Said bid is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby ex- pressly referred to and by this reference incorporated herein and made a part hereof for all further particulars. SECTION 2. The Contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this contract is made, that only American -made materials, and, so far as reasonably possible, California -made materials will be used in the work or improvement contemplated under this contract, all in conformity with the provisions of Sections 4300 to 4305, both inclusive, and Sections 4330 to 43340 both inclusive, of the Government Code of the State of California. SECTION 3. The Contractor, insofar as said Contractor is legally required so to do, must observe and abide by the pro- visions of all laws of the State of California and of the United States of America relating to contracts of the nature contem- plated herein, whether herein specifically mentioned or not. SECTION 4. That all bids received for said equipment are hereby rejected with the exception of the bid of LE ROI -RI% MACHINERY CO., hereinabove referred to, and the City Clerk is hereby authorized and instructed to return the checks of all un- successful bidders. SECTION 5. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerkts Certificate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for furnishing - 4 - to said City one new Skip Loader for use in the Water Department, pursuant to the award hereinabove made; and the Mayor of the City of E1 Segundo is hereby authorized on behalf of said City to af- fix the approval and acceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to at- test the same on behalf of said City and to affix the seal of said City thereto. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
