CC RESOLUTION 1497G G?b RESOLUTION NO. 1497 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING THE AP- PLICATION OF SAMUEL DOUGLASS AND M. CRAVENS DOUGLASS FOR AN UNCLASSIFIED USE PERMIT FOR A MORTUARY WITHIN SAID CITY; CONCURRING IN THE RECOMMENDATIONS OF THE CITY PLANNING COM- MISSION WITH REFERENCE THERETO AND GRANTING PERMISSION TO SAID APPLICANTS TO ERECT, ES- TABLISH AND OPERATE A MORTUARY ON THE NOR- THERLY 165 FEET OF LOT 4, BLOCK 102, EL SEGUNDO, CALIFORNIA. WHEREAS, there was heretofore presented to the City Planning Commission of the City of E1 Segundo, California, the application of Samuel Douglass and M. Cravens Douglass for an un- classified use permit under the provisions of Ordinance No. 434 (The Comprehensive Zoning Ordinance) of said City to establish a mortuary in a C -2 Zone on the following described property lo- cated in the City of E1 Segundo, County of Los Angeles, State of California, to wit: and The Northerly 165 feet of Lot 4, Block 102, E1 Segundo Sheet No. 4, as recorded on Page 24 of Book 20 of Maps, on file in the office of the Recorder of said County; WHEREAS, said Commission as required under the provis- ions of Articles 1$ and 19 of said Ordinance No. 434 did duly and regularly notice and hold a public hearing on said matter and after due consideration and at its regular meeting of the 14th day of February, 1955, did duly and regularly adopt the following resolution with reference to said matter, to wit: - 1 - "RESOLUTION NO. 209 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF EL SEGUNDO, CALIFORNIA, GRANT- ING REQUEST OF SAMUEL AND MARGARET CRAVENS DOUGLASS, WITH CERTAIN CONDITIONS, FOR UN- CLASSIFIED USE PERMIT TO ESTABLISH A MORTUARY ON THE NORTHERLY 165 FEET OF LOT 4, BLOCK 102, EL SEGUNDO WHEREAS, application was made by Samuel and Margaret Cravens Douglass, 146 Richmond Street, El Segundo, Cali- fornia, for an Unclassified Use Permit to erect and oper- ate a mortuary on the northerly 165 feet of Lot 4, Block 102, El Segundo, California, and WHEREAS, the City Planning Commission did on January 31, 1955, hold a duly advertised public hearing on such matter, as required by law, and WHEREAS, as a result of said hearing, testimony and evidence presented, receipt of Staff Report, and investi- gation by Commission members, the Planning Commission finds as follows: 1. That the property in question and adjoining proper- ty fronting on Imperial Highway has been zoned C -2 since the effective date of the original Zoning Ordinance No. 306 in February, 1947. 2. That Ordinance No. 306, without review, permitted mortuaries in R -4, C -2 and heavier use zones. 3. That the residences on the southwest corner of Sheldon Street and Imperial Highway, and the School to the east of subject property, were erected while Ordinance No. 306 was in effect and when mortuaries and many other uses could be located in Imperial Highway without review. 4. That under the present Zoning Ordinance No. 434, many C -2 uses such as garages, markets, etc., are auto- matically permitted on subject and adjoining property. 5. That with the adoption of Ordinance No. 434, mortuaries were placed in the unclassified category requir- ing review, not for their prohibition in a zone in which they can be permitted (C -1 and heavier), but for the pur- pose of insuring that parking, processions, building lay- out, and operation of the proposed establishment are ade- quate and considerate of public safety, convenience and welfare. 6. That the proposed plan and method of operation of the applicant gives maximum consideration to the residences to the west on Sheldon Street and Imperial Highway. 7. That the layout of the School and the topography of the playgrounds, plus a solid wall fence on the East boundary of the subject property, provides adequate insula- tion of the proposed establishment from the school children. - 2 - and "NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission recommends that the application of Samuel and Margaret Cravens Douglass for Unclassified Use Permit to erect a mortuary on the Northerly 165 Feet of Lot 4, Block 102, E1 Segundo, be granted subject to the following con- ditions: 1. That a 6 foot solid wall fence be erected on the Easterly boundary of subject property before operation of the mortuary begins. 2. That the loading of the hearse for funeral pro- cessions be done from the east porte - cochere. 3. That the unloading of incoming bodies be done, whenever possible, using the east entrance of the garage. If the west entrance is used, unloading shall be done be- hind closed doors. 4. That R -3 setback requirements be applied to the proposed residence. 5. That the parking lot be supervised to insure orderly parking and to discourage on- street parking of patrons. 6. That the plot plan submitted for the files of the Commission be adhered to. AND BE IT FINALLY RESOLVED, that a copy of this Reso- lution be forwarded to the City Council for its information and action. Allen ning Commission of the City chairman o tTe City an- of E1 Segundo, California ning Commiss16n of the City of El Segundo, California WHEREAS, upon receipt of said above quoted Resolution No. 209 of said Commission, said City Council did duly and regu- larly notice and hold a public hearing on said matter before said City Council on the 9th day of March, 1955, and after said hear- ing and due and careful consideration of said matter did reach its decision to grant said unclassified use permit as recommended by said Commission in its said above quoted Resolution No. 209, and subject to the conditions contained in said Resolution No. 209; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SE- GUNDO, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: - 3 - ,oy is SECTION 1. Said City Council does hereby find that the facts recited in the preamble of this resolution are true. SECTION 2. That said City Council does hereby concur in the findings and recommendations with reference to said mor- tuary, contained and referred to in said Resolution No. 209 of said City Planning Commission hereinabove quoted in the preamble to this resolution. SECTION 3. That said City Council does hereby recite the same facts and reasons for the approval of said application for said unclassified use permit as are hereinabove set forth in said Resolution No. 209 of said Planning Commission, hereinabove quoted, and does hereby refer to the same as hereinabove set forth and does hereby make them a part of this Section 3 of this resolu- tion for all intents and purposes as though the same were fully set forth at length herein. SECTION 4. That in view and consideration of the fore- going facts, findings and determinations, said City Council does hereby grant to said Samuel Douglass and M. Cravens Douglass an unclassified use permit to establish a mortuary on the following described property located in the City of E1 Segundo, County of Los Angeles, State of California, to wit: The Northerly 165 feet of Lot 4, Block 102, E1 Segundo Sheet No. 4, as recorded on Page 24 of Book 20 of Maps, on file in the office of the County Recorder of said County; subject to the conditions set forth in said Resolution No. 209 of said Planning Commission, and does hereby refer to the said condi- tions and does hereby make them a part of this Section 4 of this resolution for all intents and purposes as though the same were fully set forth at length herein. mediately. That pursuant to the provisions of Section 1$14 of Article 1$ of said Ordinance No. 434, the City Clerk is hereby instructed to forward one certified copy of this resolu- tion to said applicants at the address shown upon their application and to attach one certified copy thereof to the complete file of said Planning Commission in said matter and to thereupon return said complete file to said Planning Commission for permanent filing. SECTION %. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
