RESOLUTION NO. 1459 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING AND CON- CURRING IN THE FINDINGS AND DETERMINATIONS OF THE CITY PLANNING COMMISSION WITH REFERENCE TO "BATTERY BUILDING" AND THE CLASSIFICATION THEREOF NOT SPECIFICALLY MENTIONED IN THE ZON- ING ORDINANCE OF SAID CITY, AND AS SET FORTH IN RESOLUTION NO. 201 OF SAID COMMISSION. WHEREAS, the City Planning Commission of the City of El Segundo, California, did at the regular meeting of said Commission held on the 29th day of November, 1954, adopt the following reso- lution of said Commission, to wit: "RESOLUTION NO. 201 "A RESOLUTION OF THE CITY PLANNING COM- MISSION OF THE CITY OF EL SEGUNDO, CALI- FORNIA, RECOMMENDING BATTERY BUILDING AS AN M -1 USE "WHEREAS Ordinance No. 434 (the Comprehensive Zoning Ordinance] of the City of E1 Segundo, California, presently permits battery rebuilding as a permissible use in the M -1 Zone, and "WHEREAS, question has been raised as to whether such permitted use also includes the item of 'battery building' in the first instance, and "WHEREAS, Section 1402 of said Ordinance No. 434 sets forth that where ambiguity arises concerning the ap- propriate classification of a particular use within the meaning and intent of said ordinance that it shall be the duty of the Commission to ascertain all pertinent facts and, by resolution, set forth its findings and its in- terpretations, and "WHEREAS, the Commission finds with reference to battery building and battery rebuildingr, as follows: 1. In battery rebuilding, the process involves the disassembling of used batteries and the process of cleaning parts with acids, the replacing of plates and separators and reactivating them with new acid solution. It involves the use and storage of acids and solutions in some manner as to make them available for cleaning purposes. The process of disassembling used batteries - 1 - and the handling of used parts in the presence of acids can, and often does, produce fumes and odors. The degree of nuisance depends in large part upon the care of the premises and the disposal of waste materials. 2. In battery building in the first instance, the use differs from battery rebuilding largely in the fact that new materials are used and assembled. The com- ponent parts, if fabricated upon the premises, excepting the outside cases, employ materials and processes which, in themselves, are not considered obnoxious. Any acids used in this process are poured into the battery as al- most the last step in the process of assembling new ma- terials. The entire processing and assembling of new batteries represents the type of establishment devoid of obnoxious characteristics. "IVOW, THEREFORE, BE IT RESOLVED, the Planning Com- mission finds that the process of battery building is no more obnoxious and detrimental than battery rebuilding, which is a use already permitted in the M -1 Zone, and "FURTHER RESOLVED, that battery building shall be considered as a use also permitted in the M -1 Zone on the following conditions - - 1. That, in keeping with other permitted uses and conditions already established in the M -1 Zone, the manu- facture of outside cases for batteries, if done on the premises, shall be made from finished rubber if rubber is the material used, and "FINALLY RESOLVED, that a copy of this resolution be transmitted to the City Council fm its concurrence in the manner prescribed by law. and if the action of the City Council is to concur, that all officials of the City be directed to conform thereto in their administrative acts in the same manner as though said use were specified under Section 1100 of Article 11 of Ordinance 434 of the City of El Segundo. Allen ning Commission of the City Chairman of the City Plan- of El Segundo, California ning Commission of the City of El Segundo, California "; and WHEREAS, the City Council of said City has duly consid- ered the said Resolution No. 201 hereinabove set forth and the findings and recommendations made therein and is satisfied that the designated classification for the use therein described and referred to is correct and should be approved by this Council; - 2 - .� . , 6i , NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SE- GUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That said City Council does hereby make the same findings with reference to the use described and refer- red to in said Resolution. No. 201 hereinabove quoted as are made by the City Planning Commission of said City with reference there- to. SECTION 2. That said City Council does hereby approve the findings, determinations, and recommendations of said Commis- sion as set forth in its said Resolution No. 201 with reference to "Battery Building" and does hereby accordingly designate the classification "M -1" under Ordinance No. 434 of said City (The Comprehensive Zoning Ordinance), as amended, for the use de- scribed in and referred to in said Resolution No. 201. SECTION 3. That the City Clerk is hereby authorized and instructed to forward a copy of this resolution to the ad- ministrative agents of the City of E1 Segundo, who are hereby directed to conform to the findings, determinations and desi7la- tions hereby approved and made. SECTIOiN 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall ma {e a minute of the passare and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
