CC RESOLUTION 1453RESOLUTION NO. 1453. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, IN THE MATTER OF THE IMPROVEMENT OF PORTIONS OF KANSAS STREET, HOLLY AVENUE, CALIFORNIA STREET AND PINE AVENUE, AS PER PLANS AND PROFILES NO. 540716, SHEETS NOS. 2 TO 9 INCLUSIVE, ON FILE IN THE OFFICE OF THE CITY ENGINEER OF SAID CITY WHEREAS, the City Council of the City of El Segundo, California, has heretofore received two (2) separate petitions from property owners for the improvement of portions of Kansas Street, Holly Avenue, California Street and Pine Avenue and intersections of said streets, together with plats or maps showing the exterior boundaries of the proposed assessment district for the improvement of said streets; and WHEREAS, each of said petitions provided that it may be consolidated with any petition for the improvement of a street or streets intersecting streets provided for in each petition; and WHEREAS, the City Engineer has reported to this City Council that he has checked and examined the petitions with the report of owners furnished by the Title Insurance & Trust Company and finds that said petitions represent the following. (a) That the petition for the improvement of portions of Kansas Street and Holly Avenue represents 81.68% of the qualified owners in area of the property subject to assessment for the improvement of said streets; (b) That the petition for the improvement of portions of Pine Avenue and California Street represents 83.88% of the qualified owners in area of the property subject to assessment for the improvement of said streets; and WHEREAS, the City Council has duly considered the said petitions and report of the Engineer with reference to the proposed improvement referred to in said petitions. - 1 - J J NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SECUNDO, CALIFORNIA, DOES HE MY RESOLVE, DETERMINE, FIND AND ORDER AS FOLLOWS: Section 1. That the improvements referred to in said petitions are to be done and carried through under the provisions of the flImprovement Act of 1911It, Division 7 of the Streets and Highways Code of the State of California. Section 2. That this City Council does hereby find and determine that the qualified signatures to said petitions, as shown by the report of such owners furnished by the Title Insurance and Trust Company, represent more than sixty per cent (60% ) of the total assessable area of the proposed district, as shown and delineated upon the plats or maps attached to said petitions. Section 3. That this City Council does hereby further find and determine that said petitions for said improvements represent all the requirements prescribed by Section 2804 of the *Special Assessment Investigation, Limitation and Majority Protest Aft of 1931"1 being Division 4 of the Streets and Highways Code of the State of California, and the City Council intends to meet each and every condition and make each and every finding necessary on its part in order to permit the proceedings for said improvements to go forward to completion, without further reference to or application of the provisions of said Division 4 of said Streets and Highways Code. Section 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of said city, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted.
