CC RESOLUTION 1430RESOLUTION NO. 1430 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO GENERAL ELECTRIC COMPANY A CERTAIN CONTRACT FOR THE FURNISHING AND INSTALLING OF CER- TAIN RADIO EQUIPMENT FOR THE FIRE DEPARTMENT OF SAID CITY. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under a notice to bidders en- titled "NOTICE INVITING BIDS FOR THE FURNISHING AND INSTALLING OF CERTAIN RADIO EQUIPMENT FOR THE FIRE DEPARTMENT OF THE CITY OF EL SEGUNDO, CALIFORNIA. ", dated July 28, 1954, which is now on file in the office of the City Clerk, open to public inspection, and hereby referred to and by this reference incorporated herein and made a part hereof, for furnishing and installing certain radio equipment for the Fire Department of said City; and WHEREAS, at the time fixed for opening and considering said bids, to wit: the the 25th day of August, examine and declare all bids to the City Admini port to said Council at tember 1, 1954; and hour of 7:00 o'clock P. M., on Wednesday, 1954, said Council did publicly open, bids received and did refer all of said strative Officer for investigation and re- its next regular meeting to be held Sep- WHEREAS, said last mentioned date has now arrived and said Administrative Officer has reported and recommends to said Council that General Electric Company, the low bidder under said notice inviting bids, be awarded the contract for furnishing and installing said radio equipment for the Fire Department of said City; and - 1 - WHEREAS, said Council concurs in the report and recom- mendation of said City Administrative Officer and has reached its decision in the said matter; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SE- GUNDO, CALIFORNIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS: SECTION 1. That the bid of GENERAL ELECTRIC COMPANY, of 3460 Wilshire Boulevard, Los Angeles 5, California, dated August 24, 1954, (the low bid) which said Council determines to be substantially as follows, to wit: *August 24, 1954 *City Council City of El Segundo 205 Franklin Avenue El Segundo, California *Gentlemen: *General Electric Company is pleased to propose the fol- lowing radio equipment in response to your request to bid opening August 25, 1954- *I. 1A. El Segundo, California. Prices do not include Federal Excise tax or any State or local tax. "Delivery can be made within 30 to 45 days from receipt of order specifying operating frequencies. A 10% bid bond is attached to this quotation and a 25% performance bond will be provided upon award of bid to the undersigned. WORTHEN District Sales Manager Radio Communication Equipment "KJW:hm Enc. and which said bid was submitted in response to and under the terms, conditions, provisions and requirements set forth in the "NOTICE INVITING BIDS FOR THE FURNISHING AND INSTALLING OF CERTAIN RADIO EQUIPMENT FOR THE FIRE DEPARTMENT OF THE CITY OF EL SEGUNDO, CALIFORNIA. ", be, and the same is hereby accepted as hereinabove set forth and determined in the above quoted bid, which is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this refer- ence incorporated herein and made a part hereof for all further particulars. SECTION 2. The Contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this contract is made, that only American -made materials, and, so far as reasonably possible, California -made materials will be used in the work or improvement contemplated under this contract, all in conformity with the pro- visions of Sections 43QO to 4305, both inclusive, and Sections 4330 to 4334, both inclusive, cf the Government Code of the State of California. - 3 - 'S v� SECTION 3. The Contractor, insofar as said Contractor is legally required so to do, must observe and abide by the pro- visions of all laws of the State of California and of the United States of America relating to contracts of the nature contemplated herein, whether herein specifically mentioned or not. SECTION 4. That all bids received for the furnishing and installing of said radio equipment are hereby rejected with the exception of the bid of GENERAL ELECTRIC COMPANY, hereinabove referred to, and the City Clerk is hereby authorized and instructed to return the checks of all unsuccessful bidders. SECTION 5. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerkts Certifi- cate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this resolution, so ap- proved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for furnishing and installing certain radio equipment for the Fire Department of said City, pursuant to the award hereinabove made; and the Mayor of the City of E1 Segundo is hereby authorized on behalf of said City to affix the approval and acceptance of said City to such con- tract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the seal of said City thereto. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of E1 Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City - 4 - Council of said City, in the minutes of the meeting at which the same is passed and adopted.
