CC RESOLUTION 142276' a ) RESOLUTION NO. 1422 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO TIDE WATER ASSOCIATED OIL COiMPANY CERTAI CONTRACTS FOR CERTAIN PETROLEUM: PRODUCTS TO BE SUPPLIED TO SAID CITY DURING THE PERIOD AUGUST 15, 1954, TO AUGUST 14, 1955. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bidders entitled "NOTICE TO BIDDERS ON GASOLINE, OIL, LUBRICANTS, PETROLEUM PRODUCTS AND ASPHALTIC EMIULSION TO BE FURNISHED THE CITY OF EL SEGUNDO, CALI- FORNIA.", dated the 7th day of July, 1954, which is now on file in the office of the City Clerk, open to public inspection, and hereby referred to and by this reference incorporated 'herein and made a part hereof, for furnishing said City with the materials referred to in said notice; and WHEREAS, at the time for opening and considering all of said bids, to wit: the hour of 7 :00 o'clock P. M.. (California Day- light Saving Time) on Wednesday, the 28th day of July, 1954, said Council did publicly open, examine and declare all bids received; and WHEREAS, at said hour said Council did take all of said bids under advisement until its next regular meeting to be held Au, -;ust 4, 1954, and referred said bids to the City Administrative Officer for tabulation and report; and WHEREAS, said last mentioned date has now arrived and the City Administrative Officer has submitted a report to this Coun- oil substantially as follows: - 1 - 7_17 f' "August 4, 1954 'TO: CITY COUNCIL FROM: CITY ADMINISTRATOR SUBJECT: ANALYSIS AND RECOMMENDATIONS OF GASOLIiNE AND PE- TROLEUM PRODUCTS BIDS "The following is a tabulation of the bids for furnish- ing gasoline and other petroleum products for the period August 15, 1954 to August 14, 1955• These bids were re- ceived by your Board at its last regular meeting. All other prices are plus State Sales Taxes on oils, greases, asphalt, etc. All vendors bid a maximum price guarantee. All prices are net to City for delivery in standard amounts of accepted trade practice. "It is my recommendation that the entire award on Gasoline, lube oils, grease and other petroleum products, with the exception of Item No. 16 which is asphaltic ma- terial, be awarded to the low bidder, namely, Tidewater Associated Oil Company. "Two of the other bidders, namely Union Oil Company and Shell Oil Company, bid low on several of the smaller miscellaneous items; however, Tidewater Associated Oil Com- pany was low on the principal item, namely gasoline, and the prices were very much in line on all the other items with all the other companies. If we broke the bid down and awarded the small miscellaneous amounts to the other bidders, aside from Tidewater Associated Oil Company, conceivably the City would save approximately J60.00 over the year's period. However, I strongly feel that since one company is the over- all low bidder and has an excelent line of products which meet all of our specifications, that it would be much more - 2 - 7617 profitable for us to deal with one Company alone except for the asphaltic materials, where there was one lone bidder. I recommend, and Niech. Mlaint. Supt. Mir. E. J. Grow, concurs that Associated Tidewater Oil Company be awarded total overall bid as the lowest and best bidder in amount of 0,303-40. if /s/ E. E. UDALL, CITY AD14INISTRATOR "EEU�ec and WHEREAS, said Council concurs in the recommendation of said City Administrative Officer, as hereinabove set forth, and has reached its decision in the said matter; NOW, THEREFORE, the City Council of the City of El Se- gundo, California, does resolve, declare and determine as follows: SECTION 1. That all bids received on the items referred to in the above quoted portion of the report and recommendation of the City Administrative Officer (City Administrator), dated August 4, 1954, be and the same are hereby rejected with the exception of the bid of Tide Water Associated Oil Company, dated July 25, 1954, and that the contracts for the furnishing to said City of the products referred to in said items for and during the one year period from August 15, 1954, to August 14, 1955, be and the same are hereby awarded to said Tide Water Associated Oil Company at the respective prices for said respective items as set forth in the original bid of said Tide Water Associated Oil Company upon said items which is now on file in the office of the City Clerk and hereby referred to and by this reference made a part hereof. SECTION 2. That responsive to the awards hereinabove made in Section 1 of this resolution, the Mayor of the City of El Segundo is hereby authorized and instructed to execute the re- spective forms of contract for Governmental Agencies enclosed with said original bid of said Tide Water Associated Oil Company for said respective products, and the City Clerk to attest the same and to affix the official seal of said City thereto and make - 3 - 761 delivery of said contracts in due course; provided, that the fol- lowing clause to be designated by an appropriate number shall be added to the reverse side of each of said contracts, to wit: The "NOTICE TO BIDDERS ON GASOLINE, OIL, LUBRICANTS, PETROLEUM PRODUCTS AND ASPHALTIC EMULSION TO BE FUR- NISHED THE CITY OF EL SEGUNDO, CALIFORNIA. ", dated July 7, 1954, pursuant to which the seller herein bid and under which this contract is awarded and which is now on file in the office of the City Clerk, is hereby referred to and by this reference incorporated herein and made a part hereof. SECTION 3. In the making of this award the City Council has found and determined and does hereby find and determine that the bid of said Tide 'Water Associated Oil Company is the lowest and best overall bid received under said notice inviting bids on all of the products referred to in said Items Nos. 1 to 14, both inclusive, set forth in said recommendations of said Administrative Officer and therefore, it is for the best interests of said City that the contract on all of said items be awarded to said Tide Water Associated Oil Company as herein ordered. SECTION 4. That the City Clerk is authorized to return the bid deposits of unsuccessful bidders on the above items. SECTION 5. That this resolution shall take effect im- mediately. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of El Segundo; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City - 4 - Council of said City in the minutes of the meeting at which the same is passed and adopted.
