RESOLUTION NO. 1421
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, AWARDING TO G. J.
PAYNE COMPANY THE CONTRACT FOR FURNISHING THE
CITY OF EL SEGUNDO WITH ITS ASPHALTIC EMULSION
REQUIREMENTS FOR A ONE YEAR PERIOD BEGINNING
AUGUST 15, 1954.
WHEREAS, the City Council of the City of El Segundo, Cali-
fornia, has heretofore in the manner provided by law, duly and re;u-
larly advertised for bids under notice to bidders entitled "NOTICE
TO BIDDERS ON GASOLINE, OIL, LUBRICANTS, PETROLEUM PRODUCTS AND
ASPHALTIC EMULSION TO BE FURNISHED THE CITY OF EL SEGUNDO, CALI-
FORP?IA. ", dated the 7th day of July, 1954, which is now on file in
the office of the City Clerk, open to public inspection, and hereby
referred to and by this reference incorporated herein and made a
part hereof, for furnishing said City with the materials referred
to is said notice; and
WHEREAS, at the time for cpenin,r and considerin; all of
said bids, to wit: the hour of 7:00 o'clock P. M. (California Day-
light Saving; Time) on Wednesday, the 28th day of July, 1954, said
Council did publicly open, examine and declare all bids received;
and
udREREAS, at said hour said Council did tare all of said

August 4, 1954, and referred said bids to the City Administrative
Officer for tabulation and report; and
WHEREAS, said last mentioned date has now arrived and the
City Administrative Officer has submitted a report to this Council

"The following; is a tabulation of the bids for fur-
nishing gasoline and other petroleum products for the
period August 15, 1954 to August 14, 1955. 'These bids
were received by your Board at its last regular meeting.

"All excise tax deducted throughout.
Gasoline prices include California State Tax. All other
prices are plus
State Sales taxes on oils, greases, asphalt, etc.
All vendors bid a maximum price ;guarantee. All prices are
net to City for delivery in standard amounts of accepted
trade practice.
"On Item No. 16, which is for 3,000 gal. of penetration
type asphaltic emulsion, the City received only one bid, from
the G. J. Payne Company. This bid was for 24¢ per gallon de-
livered to the City yard, or the alternate price of 8 -1/4¢
per gallon F.O.B. Vendors plant, in City trucks. This price
is better than what we have been payin-- on a negotiated basis
during last year; therefore I recommend that this part of the
contract be awarded to G. J. Payne Company.

WHEREAS, said Council concurs in the recommendation of
said City Administrative Officer, as hereinabove set forth, and has
reached its decision in the said matter;
NOW, THEREFORE, the City Council of the City of El Segun-
do, California, does resolve, declare and determine as follows:
SECTION 1. That the bid of G. J. PAYNE COMPANY, of 6810
Crenshaw Boulevard, Los Angeles, California, dated July 26, 1954,
which said Council determines to be substantially as follows, to
wit:

will be furnished. As required in said 'Notice to Bidders',
there is enclosed Cashier's Check in amount of TWO HUNDRED
DOLLARS(9'200.00); and as further required in said 'Notice to
Bidders', bidder hereby states that California 'Sales 'Tax'
or 'Use Tax', or any other State or Federal Tax IS NOT in-

be and the same is hereby accepted as to the asphaltic emulsion re-
quirements for said City for a one year period, beginning AuY;ust
15, 1954, and ending at midnight August 14, 1955, at the respec-
tive prices therefor set forth in said bid, which is now on file in
the office of the City Clerk of said City, and which said bid so on
file is hereby expressly referred to and by this reference incor-
porated herein and made a part hereof for all further particulars.

SECTION 2. The Contractor agrees, responsive to the
preference of the City Council of said City as expressed in the
notice inviting bids, pursuant to which this contract is made, that
only American -made materials and California -made materials will be
used in the work or improvement contemplated under this contract,
all in conformity with the provisions of Sections 4300 to 4305,
both inclusive, and Sections 4330 to 4334, both inclusive, of the
Government Code of the State of California.
SECTION 3. The Contractor, insofar as said Contractor
is legally required so to do, must observe and abide by the pro-
visions of all laws of 'the State of California and of the United
States of America relating- to contracts of the nature contemplated
herein, whether herein specifically mentioned or not.
SECTION 4. That the City Clerk shall prepare copies of
this resolution after the passage and adoption thereof, and shall
affix to such copies at the end thereof, after the Clerkts certifi-
cate, forms for the approval of the successful bidder and on the
part of the said City, and such copies of this resolution, so ap-
proved and accepted by such successful bidder and by and on behalf
of said City, shall constitute the contract for furnishing to said
City all of the asphaltic emulsion requirements mentioned in said
bid, and which are to be furnished by such successful bidder pur-
suant to the award hereinabove made.
SECTION 5. That the Payor of the City of E1 Segundo is
hereby authorized and directed to execute the contract or agree-
ment between said City and said successful bidder; and the City
Clerk to attest the same; affix the City's seal thereto and make
delivery thereof in due course, as hereinabove awarded.
SECTION 6. That the City Clerk shall certify to the pass-
age and adoption of this resolution;shall cause the original of the
same to be entered in the book of resolutions of the said City of

thereof in the records of the proceedings of the City Council of
said City in the minutes of the meeting at which the same is passed
and adopted.
Passed, approved and adopted this 4th day of August, 1954.
