A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, AWARDIhIG A CERTAIN
CONTRACT TO AMERICAN CAST IRON PIPE COMPANY
FOR FURNISHING AND DELIVERING TO SAID CITY
CERTAIN CAST IRON PIPE.
WHEREAS, the City Council of the City of El Segundo, Cali-
fornia, has heretofore in the manner provided by law, duly and regu-
larly advertised for bids under notice to bidders entitled "NOTICE
INVITING BIDS ON CAST IRON PIPE FOR THE CITY OF EL SEGUNDO.", dated
June 30, 1954, which is now on file in the office of the City Clerk,
open to public inspection, and hereby referred to and by this refer-
ence incorporated herein and made a part hereof, for furnishing and
delivering certain cast iron pipe to said City; and
WHEREAS, at the time fixed for opening and considering
said bids, to wit: the hour of 7;00 o'clock P. M. (California Day-
light Saving Time) on Wednesday, the 21st day of July, 1954, said
Council did publicly open, examine and declare all bids received;
and did take all of said bids under advisement until the next regu-
lar meeting of the said Council to be held July 2$, 1954, and re-
ferred the same to the City Engineer for tabulation and report; and
WHEREAS, said last mentioned date has now arrived and
said City Engineer has reported and recommends that the bid of
American Cast Iron Pipe Company, the low bidder, be accepted; and
WHEREAS, said Council concurs in the recommendation of
said City Engineer and has reached its decision in the said matter;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS;
SECTION 1. That the bid of American Cast Iron Pipe Com-
pany, of Los Angeles, California, dated July 20, 1954, which said
Council determines to be substantially as follows, to wit;

'Gentlemen:
"With reference to your official advertisement of June 30th
proposals would be received by you until 7:00 o'clock p.m.,
Wednesday, July 21, 1954 for furnishing the Cast Iron Pipe
referred to therein, we are pleased to quote as follows:

"The above prices are f.o.b. our foundries with full freight
allowed to El Segundo, California, which would be prepaid by
us, for truck delivery to your City Pipe Yard, or jobsite,
where available to larl7e truck and trailer, minimum shipment
40,000 pounds. Prices include California State Use Tax of
3'Z on the basis of foundry value, and terms are net thirty
days.
"Our I40no -Cast pipe, on which we have quoted, would conform
to Federal Specifications Vd -P -421, Type II, and would have
our 'Enameline' lining, which is a cement lining 116" in
thickness applied by method embodying both mechanical and
centrifugal forces, together with a seal coat.
"As required, we are attaching bid bond in the amount of
Q'3,600.00.
"Based on our present commitments, if favored with your order,
we could commence delivery within approximately 20 days arid

complete within approximately 35 days, after receipt of or-
der, sooner if possible, but subject to delays beyond our
control.

and which said bid was submitted in response to and under the terms,
conditions, provisions and requirements set forth in said "NOTICE
INVITING BIDS ON CAST IRON PIPE FOR THE CITY OF EL SEGUNDOrr, be, and
the same is hereby accepted on the basis of delivery as set forth in
the above quoted bid as to Items Nos. 1, 2, 3 and 4 of said Notice
Inviting Bids at the prices set forth in said bid, which is now on
file in the office of the City Clerk of said City, and which said
bid so on file is hereby expressly referred to and by this reference
incorporated herein and made a part hereof for all further particu-
lars.
SECTION 2. The Contractor agrees, responsive to the pref-
erence of the City Council of said City as expressed in the notice
inviting bids, pursuant to which this contract is made, that only
American -made materials, and, so far as reasonably possible, Cali-
fornia -made materials will be used in the work or improvement con-
templated under this contract, all in conformity with the provisions
of Sections 4300 to 4305, both inclusive, and Sections 4330 to
4334, both inclusive, of the Government Code of the State of Cali-
fornia.
SECTION 3. The Contractor, insofar as said Contractor is
legally required so to do, must observe and abide by the provisions
of all laws of the State of California and of the United States of

America relating to contracts of the nature contemplated herein,
whether herein specifically mentioned or not.
SECTION 4. That all bids received for said cast iron pipe
are hereby rejected with the exception of the bid of AMERICAN CAST
IRON PIPE COMPANY, hereinabove referred to, and the City Clerk is
hereby authorized and instructed to return the checks of all unsuc-
cessful bidders.
SECTION 5. That the City Clerk shall prepare copies of
this resolution after the passage and adoption thereof, and shall
affix to such copies at the end thereof, after the Clerk's Certifi-
cate, forms for the approval of the successful bidder and on the
part of the said City; and such copies of this resolution, so ap-
proved and accepted by the successful bidder and by and on behalf
of said City, shall constitute the contract for furnishing and de-
livering to said City certain cast iron pipe, pursuant to the award
hereinabove made; and the Mayor of the City of El Segundo is hereby
authorized on behalf of said City to affix the approval and accept-
ance of said City to such contract, and said City Clerk is hereby
authorized and instructed to attest the same on behalf of said City
and to affix the seal of said City thereto.
SECTION 6. That the City Clerk shall certify to the
passage and adoption of this resolution; shall cause the original
of the same to be entered in the book of resolutions of the said
City of El Segundo, and shall make a minute of the passage and
adoption thereof in the records of the proceedings of the City
Council of said City, in the minutes of the meeting at which the
same is passed and adopted.

solution, being Resolution No. 1420, was passed and adopted by the
said City Council, approved and signed by the Mayor of said City,
and attested by the City Clerk of said City, all. at a regular meet-
ing of the said Council held on the 28th day of July, 1954, and
that the same was so passed and adopted by the following vote:
AYES: Councilmen Baker, Gordon, Swanson and Mayor
Selby;
NOES: Councilmen None;
ABSENT: Councilman Frederick.
