CC RESOLUTION 1374M RESOLUTION NO. 1374 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING THE FINDINGS AND DETE 6 INATIONS OF THE CITY PLANNING OF SAID CITY AS SET FORTH IN RESOLUTION NO. 171 OF Sj'= COMPIISSION THAT THE USE OF "VACUU114 METALI- ZATION" BE CLASSIFIED A ZONE "M -1" USE, WHEN CONDUCTED AS DESCRIBED AND LIMITED IN SAID RESOLUTION NO. 171. WHEREAS, the City Planning Commission of the City of El Segundo did heretofore on the 28th day of December, 1 953, after due consideration, adopt Resolution No. 171 of said Com- mission in words and figures as follows: "RESOLUTION NO. 171 WHEREAS, the Mirra -Cote Co. Inc., Specialists in Vacuum Metalization, has made inquiry concerning its classification under the Cityts zoning ordinance be- cause the type of business involves equipment and pro- cesses not identified in the zoning ordinance, and WHEREAS, both the present and proposed zoning ordinances make provision requiring the Planning Commis- sion, in the presence of omissions or ambiguities, to ascertain pertinent facts and recommend interpretations consistent with the spirit and purpose of the Ordinances (Paragraph A of Section 12 of Ordinance 306 as amended, and Section 1402 of impending new ordinancej, NOW, THEREFORE, BE IT RESOLVED, that the Com- mission finds as follows: (1) That the enterprise, as evidenced by an operating plant and buildings and installation plans presented, reveals that the use is definitely industrial in character. (2) That the major features comprising the plant include: (a) Offices, (b) Vacuum metalic precipitating and coating equipment, - 1 - 7406 (c) Two separated rooms devoted to dipping objects in enamel both for coating, drip draining and blower removal of surplus enamel, all on a conveyor belt, (d) Small compartments, separated from enamel rooms, for tbakingt enameled ob- jects; one treating non - metalic objects at 1400 fahrenheit, and the other unit for treating metalic objects at 3000 fahrenheit, (3) Ventilating equipment. (4) Outdoor storage of solvent inside cyclone fence, curbed enclosure with a capacity of 20 drums, and FURTHER RESOLVED, (1) That in terms of compat- ability as measured by degree of nuisance recognized by zoning standards, the use would fall naturally into the 1I -1 category of uses as defined in both the present and proposed zoning ordinances except for the enameling pro- cess and materials. (2) That in the respects enumerated in item (1) above, the establishment is comparable to service stations, auto painting and similar uses which, as a whole in each type of use ,could be required to be located in a heavier zone because of the hazardous character of certain materi- als employed, were it not for the fact that such natural hazard factors are minimized through the requirements of the Dangerous Chemicals Code, the Building Code, and simi- lar protective codes. (3) That such Codes would automatically apply to the instant case, thus bringing the use by reason of buildin- design, equipment and operation in the category of permissible uses in the M -1 Zone, and FINALLY RESOLVED, that a copy of this resolution be forwarded to the City Council for its consideration, and if concurred in, that the interpretation be hereafter followed in all related administrative acts. Allen Chairman of the City Plan-' ning Commission of the City Of El Segundo, California "; and WHEREAS, said resolution was duly certified to the City Council of said City for its consideration and action thereon, all as contemplated under the provisions of Ordinance 407 No. 305 (the land use plan - Zoning Ordinance) of said City, as amended; and 1HEREAS, said City Council has duly and carefully considered and discussed the said resolution and all of the terms, conditions and provisions thereof and is satisfied that the determination and decision made by said City Council, with reference thereto as hereinafter set forth, is correct and in the interests of said City and of the citizens thereof; now, therefore, - THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALI- FORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, FIND AND ORDER AS FOLLOWS; SECTION 1. Said Council does hereby find that the facts recited in the preamble of this resolution are true. SECTION 2. That said Council does hereby approve the findings, determinations and recormendations of the City Plan- ning Commission of the City of E1 Segundo, California, all as set forth in said Resolution No. 171 of said Commission, here - inabove quoted in the preamble to this resolution; and does hereby make the same findings and determinations on its own part as are made by said Commission in its said Resolution No. 1?1. SECTION 3. That said City Council does hereby accord- ingly establish the use of "vacuum metalization" as a use which properly may be, and is hereby authorized to be, located in the NI -1 zone as established under said Ordinance No. 306, as amended, when such use is conducted as described and limited in said Reso- lution No. 171. SECTION 4. That this Resolution shall take effect imme dzt e iy . SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same - 3 - 08 in the book of original resolutions of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of said City Council in the minutes of the meet- ing at which the same is passed and adopted; shall forward a certified copy of this resolution to the said City Planning Commission for its information and files; and shall Furnish a copy thereof to each of the departments of said City concerned with the enforcement of the zoning or land use regulations of said City for their information in the premises.
