CC RESOLUTION 1339RESOLUTION NO. 1339 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO CENTURY OIL COMPANY THE CONTRACT FOR FURNISHING THE CITY OF EL SEGUNDO WITH THE MATERIALS CONTEMPLATED UNDER ITEMS NOS. 1 TO 13, BOTH INCLUSIVE, OF THE NOTICE TO BIDDERS DATED JULY 1, 1953; REJECTING ALL BIDS UNDER ITEM NO. 1¢ OF SAID NOTICE; AND INSTRUCTING THAT THE MA- TERIALS REFERRED TO IN ITEMS NOS. 14, 15 AND 16 BE PURCHASED IN THE OPEN MARKET. WHEREAS, the City Council of the City of El Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bidders entitled "NOTICE TO BIDDERS ON GASOLINE, OIL, LUBRICANTS, AND ASPHALTIC EMULSION TO BE FURNISHED THE CITY OF EL SEGUNDO, CALIFORNIA. ", dated the lst day of July, 1953, which is now on file in the of- fice of the City Clerk, open to public inspection, and hereby re- ferred to and by this reference incorporated herein and made a part hereof, for furnishing said City with the items referred to in said notice; and WHEREAS, at the time for opening and considering all of said bids, to wit: the hour of 7:00 otclock p.m. (California Daylight Saving Time) on Wednesday, the 29th day of July, 1953, said Council did publicly open, examine and declare all bids re- ceived; and WHEREAS, at said hour said Council did take all of said bids under advisement until the hour of 7:00 otclock p.m. (California Daylight Saving Time) on Wednesday, the 5th day of - 1 - August, 1953, and referred said bids to the Director of Public Works for examination, recapitulation and report thereon; and WHEREAS, said last mentioned hour has now arrived and the Director of Public Works has submitted a report to this Coun- cil in words and figures as follows: "Date August 5, 1953 'To: City Council From: Director of Public Works Subject: Analysis of Gasoline and Lubricant Bids "Following is a tabulation of the bids for furnishing gasoline and lubricants which were received by your Board at its last regular meeting: TIDE RICHFIELD CENTURY SHELL WATER TEXAS OIL OIL OIL ITEM ASSOC. Shell Oil Company submitted a bid subject to price changes and with no guarantee of a maximum price, the current price being $.206 per gallon net to the City. Century Oil Company sub- mitted a premium grade gasoline at V.219 per gallonret to the City. Inasmuch as the Tide Water Associated bid was unsigned and the Shell Oil Company bid did not quote a firm price, it is recommended that these two bids be rejected for these two items and the award for Items No. 1 and No. 2 be made to Cen- tury Oil Company under the terms of their bid. ' TFrom the tabulation given above it can be seen that Shell Oil Company submitted the lowest bid on Items No. 3, 4 and 5; Centuuy Oil Company submitted the low bid on Items No. 6, 7, 80 10 and 13; the Texas Company submitted low bid on - 2 - Items No. 9 and 11 and Tide Water Associated submitted low bid on Item No. 12 and had the only bid on Item No. 14. No bids were received on Nos. 15 and 16. Assuming that all bidders would be willing to supply the individual items upon which their bid was low and that the City would use exactly the quantities given in the tNotice to Bidders' as the ap- proximate needs, the lowest total cost to the City for Items 3 through 13 is 4828.38. If an award was made to Shell Oil Company for all items 3 through 13 the total cost would be .867.98 while an award to Century Oil Company for all items 3 through 13 would result in a cost of $878.01. Inasmuch as Century Oil Company submitted the low bid on the greatest number of individual items from 3 through 13 and because of the greater convenience in dealing with a single supplier for all products, it is respectfully recommended that Cen- tury Oil Company be awarded the contract for supplying the City with lubricants under Items 3 through 13. "Inasmuch as only one bid was received on Item 14 and no bids received on Items 15 and 16, it is respectfully re- commended that all bids for these items be rejected and that the undersigned be authorized to procure these commodities on the open market. f1 DRS: VM "Respectfully submitted, /s/ Donald R. All drums not offered for re- turn in good useable condition within ninety days from date of delivery will be charged for at rate of $5.00 for each full drum, 44.00 for each half drum, 43.50 for each quarter drum. - 5 - • rr 0 - 6 - �';'" ;a' 44 - be and the same is hereby accepted as to Items Nos. 1 to 13, both inclusive, under said notice to bidders dated July 1, 1953, at the respective prices therefor set forth in said laid, which is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this reference incorporated herein and made a part hereof for all fur- ther particulars. SECTION 2. The Contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this contract is made, that only American -made materials and California -made materials will be used in the work or improvement contemplated under this contract, all in conformity with the provisions of Sections 4300 to 4305, both inclusive, and Sections 4330 to 4334, both inclusive, of the Government Code of the State of California. SECTION 3. The Contractor, insofar as said Contractor is legally required so to do, must observe and abide by the provisions of all laws of the State of California and of the United States of America relating to contracts of the nature contemplated herein, whether herein specifically mentioned or not. SECTION 4. That all bids received under said Items Nos. 1 to 13, both inclusive, under said notice to bidders, with the exception of the said bid of said CENTURY OIL COMPANY, be and the same are hereby rejected; and the City Clerk is hereby authorized and instructed to return the checks of all unsuccessful bidders. SECTION 5. That all bids under Item No. 14 of said no- tice be and the same are hereby rejected, as the City Council be- lieves and hereby finds and determines that the materials referred to in said Item No. 14 can be purchased to better advantage and at a lower price in the open market and does hereby accordingly order that such materials referred to in said Item No. 14 be pur- chased, as needed, in the open market. The City Clerk is authorized — 7 — ;J,G Ir.,y�Yi to return the deposit checks to all bids under said Item No. 14. SECTION 6. That since no bids were received on Items Nos. 15 and 16 of said notice inviting bids, the City Council hereby declares that in its ,judgment further advertising would be of no avail and therefore does hereby determine and order that the materials referred to in said Items No. 15 and 16 be purchased in the open market. SECTION 7. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerk's Cer- tificate, forms for the approval of the successful bidder and on the part of the said City, and such copies of this resolution, so approved and accepted by such successful bidder and by and on behalf of said City, shall constitute the contract for furnishing to said City all of the items and materials mentioned in said Items Nos. 1 to 13, both inclusive, in said bid, and which are to be furnished by such successful bidder pursuant to the award here - inabove made. SECTION 8. That the Mayor of the City of El Segundo is hereby authorized and directed to execute the contract or agreement between said City and said successful bidder; and the City Clerk to attest the same; affix the City's seal thereto and make delivery thereof in due course, as hereinabove awarded. SECTION 9. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of E1 Segundo; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City ,.F Council of said City in the minutes of the meeting at which the same is passed and adopted.
